Police like bouncers. They like having people delivered subdued and, if possible, handcuffed. It would take a lot to turn the police against such a useful ally. I had a bouncer client. We sued the strip club he worked for. He had some great stories about the friendly relationships he had with police.I once sued a couple bouncers and the bar John Henry's in Eugene, Oregon for choking my client into unconsciousness and breaking his jaw. It was a real learning experience. I got both 911 tapes - my client’s and the bar owner’s.The dispatcher basically cross examined my client. He mistakenly said he had been at Sam Bond’s (another bar with a man’s name in town.) The dispatcher, and later the police and the bar, used that against him. When the police arrived they treated him as a criminal and investigated and wrote up the report as a trespass.According to the bouncers and bar tender, my client had been 86d from the Horse Head, a bar next door to John Henry’s under the same ownership. When the bartender told him that he had to leave, he paid for his drink, left a nice tip and tried to leave, but the bar tender had summoned his off duty bouncers, who were drinking at another bar across the street. There was a third bouncer who had a felony conviction for unlawful delivery of Cocaine, so he should not have been doing any security work, and they denied he was involved. My client’s memory remained foggy on the assault, as is common in cases of unconsciousness.The owner of the bar called 911 and said there was a guy out front who got beat up and was bleeding from his mouth and might need help, but denied knowing who beat him up. Once they heard that my client had mistakenly said he was at Sam Bond's John Henry's claimed he was not injured when he left their bar. They stuck with that story until I got the owner in deposition and played his 911 call for him, which he apparently forgot he had made. The case settled for policy limits.I asked the bouncer about the idea of being 86′d. He could not tell me whether being 86d was a permanent or temporary thing, and no one I have asked has been willing to say it is either, which goes to the theory that my client was trespassing at all, or whether he was trespassed from the neighbor bar. It probably did not help matters that my client was a Native Alaskan, with darker skin, hair and eyes, and the bar owners were sons of a Eugene Sand and Gravel bigwig and the main bouncer was an Oregon native son of a guy who is something of a politician.I had the BPST (Board of Police Standards and Training, who certify private security guards) investigate the bar. The bar denied having bouncers at all. They claimed the men bused tables and collected cover charges at the door. The BPST sent letters and I think that's as far as it went.
