A former boss who was obsessed with me. I developed a repetitive motion injury and was released from work by Workman’s Comp. He had a bad cocaine, weed, and alcohol habit. A conceal carry gun permit, a federal arms dealer’s license, and connections with some very bad people as well as folks in power in our city. He kept contacting my personal physician and the state workers comp lawyers and medical professionals. He had me evicted from my home . He had my next boss sued into bankruptcy, and paid other people to find me. He was buying photos from photographers I had modeled for and was sending copies to his lawyer and mine. I had to move 4 times in two years to hide from him. Finally after the two years Oregon installed a Stalker Law and he quit.Lucky for me his habits caught up wth him and he died years ago.

It’s the attending physician that should determine that you are improving medically and then at some point declare that you are fully recovered to pre-injury status. Usually employers want the physician to issue a full release to work duty.

The answers to this question can vary. It’s not that they don’t want to help you. The way the workers' compensation system works is that everything is pretty much dependent on what doctors recommend. Your treating physician must provide the insurance company, or state, with objective medical evidence of your ongoing need for medical treatment. If your physician is unable to provide any evidence for further treatment, they must release you to return to work.Some people are unaware of the difference between subjective and objective medical evidence. When you say that you are FEELING pain, that is subjective medical evidence. When the physician finds the cause of your pain, that is objective medical evidence. Subjective is not good enough for the insurer because they want physical evidence in order to continue paying for treatment.Your treating physician must send a monthly medical report of the status of your injury to the work comp insurer. If your treating physician is unable to find any cause of your pain or any need for further medical treatment, they must provide that information to the insurer. If your employer’s insurer feels that your injury is taking too long to heal, they are within their rights to schedule you for an ”Independent” Medical Examination/Evaluation (IME) so that physician can evaluate your injury and see if they agree with your physician. Your physician also has a right to dispute the IME’s findings, if they disagree. This is why it is very important that the physician in charge of handling the medical aspect of your claim should NEVER be a chiropractor. Always make sure it is a medical doctor (someone with a medical degree such as M.D. or D.O., not a “doctor of chiropractic” (D.C.) degree). The reason being, an IME or any evaluator that the insurer will request you to see will be a medical doctor (M.D. or D.O.). If this medical doctor says you are able to return to work, and your chiropractor disagrees, you will have to return to work because a medical professional’s word carries a lot more weight than a chiropractor’s, thereby closing your claim with no further treatment.to reiterate, your physician must be able to provide evidence of the need for further treatment in order for your claim to remain open. Simply telling your doctor that you are in constant pain, is not enough. They must be able to provide evidence of what is causing your pain or the insurer will close your claim and stop paying any further medical treatment. They will also expect you back at work or you may lose your job. Any recommended treatment must be approved by the insurer before they will pay for it. So if your physician recommends specific testing or treatment be performed on you, they must provide a medical explanation for the insurer’s medical department to review before they authorise it. if they don’t authorise a specific treatment, they will not pay for it and the doctor will be unable to perform it for free, especially if they are not private practice.Side note: (Because I have experienced this many times with chiropractors giving patients the wrong information.) Both MD’s and DO’s undergo four years of medical school before submitting themselves to residency programs to finish their training and become full-fledged physicians. A chiropractor does not. Never let a chiropractor tell you otherwise, as they are not medical professionals, and the decision to go with a chiropractor over a medical doctor to handle your work comp claim is a good way to have your claim close fast.
