Mechanic Lien laws vary from State to State and are in place to assure that suppliers and subcontractors get paid. A horrible event resulted in the lien laws being changed in Missouri in the 1980’s. An elderly woman, retired schoolteacher in a small town had her furnace and air conditioning system replaced and paid the contractor in full. The company that supplied the equipment did not get paid from the contractor and ultimately filed a mechanic’s lien against the woman’s property.She must have known how things were going to turn out in court, because she packed her small house with magazines and newspapers. When court day came she brought proof that she had fulfilled her obligation and had paid in full. But the court ruled against her because she had no signed Lien Waiver from the equipment supplier. It was patently unfair.She went home and made a tragic statement. She soaked, with kerosene, the paper she had hoarded, sat in the middle of the house and set it on fire.The Missouri law now differentiate between homeowner and “sophisticated parties” so that homeowners don’t face that issue. Nevertheless, demanding Lien Waivers from every supplier and subcontractor on the project is good practice.
