Common law systems like HK are supposed to use stare decisis and Obiter dictum in law. This required no more than three years’ imprisonment.The second burglary resulted in D causing minor injury to an occupant, and the fact that the premises were occupied was an aggravating factor that would take the starting point for sentence beyond three years. But the fact that this was a repeat visit to the same premises should not be an aggravating factor.An 18-month starting point for Assault Occasioning Actual Bodily Harm (AOABH) was manifestly excessive, since D had no intention to injure and the injury was quite minor. An appropriate starting point for this was four months’ imprisonment and reduced for plea to two months and 20 days.So a case in 2012 where there was AOABH but there was NO intent and minor injury has a starting point of FOUR MONTHS.Yet here we have a rioter who was INTENTIONALLY attacking a police officer and minor injury and yet he gets 80 hours community service?Lets look at other common law precedent:1995 Manchester United Eric Cantona.Eric was sentenced to 14 days in prison for that. On appeal it was reduced to 120 hours community service. Yet the HK rioter got 80 hours?So? It’s funny when people say OMG the CCP is eroding the rule of law and judicial independence. No the JUDICIARY are undermining rule of law and intentionally giving extremely light sentences.They’re undermining themselves.

Set a chair on your lawn, and every time he does it, grab yourself a tall drink, sit in your chair on your lawn, in plain view so he can see you, and use your phone camera to video record him. Make it a fun, relaxing event. Take your time, and get good footage.Make sure you sit within plain view, so he sees you; this is critical!He will be wondering why you are recording it, and what you plan to to do with the video. If he asks you, be sure to tell him to mind his own business.I guarantee you, after your second recording, you will be getting no more snow.So what do you do with the video?More than likely you’ll not have to do anything, because that will take care of the problem. But if he does not stop, you have footage for filing a complaint with the city.In many (US & Canadian) cities, the ordinances prohibit residents from dumping snow, ice, or other debris on private properties or city streets. Residents will be fined a stiff penalty if they do. I’ve known it to be as high as $1000USD (Years ago. So it could be more now). You may want to research this as it relates to your city, and if it is applicable, then Mr. Sno-shovelling-neighbour will have something else to shovel…Dead presidents into the city coffers.And this is one shovelling that the city officials will not object to, at all!But I can almost guarantee you that you will not have to file a complaint. Just knowing that you have it on record will keep him in check.
