Many of them already practised trying their wings in the first impeachment.They retained them and their brains; thus they do not plan to fly for the second trial.Now, as Rudy Giuliani tosses his wrench into the fold and back flips on claims that he would serve on the president’s defence team for his upcoming second impeachment trial, Giuliani has dismissed the legitimacy of the single article that brought trump his second impeachment.He reckons trump’s rally speech did not incite the riot because there was a delay between the speech and the attack.Oh puleeease! How many moments would he like us to count between the incitement and the damage inflicted?Turns out he’s not as confident in taking this next trump fantasy on as he thought he was.Giuliani is the essence of trump's unjustified attempts to topple the political race and look how it all fizzled. A couple of thoughts:First, Mueller is literally just doing his job. He was tasked with investigating the people and circumstances around the 2016 election, he uncovered evidence of a series of criminal acts, which he brought the the grand jury. This isn’t a “distraction,” this is a federal criminal investigation. Whether or not it has some larger political implication, if the guy was a major money launderer, it seems like something he ought to get charged with.Second, as Jeet Heer has written, Mueller has likely built a “Second Foundation” planning for just this kind of scenario. We know he’s been sharing information about Paul Manafort specifically with New York Attorney General Eric Schneiderman, who has been running a parallel investigation into Manafort’s apparently numerous misdeeds. We obviously need more details, but I suspect if Mueller has enough evidence to charge Manafort, the State of New York likely will as well. And, while Trump can pardon Manafort on federal charges, he has absolutely no power to do that on state charges, which means that Mueller and Schneiderman (who, by the way, can’t be fired by Trump) will have leverage even if a pardon occurs.Third, why are you so confident Manafort won’t cooperate? His whole career has demonstrated that he’s an amoral mercenary. He has no personal loyalty to Trump. If, as I suspect, he’s going to be facing a substantial state prison sentence no matter what, why wouldn’t he cooperate?Fourth, taking the attitude “we’re heading for a constitutional crisis, why bother” just doesn’t seem very healthy, does it? Again, it appears that Manafort has just been a straight-up criminal (money laundering, false statements, unregistered work for foreign powers) for a good chunk of his career. Your argument is that we shouldn’t try prosecuting criminals if we don’t think it will come off because of presidential interference.Fifth, a preemptive pardon of Manafort might actually contribute to Mueller’s larger investigation of obstruction of justice, since it further establishes a pattern and intent of trying to interfere with the investigation into the Trump campaign’s ties to the Russian efforts to subvert the election.And finally, not that this plays into Mueller’s thought process, but the image of Trump pardoning his money-laundering, in-hock-to-the-Russians former campaign manager before a trial happens is not going to look great in the 2018 or 2020 elections.
