Damages incurred as a result of a lawful warrant are difficult to recover, though some cases do see reimbursement. There have been several cases where damages were compensated and others where the courts ruled that under a doctrine known as sovereign immunity, the government can’t be held liable in cases such as these.Because a search warrant is issued by a judicial official based on the sworn statements of a law enforcement officer; the affidavit says law enforcement seeks to locate and seize evidence of a specific criminal violation, it’s not an assurance that it’s going to be found, but that there is a reasonable believe that it is. The affidavit and warrant will cite what the specific violation(s) are and the evidence being searched for. There are two parts to the answer. First, as long as they just swore to what they actually saw then there is nothing to charge them with. What they saw may or may not have been actual tampering. For example, you see someone breaking into a car and swear to that. You don’t know if it was the car owner who locked their keys inside the car (not a crime for them to be breaking in) or someone trying to steal from the car. It turns out to be the owner. Should you be prosecuted for your sworn statement you saw them break in? No. You did not lie. The same applies to those who witnessed what they believed to be election tampering.Second, no one claims there was absolutely no election tampering or fraud but rather that it was immaterial to the outcome of the election. There will always be a ballot here or there that is not properly handled, but that isn’t enough to swing an election. The question at hand was if there was a massive amount of fraud involving many thousands of ballots in a close race, and evidence of that was never found. So it is quite possible that someone witnessed a minor case of election tampering (e.g., someone helping a senior in a nursing home fill out their ballot and suggesting candidates) and accurately swore to that. What would be the grounds on prosecuting them? None.Now if someone swore to something they didn’t actually witness, they should indeed be prosecuted. But my guess is that nearly all of them swore to things they did witness, but their interpretation of what was happening was wrong.

Old men, two of them, probably in their 70s, “enjoying” lunch without their wives, but spending the time crabbing about their “old ladies,” when they weren’t laughing uproariously about the women’s foibles and their own (Imaginary, I believe) triumphs over them. I was going to grow old just like their bad-tempered bitches and I should just mind my own f’n business and let two old codgers enjoy their day without wimmen interfering with their personal opinions. Since I was close to their age, I agreed, took my granddaughter, and left, despite having already ordered. I tossed twenty bucks (enough to cover a grilled cheese sandwich and a cup of soup) on the counter at the front and told the owner why I was leaving. She gaped at me and said, “But they always talk that way. They’re regulars. It doesn’t mean anything.” My granddaughter, who is mentally handicapped and sweet as a rosebud and I were also regulars, only we usually went about an hour later than we did that day. We have never been back.
