Somebody messed up.When the two Carolinas were created as separate British colonies, they were supposed to be split by two simple straight lines: one running northwest from the Atlantic Coast to the 35th Parallel, the other following the 35th parallel due west. In other words the diagonal black line running from the coast in a northwesterly direction was supposed to continue Northwest until it intersected the black line running in an East-West direction. But it wasn’t so easy.The original 1735 survey party had members who sometimes didn’t show up, sometimes didn’t get paid, and often gave up while trudging through the swamps and wilderness they encountered in the Carolina lowlands country on their way up from the coast. That may explain why they failed to reach their target, the 35th Parallel, after two years of effort: Instead, they drove a stake into the ground 12 miles too far to the south, and went home.Another party, sent out in 1764 to continue the survey, headed west from that same stake, thinking erroneously that the previous surveyors had indeed reached the 35th parallel. The 35th parallel was supposed to intersect the Catawba Indian Nation as it went west. When the survey crew never found the Catawba Indians, they sent out scouts and found the Indians 12 miles to the north. That was when they realized their error. By the time they detected their error, 64 miles later, they had shaved 422,000 acres off what was supposed to be South Carolina.An effort was made to compensate South Carolina with more territory by continuing the westward line slightly north of the 35th Parallel. Look for how the border in the westward portion of the boundary on the second drawing is slightly north of the red line.So the survey team at that time navigated their way northwest around the Catawba Indian Nation and then back southwest until they were mired in the swamps of the Catawba River and decided to use the Catawba River north as the boundary. The boundary was re-surveyed at least three times, in 1813, in 1815, and in 1905, without doing much of anything to correct the original errors. Both states agreed to what is largely the current boundary in 1815.There the border, tenuous as it was, might have stayed except for the construction of the Fort Mill dam in the early 1900′s and the subsequent flooding of the Catawba River to create Lake Wylie. The flooding inundated thousands of acres of land, and a border that might have been found was now lost.This is the best image I can come up with that shows what was supposed to happen and what did happen:And there the matter stayed until the 1990′s when the Duke Energy Corporation offered to sell the two states land that straddled both of them in order to create a state park. The utility asked the not unreasonable question of exactly where the boundary ran. The trouble was, neither state knew. And neither state wanted to buy land that wasn't already within their borders and suffer the subsequent legal problems that might bring.In 1993 the two states’ mapping agencies pledged to cooperate, harnessing geospatial technology to old-fashioned detective work. In one border segment near Charlotte, NC, they unearthed colonial-era property maps that had used the boundary trees as tract corners and overlaid Geographic Information System data — mapping technology accurate to within inches — to calculate where the trees once stood.In another segment, researchers found a stone boundary monument that had been set as part of a 1928 re-survey, except it now stood near a tee on a golf course. Officials at the course had moved it years before so golfers could brag about their two-state tee shot. Using the original 1928 maps, advanced mathematics, and some informed guesswork, the joint survey teams navigated to the exact spot where the monument had been uprooted, and even found its broken-off base.By 2013, the entire 334-mile boundary had been relocated and re-marked. Unfortunately, it was not always where people had thought it was. Some residents living near the boundary discovered that their homes were in fact in a different state. A North Carolina doctor discovered that the room in his home where he sometimes saw patients was in fact in South Carolina, and worried he would have to get a South Carolina medical license.Fortunately, the two states had seen this coming, and the Joint Boundary Commission they formed to oversee the surveying began to catalog potential negative impacts. The commission sent letters and aerial photos to 173 landowners warning that their lives — and sometimes their addresses — could change, and asked for comments.One man had bought a gas station in the early 1990’s just south of what he thought was the state line to take advantage of South Carolina’s significantly lower gas tax, as well as the ability to sell beer and fireworks. Unfortunately, the survey work showed conclusively that his pumps were in a part of North Carolina where gas is more expensive, beer sales are not allowed and fireworks are illegal. As he told commissioners in a public meeting, “Our business is going to be destroyed.”However, both states had pledged to cooperate in this endeavor, and they stuck to it. In 2016, nearly three centuries after surveyors began delineating the two Carolinas, the governments of North and South Carolina agreed on a boundary between the two states.21 homes switched states as a result of the change. 54 additional properties were affected, with the new border splitting their properties across the two states, in some cases the new border ran right through the middle of their home.A bill signed by the state’s Governors settled issues that affected those property owners, such as where their children will go to school. The legislation said that residents who moved from North Carolina to South Carolina will remain eligible for North Carolina in-state tuition for 10 years after the change, provided that they remain on the same property that was formerly in North Carolina. Residents whose homes moved from South Carolina to North Carolina are eligible for South Carolina in-state tuition for two years after the change.The gas station that was affected by the change and moved from South Carolina to North Carolina will continue to sell gas at South Carolina prices as well as to sell liquor and fireworks. This agreement will only change if the property and business are sold to a new owner. It was during these surveys, in 1768, that Cook discovered the error of the 1764 boundary survey. South Carolina’s Governor Lord Charles Montagu had initially been receptive to the North Carolina governor’s proposal to extend the 1764 boundary due west to the Cherokee boundary. However, his attitude quickly changed when he learned of Cook’s discovery of the error. For compensation for the loss of territory resulting from the 1764 boundary survey, Governor Montagu proposed running the boundary up the Catawba River past the 35th parallel and then west and sent James Cook to survey that region.I can find nothing that tells me why Governor Montagu didn't instruct surveyor Cook to start over again at the origin of the original error. Carowinds straddles the state line, but that section of the boundary remained where it was. The properties that were affected by the boundary change were slightly west of the theme park west of the Catawba River.Update 3: In response to a question about whether Federal Government approval was needed: No Federal Government or US Congressional approval was needed because the official statement from both state governments was that this effort was reaffirming where the boundary was that was agreed to by both states in 1815. Thus, any “moving” of the boundary was putting the boundary back where it was agreed to in the 1815 survey.
