In Louisiana, where I practiced law, the answer to your question depends on whether the succession is administered or not. In small succession without a lot of debt, administration (the appointment of a succession representative or executor is often dispensed with, and the heirs are placed into possession of the estate fairly quickly. In those cases, the heirs or beneficiaries are the proper parties, either through their attorney(s) or individually.In larger successions, successions where there is a lot of debt, succession where the beneficiaries are not readily identifiable, or other complex issues, administration is indicated. This process consists of an interested party requesting that the Court appoint a succession representative. This is normally the person named in the last will and testament of the deceased. In intestate cases, any interested party may seek this designation.Succession representatives usually serve with bond. This theoretically ensure they will discharge their fiduciary duty to all heirs. In practice, however, these representatives often seek to press their own advantage. In any event, the representative ordered by the Court is the person to contact.I handled only a few succession in my 25 years of practice. I was primarily a litigator. It's just not true.And it's belittling to the other person—and maybe even yourself— to think you know everything they are and think and feel no matter how much time you spent together. Mississippi has three big problems that have hurt it compared to parts of the “New South” that have become increasingly prosperous. First, its largest city, Jackson, is on the small side (there are larger suburbs in states like Texas and California), and if anything, is shrinking. The lack of even a single thriving large city makes it tougher to attract the kind of white-collar employers that can elevate a state's fortunes.Second, even if Mississippi wanted to set its sights on more industrial work, educational achievement in the state remains low, and related issues like teenage pregnancy and incarceration are also problems. Mississippi does not have the existing workforce that modern employers want, and as one commenter correctly noted, the state further suffers from “brain drain,” with many of its college grads moving to greener pastures after graduation. You’d be surprised how many Mississippi State engineers I’ve met through the years who are working for NASA or some big energy company Houston, for example.And finally, even though it's a beautiful place with friendly people, Mississippi has an image problem. What do people think of when they think about Georgia? My guess is peaches, the dynamic city of Atlanta, Coca-Cola, and maybe the state's thriving film industry. North Carolina? Charlotte, banks, and the Research Triangle. Tennessee? Music and big, interesting cities. Louisiana? New Orleans, food, and fun. Mississippi? My first thoughts were cotton and the “Old South,” (and everything associated with it) and I don't think either carries many positive associations for outsiders. You look at the success stories in the South like Houston and Atlanta, and the cities that are currently exploding like Austin and Nashville, and they're appealing both to employer and employees, the kinds of places people flock to for jobs and quality of life. Until Mississippi can similarly sell itself, it's going to be outpaced by its neighbors.
