As the names suggest, the WA is about the terms of withdrawal and the PD sets out a general, broad description of the future relationship.Both parts of the agreement are legally binding. The WA is specific, while the PD describes a broad landing zone. The point needs to be re-emphasised as it is often misunderstood: both parts of the agreement are legally binding.Let’s quickly recap the May deal (which was rejected by Parliament) before moving to the Johnson deal.May:The WA included a commitment to keeping many of the EU’s regulations (note, the same regulations)The WA included a “backstop” that said that if no arrangement could be found to achieve a frictionless border in Ireland, the whole of the UK would remain largely subject to all EU regulations, indefinitelyThe PD included a commitment to a customs union (well, it didn’t quite call it that, it called it a “customs territory”, but that was just a bit of cosmetic engineering)For the four groups mentioned above, May’s deal was:Hated by Ultra-Remainers, who reject any form of BrexitGrudgingly tolerated by Remainers, as it painted a picture of a future relationship that looked very much like membershipHated by Brexiteers and Ultra-Brexiteers as it looked too much like EU membershipNow to Johnson:The WA removed the specific commitments on regulation and moved them to the PD, where they became much more general (commitments to maintaining standards without stipulating those standards would be met by the EU’s exact regulations)The WA placed Northern Ireland, effectively in a single market with the rest of Ireland, and administrative controls in the Irish Sea.
