I believe roommate agreements are a very good idea, yes. I don’t know that you need to involve an attorney, unless you are talking about something extraordinary, or a romantic relationship. But it doesn’t hurt to have one review or even write the agreement.I think people who are in romantic relationships who live together should have formal relationship/roommate agreements.As far as roommate agreements for non-romantic roommates, I think they should spell out financial arrangements, who is responsible for doing what in the home, what happens if you purchase something jointly and so on. They should also address visitors, how long they can stay, methods for approving any additional roommates and other things where there are often disputes. They should have a non-court method for resolving disputes when possible. Especially if they involve who is and isn’t cleaning the house or whether someone has violated the visitor’s rule. This might require that the people agree on a neutral third party to help them solve the problem. They should address legal fees if court and lawyers are required.If you cannot agree on or aren’t sure what the roommate agreement should contain, then you ought to include a lawyer. Technically, you should have two lawyers, but if you can work through it with one, all the better.Now, romantic relationships essentially need a prenuptial agreement. Because without marriage there are no protections and people often get themselves in nasty situations. Each person should have their own lawyer. One lawyer can draft the other lawyer can review.
