It’s not a legend. It is a fact. The "Charter Oak" within which the Connecticut colonial charter was briefly hidden, stood on the Wyllys estate in Hartford until it was felled by a windstorm in 1856.Clearly the circumstances surrounding this “legend” were very significant, and many of the issues that were raised at the time can be seen as resurfacing during the crisis of the American Revolution and the formulation of the US Constitution and Bill of Rights in the century to come.The Dominion of New England was formed by Royal decree of Charles II in 1686 under Governor Sir Edmund Andros and merged the independent colonies of Connecticut, Massachusetts, New Hampshire and Rhode Island, together into one large colony. Colonial charters were confiscated — all but that of Connecticut, which was hidden in the hollow of an oak tree, a legally meaningless but highly symbolic gesture. From hence comes the phrase charter oak, which is common in Connecticut to this day. The specific objectives of the Dominion included the regulation of trade under the Lords of Trade, reformation of land title practices to conform more closely to English methods and practices, coordination on matters of defense, and a streamlining of the colonial administration. In 1687, Andros was so angered by Connecticut's failure to cooperate with the new regime that he and armed retainers tried to take physical possession of the colony’s charter. Neither faction sustained casualties during the revolt.Checks and Balances: In 1688 during the crisis known as the Glorious Revolution, the British Crown, under Andros, briefly attempted to consolidate arbitrary royal rule over the so-called Dominion of New England (including New York and New Jersey) in which the power of the legislatures were limited, the towns restricted to a single annual meeting, and the establishment of Anglicanism enforced.Property: Because the old charters had been revoked, all the old land titles were brought into question. All landowners were informed that the titles to their land had been voided. The land now belonged to the king and the landowners were required to petition the government for new titles. To make matters worse, the government soon discovered that many colonials had actually purchased their land directly from the local Native tribes, which was not allowed, and lacked any proof or evidence of ownership.Taxation: Since Massachusetts had no pre-existing tax laws, a scheme of taxation and revenue enhancement was created by the Lords of Trade in London that would apply to the entire dominion. The first proposal derived its revenues from import duties, principally from alcohol production. The first attempts to enforce the revenue laws were met with stiff resistance from a number of communities. Relatively poor landowners were hard hit because of the high rates on livestock, and mariners from duties derived from whaling. Promised safe conduct, Andros was marched under guard to the townhouse where the colonial council had assembled. He and others were held for 10 months before being sent to England for trial. King James II (Stuart) was successfully deposed, and the individual colonies returned to their previous form of local governance in 1691 by decree of William III and Mary (Stuart), James’ own elder daughter. The Stuarts had believed that the well being of the empire lay in the enforcement of the Navigation Acts; that the colonial governments had shown a tendency to resists such laws — a spirit of independence must be controlled. William and Mary made few changes in these policies.A Dutch rebel in New York named Jacob Leisler, buoyed by the crowning of William of Orange as king of England, raised a group of his countrymen, seized Fort William in lower Manhattan, and attempted to gain control of the colony. However, Albany was still controlled by the Conservative Party under the leadership of Mayor Peter Schuyler. The unrest continued until word came from King William and Queen Mary appointing Leisler governor. Ironically, Leisler was later hanged for having overstepped his authority and plotting treason.The new king and queen reissued the charters with additional guarantees of local sovereignty. Sam Adams later noted that the royal charters issued to many of the colonies and sanctioned at the end of the previous century by William III and Queen Mary secured to the American people “all the English liberties” and “some additional privileges which the common people in England had not.” It was at this time that the English Bill of Rights (1689) was issued, which contained provisions for the keeping and bearing of arms by the citizenry.
