PDF Editor FAQ

Would a total gun ban & universal confiscation violate the "ex post facto" clauses, even if the 2nd Amendment were repealed?

There’s a wider classification of laws that it would actually prohibit the act, which is known as a ‘bill of attainder’. The term of art is considered to be obsolete, being only ‘punitive’ The term of art though was heavily discussed in multiple supreme court decisions dating up to the Nixon administration, and in the post-civil-war reconstruction period. The court cases involved:Cummings v. Missouri, 71 U.S. 277 (1867)Ex parte Garland, 71 U.S. 333 (1866)Aptheker v. Secretary of State, 378 U.S. 500 (1964)United States v. Brown, 381 U.S. 437 (1965)From Cummings:"A British act of Parliament," to cite the language of the Supreme Court of Kentucky, "might declare, that if certain individuals, or a class of individuals, failed to do a given act by a named day, they should be deemed to be, and treated as convicted felons or traitors. Such an act comes precisely within the definition of a bill of attainder, and the English courts would enforce it without indictment or trial by jury.In the US, however, the bill of attainder clause went further and also affected ‘bills of pains and penalties’. This was also part of the Cummings case."Whatever respect might have been felt for the State sovereignties, it is not to be disguised that the framers of the Constitution viewed with some apprehension the violent acts which might grow out of the feelings of the moment, and that the people of the United States, in adopting that instrument, have manifested a determination to shield themselves and their property from the effects of those sudden and strong passions to which men are exposed. The restrictions on the legislative power of the States are obviously founded in this sentiment, and the Constitution of the United States contains what may be deemed a bill of rights for the people of each State. "Page 71 U. S. 323 "No State shall pass any bill of attainder, ex post facto law, or law impairing the obligation of contracts." A bill of attainder is a legislative act which inflicts punishment without a judicial trial. If the punishment be less than death, the act is termed a bill of pains and penalties. Within the meaning of the Constitution, bills of attainder include bills of pains and penalties. In these cases, the legislative body, in addition to its legitimate functions, exercises the powers and office of judge; it assumes, in the language of the textbooks, judicial magistracy; it pronounces upon the guilt of the party without any of the forms or safeguards of trial; it determines the sufficiency of the proofs produced, whether conformable to the rules of evidence or otherwise; and it fixes the degree of punishment in accordance with its own nations of the enormity of the offence. But it goes beyond this case to a much older case.Fletcher v. Peck, 10 U.S. 87 (1810)No State shall pass any bill of attainder, ex post facto law, or law impairing the obligation of contracts. A bill of attainder may affect the life of an individual, or may confiscate his property, or may do both. In this form, the power of the legislature over the lives and fortunes of individuals is expressly restrained. What motive, then, for implying, in words which import a general prohibition to impair the obligation of contracts, an exception in favour of the right to impair the obligation of those contracts into which the State may enter? The State legislatures can pass no ex post facto law. An ex post facto law is one which renders an act punishable in a manner in which it was not punishable when it was committed. Such a law may inflict penalties on the person, or may inflict pecuniary penalties which swell the public treasury. The legislature is then prohibited from passing a law by which a man's estate, or any part of it, shall be seized for a crime which was not declared by some previous law to render him liable to that punishment. Why, then, should violence be done to the natural meaning of words for the purpose of leaving to the legislature the power of seizing for public use the estate of an individual in the form of a law annulling the title by which he holds that estate? The Court can perceive no sufficient grounds for making this distinction. This rescinding act would have the effect of an ex post facto law. It forfeits the estate of Fletcher for a crime not committed by himself, but by those from whom he purchased. The very revocation of a right without trial or outside of a sentence is also a bill of attainder; the naming of the right as an exemption to public power is a recognition of its full vesting. This was made more firm in the 14th amendment and the reconstruction acts following the 14th, during that dark period when men in masks rampaged through southern streets, burning homes, murdering and beating people because they voted the ‘wrong’ way or had the termerity to engage in rights that were inherent in all of those of the class of ‘citizen’.Even a child knows one may be punished by exclusion from a favored group, or inclusion into a disfavored group. The objective was to maintain a system of general and uniform law, to prevent the legislature from making laws to their own advantage and disadvantaging other groups.Ex post facto laws are a particularly egregious subcategory of attainder; but they remain an attainder none the less.Back to CummingsBe it enacted, that all persons who have heretofore, at any time, entered or left the State of Missouri, with intent to avoid enrollment or draft in the military service of the United States, shall, upon conviction Page 71 U. S. 329 thereof, be forever rendered incapable of holding any office of honor, trust, or profit in the State, or of teaching in any seminary of learning, or of preaching as a minister of the gospel of any denomination, or of exercising any of the professions or pursuits mentioned in the second article of the constitution -- there would be no question of the character of the enactment. It would be an ex post facto law, because it would impose a punishment for an act not punishable at the time it was committed. The provisions of the constitution of Missouri accomplish precisely what enactments like those supposed would have accomplished. They impose the same penalty, without the formality of a judicial trial and conviction, for the parties embraced by the supposed enactments would be incapable of taking the oath prescribed; to them, its requirement would be an impossible condition. Now, as the State, had she attempted the course supposed, would have failed, it must follow that any other mode producing the same result must equally fail. The provision of the Federal Constitution, intended to secure the liberty of the citizen, cannot be evaded by the form in which the power of the State is exerted. If this were not so, if that which cannot be accomplished by means looking directly to the end can be accomplished by indirect means, the inhibition may be evaded at pleasure. No kind of oppression can be named, against which the framers of the Constitution intended to guard, which may not be effected. The deprivation of the right in property against men who have done no wrong is absolutely a bill of attainder, and one of the worst possible sort. It seeks to penalize the potential of a future act, by deprivation of the right and the property of those who had no part(and arguably, had no evidence that they ever intended to do such an act).It is a doctrine of separated powers; i.e. a doctrine by which the Legislature cannot set itself up as a judicial body to strike at the core of the citizenry which authorizes it to exist. From Brown"Nothing is more common than for a free people, in times of heat and violence, to gratify momentary passions by letting into the government principles and precedents which afterwards prove fatal to themselves. Of this kind is the doctrine of disqualification, disfranchisement, and banishment by acts of the legislature. The dangerous consequences of this power are manifest. If the legislature can disfranchise any number of citizens at pleasure by general descriptions, it may soon confine all the votes to a small number of partisans, and establish an aristocracy or an oligarchy; if it may banish at discretion all those whom particular circumstances render obnoxious, without hearing or trial, no man can be safe, nor know when he may be the innocent victim of a prevailing faction. The name of liberty applied to such a government would be a mockery of common sense. [Footnote 18] "We do not hold today that Congress cannot weed dangerous persons out of the labor movement, any more than the Court held in Lovett that subversives must be permitted to hold sensitive government positions. Rather, we make again the point made in Lovett: that Congress must accomplish such results by rules of general applicability. It cannot specify the people upon whom the sanction it prescribes is to be levied.Under our Constitution, Congress possesses full legislative authority, but the task of adjudication must be left to other tribunals. Page 381 U. S. 462This Court is always reluctant to declare that an Act of Congress violates the Constitution, but, in this case, we have no alternative. As Alexander Hamilton observed:"By a limited constitution, I understand one which contains certain specified exceptions to the legislative authority; such, for instance, as that it shall pass no bills of attainder, no ex post facto laws, and the like. Limitations of this kind can be preserved in practice no other way than through the medium of the courts of justice, whose duty it must be to declare all acts contrary to the manifest tenor of the constitution void. Without this, all the reservations of particular rights or privileges would amount to nothing. [Footnote 40]"In the case of gun forfeiture via congressional edict, it would be directly targeted agains the class of persons known collectively as ‘gun owners’ or ‘gun possessors’. Effectively the congress has declared the initial title, dominion, and control of the property, and the right void for ‘dangerousness’ and voided the very rights which that selfsame government was established to protect, as a foundation for the powers delegated to it.No state, in any portion of their powers, can accomplish such an act, even via amendment of their own constitution or the federal one, while the clauses in article 1, section 10 exists. The federal government is forbidden as well.Such a doctrine is old. It would equally forbid the prohibiton of ‘gay marriage’, the estabishment of personal bonuses and benefits for legislators, personal projects benefiting said legislators, and exemption from their own laws for themselves and their friends. From the Federalist No 57Hence, in the fourth place, the House of Representatives is so constituted as to support in the members an habitual recollection of their dependence on the people. Before the sentiments impressed on their minds by the mode of their elevation can be effaced by the exercise of power, they will be compelled to anticipate the moment when their power is to cease, when their exercise of it is to be reviewed, and when they must descend to the level from which they were raised; there forever to remain unless a faithful discharge of their trust shall have established their title to a renewal of it. I will add, as a fifth circumstance in the situation of the House of Representatives, restraining them from oppressive measures, that they can make no law which will not have its full operation on themselves and their friends, as well as on the great mass of the society. This has always been deemed one of the strongest bonds by which human policy can connect the rulers and the people together. It creates between them that communion of interests and sympathy of sentiments, of which few governments have furnished examples; but without which every government degenerates into tyranny. If it be asked, what is to restrain the House of Representatives from making legal discriminations in favor of themselves and a particular class of the society? I answer: the genius of the whole system; the nature of just and constitutional laws; and above all, the vigilant and manly spirit which actuates the people of America, a spirit which nourishes freedom, and in return is nourished by it. If this spirit shall ever be so far debased as to tolerate a law not obligatory on the legislature, as well as on the people, the people will be prepared to tolerate any thing but liberty. Such will be the relation between the House of Representatives and their constituents. Duty, gratitude, interest, ambition itself, are the chords by which they will be bound to fidelity and sympathy with the great mass of the people. It is possible that these may all be insufficient to control the caprice and wickedness of man. But are they not all that government will admit, and that human prudence can devise? Are they not the genuine and the characteristic means by which republican government provides for the liberty and happiness of the people? Are they not the identical means on which every State government in the Union relies for the attainment of these important ends? What then are we to understand by the objection which this paper has combated? What are we to say to the men who profess the most flaming zeal for republican government, yet boldly impeach the fundamental principle of it; who pretend to be champions for the right and the capacity of the people to choose their own rulers, yet maintain that they will prefer those only who will immediately and infallibly betray the trust committed to them? Were the objection to be read by one who had not seen the mode prescribed by the Constitution for the choice of representatives, he could suppose nothing less than that some unreasonable qualification of property was annexed to the right of suffrage; or that the right of eligibility was limited to persons of particular families or fortunes; or at least that the mode prescribed by the State constitutions was in some respect or other, very grossly departed from. We have seen how far such a supposition would err, as to the two first points. Nor would it, in fact, be less erroneous as to the last.
