So, how do you get such a visa and then board your flight to the USA?[insert sound of the needle dragging viciously across a record]Most of of mom-and-pop shops (but not all) are really questionable organizations set up by generally well-to-do Indians who buy a hand-full of H1b Visas that they sponsor their contractors with. Some of them make up fake contracts and then make all sorts of threats that -- unfortunately -- paternalistic Indians accept (more often than not) on the grounds that they are used to deferring to seniors, professionals and managers because of a cultural imperative to do so. Every week, I have to console XYZ Indian because their "vendor" has threatened to send them back to India. So, before this, KNOW YOUR RIGHTS. (that discussion for another time, but suffice it to say, slavery is illegal in the USA)The H1b laws require the sponsor to EMPLOY that person directly (as a W2 employee) and pay them the minimum wage of the state in which they operate. This is around $7.25 per hour (states vary). When they are off contract this is what they get. When they are ON CONTRACT, most operate on an 80/20 split (the sponsor keeps 20% and the contractor gets 80%). This ain't so bad nor is it unethical. This is a business, and the sponsor needs to make money off of the investment, especially since they assume a lot of risk. What's unethical is how they treat their contractors and much of what goes on. (again, be informed)A number of the top staffing companies like (List ranks largest IT staffing firms) are actually quite ethical in their H1b process and treat their contractors like gold (I know my employer does!). But, unlike the mom-and-pop firms, they won't typically keep a contractor on-duty if they cannot find an assignment within X amount of time and/or if they don't receive high marks for their performance. These big companies have reputations to uphold and they won't accept anything but top performers (very reasonable). So, while they'll sponsor, they will demand hard work. Whereas with the mom-and-pop the standards of service may be lower, but they exercise greater degrees of exploration.Your goal to get into the USA will be the same for either route, but I highly recommend a company like Experis, TEKSystems, Adecco, RobertHalf, Randstad (they will treat you very well).
