I suspect you are involved in an H-1B contract labor scam.The scam works by:Setting up contract labor company AGetting H-1B employees for the contract labor company AContracting out the labor of the H-1B employees to company B for a very high hourly ratePaying the H-1B workers a very small salary, which generally covers the employee portion of the benefits costs associated with them being a salaried employee of company A, and nothing else — or a small amount on top of thatPaying the H-1B workers some absurdly small percentage of the contract rate, and taking the rest of the hourly costs to company B as profit for company AThe contract rate payments are on top of the salary; this is structured as a “base plus commission” deal, where most of the money is paid to the H-1B employee contingent on payment to the contracting company A, by company BIt’s a scam on the H-1B workers, since the H-1B worker is usually lured in with the promise of the company pursuing a green card on behalf of the employee.If company B doesn’t pay, you don’t get your commission; but you get your “salary” (the base), which typically means you don’t receive any other payment from the company, or a small token amount as salary.It also means you are pretty much slave labor:If you report the company and they go out of business, you lose your H-1B status and your green card sponsorIf you report the company, and they don’t go out of business, but they fire you, you lose your H-1B status and your green card sponsorIf a green card application has already been started, you are pretty much stuck there; the company can intentionally “go slow” on this process, for up to a decadeIf you jump ship to another company (it’s possible), it generally means a restart on the green card process — and finding a new sponsorIf you get dumped, unless you can get a new job willing to sponsor your H-1B in a few weeks, you are getting deported or becoming illegal.Another company taking over the H-1B, while doable, you have to be pretty impressive for a company to be willing to do this, even though it’s outside the usual H-1B process, and doesn’t cost them a lot, and can take place outside the lottery quotas.You’re still stuck on the green card sponsorship, unless the new company is willing to start the process on your behalf, or you can start the process on your own behalf.If you’ve been in this situation for a while with a scam company, there is a clock on the H-1B, and you’ve run some/a lot/most/all of that clock out while the contracting company was foot-dragging.Given the non-payment due to time-cards, this is almost certainly an H-1B contract labor scam.You are probably being scammed.Your best recourse is to pursue several avenues at once:Contact company B to get the May 2017 time sheets approved; this has several problems:They may be out of business, in which case you are not going to be paid, if there is a commission contingency on the work performed; your company A doesn’t get paid by company B? You don’t get paid by company A. End of discussion, unless company A is willing to press their relationship with company B as a creditorCompany B may contact company A about your inquiry; if company A is doing anything shady at all? You’re looking at finding a new job or being deported, if you can’tLook for other work at someone willing to take over your H-1B sponsorship; this also has several problems:Under no circumstances do you want the new company contacting company A, to you are going to be out on your butt; they may also do things that risk your H-1B sponsorship, such as retract the skills affidavit that they had to file to justify the H-1B: “They weren’t actually as skilled as it appeared from their credentials and their interview”. You will have a hard time transferring your H-1B, or getting another one in the future, if this happens.You don’t want company A finding out about this in any other way; that means no “dental appointments”, unless you also make insurance claims (that’s the number one excuse people use when they are interviewing elsewhere); you don’t tell your coworkers; you don’t tell your friends: tell no one who is not a reference.Contact the Department Of Labor:You will have to “take your lumps”: you’re going to have to find another employer, or you’re going to have to leave the country, but at least you will be able to come backNo one else will be scammed the same way by company A; instead, they will get scammed by entirely different companies, since these companies pop up like mushrooms after a rainAlternately… it was last May… count the money as “lost”, and get on with your life. If that’s the case — I’d personally go for option #2, above: get out of the bad situation.It’s an unfortunate reality that such companies exist.However, if something is too good to be true: it almost certainly is.If you are contemplating an H-1B position in the U.S., do not go to work for companies that pay the majority of your income off “contingency”, “commission”, “bonus”, or similar schemes not involving direct payment of salary.An H-1B worker is supposed to have been granted the visa because they have certain valuable skills not available to them from the pool of U.S. applicants for the position they are offering. If you actually have those skills, then your salary should reflect that; otherwise you are probably being scammed.
