How possible is it to lose the license to practice law in one state but still retain the license in another state? Can a lawyer reapply to the bar, after disbarment?
I am not the expert here, but I have been reading Bar Disciplinary Notices for more than 45 years and have represented healthcare providers before State Agencies where discipline against the providers’ licenses are the subject of an investigation or a hearing on retaining the license. There are two distinct questions here: 1) will Attorney discipline in one State result in discipline (e.g. loss of license or something less, such as a reprimand) in another State or States where the lawyer is licensed and 2) if a lawyer is disbarred, is the lawyer entitled to seek re-admission to that Bar.As a general matter, discipline by a Bar Association or the Supreme Court of the State against a lawyer in which State that lawyer is licensed to practice law triggers an investigation and then the consideration, in a hearing, of charges whether the lawyer has violated the Rules of Professional Conduct in the other State or States in which a lawyer also is licensed. There likely be a reporting requirement: if one lawyer’s licensing agency makes charges against a lawyer, that lawyer on his or her own must report that to the Bar or Court or whoever licenses lawyers in that other State or States. This reporting requirement, if overlooked or purposely ignored, may trigger another, different charge for discipline against the lawyer. If a disbarment of the lawyer ensues, after a hearing or a plea by the lawyer, readmission is governed by the Rules of the Bar, the Court or the licensing agency, likely will state in the Order of Disbarment whether or not re-admission is possible. A minimum time of exclusion from practice is determined by the rules of the State Bar, Supreme Court, or licensing authority. Most disbarment Orders I have seen are permanent and say so, but a lawyer may file a petition for reinstatement at which time the Bar will conduct an field investigation of character references, work or other experiences during the period of disbarment, and, among other things, whether any criminal activity was reported during that interval. For the record, there are forms of discipline for lawyers less severe than disbarment: Reprimand (a written warning and counseling) or Suspension from practice for a minimum period of time. In most cases of suspension or a petition for re-admission, the lawyer must file an application as though he were a law student seeking admission and likely be required to sit the Bar Examination (again).
Why is out-of-school suspension a punishment, since schools are just allowing kids to go home? Should schools get rid of the out-of-school suspension policy?
An out-of-school suspension serves two purposes:It removes a distraction from the school. It acts as a rung on the disciplinary ladder towards expulsion. That is, the suspension is more about the people who are still in school than it is the student who isn’t in school. Sometimes, removing a single student from a class changes that class’s entire aura. Perhaps, since Timmy is gone for a week, the teacher can try something new, like group work or more hands-on learning. You know, the types of lessons that the other students would enjoy and benefit from, but Timmy would be sure to ruin for everyone.Several years ago, I taught at a school where a single student’s suspension for a week led all of his teachers to comment on how much better the entire class was, and how much less stress they felt that week. According to one teacher, her husband even noticed how much happier she seemed that week, without her mentioning the suspended student. That student ended up expelled within a month of returning to school. That’s the other purpose of a suspension: to show an escalation of disciplinary measures by the school. To show that they tried to correct the situation without giving up on the student, but their attempts didn’t work. You can’t just go from zero to expulsion, unless it’s something really egregious, like bringing a gun to school. There have to be steps in-between. Suspensions are some of those steps. If you’ve ever been suspended, now you know… it wasn’t so much to punish you as it was to give people a break from you.
How does FIFA determine the length of bans or suspensions for incidents like Suarez's biting an Italian player?
Probably the most straightforward way to answer this is to turn to FIFA's Disciplinary Code (Page on fifa.com).Disciplinary Code Article 19 details that international suspensions can be numbered in matches or months: no more than 24 matches, or 24 months.Article 96 states that the following types of evidence may be presented to a FIFA Disciplinary Committee:"The following are, in particular, admissible: reports from referees, assistant referees, match commissioners and referee inspectors, declarations from the parties and witnesses, material evidence, expert opinions and audio or video recordings."The World Cup matches use a 34-camera plan, so that's how many stadium cameras were recording the event (HBS: Picture gallery).Articles 76 - 78 detail the Disciplinary Committee's jurisdiction, which includes incidents like this biting.Articles 79 - 80 explain the Appeals process, under which the sanctioned player or official may contest the Comittee's decision.Chapter II of the Code details how a matter is brought to the Committee's attention (anyone can report an incident, and match officials are required to), how an investigation is started ("The secretariat carries out the necessary investigation ex officio under the chairman’s guidance." - Article 108)Evidence (as outlined above) is examined. The chairman and Committee deliberate, and then finally pass a decision. A decision contains (from Article 115):"a) the composition of the committee;b) the names of the parties;c) a summary of the facts;d) the grounds of the decision;e) the provisions on which the decision was based;f) the terms of the decision;g) notice of the channels for appeal."This is where we should see their logic behind the length of the ban. They do consider relevant circumstances, including the record of the person being considered for sanction (Article 33).Appeals must be lodged within three days of the decision. A written explanation of the appeal must then be given within the following seven days (Article 120).
