I am no judge or jury. But, I think Kamra’s tweets do amount to the contempt of court in India. In fact, the fun part is, I think even Kamra knows that his tweets amount to the contempt of court.This is very clear if you look at the follow up letter he wrote to KK Venugopal, defying all expectations.I am sure he will be sent to jail for his actions. Otherwise, the Supreme Court will become a joke (some say it is already) and make unwarranted allegations against the SC.However, I support Kamra on this. I don't think he has anything to gain by insulting the courts. He has posed a very uncomfortable question which the Supreme Court will find hard to answer.How does the Supreme Court have time to hear Arnab Goswami within 48 hours, but takes weeks and months for other people and I am not even talking about common people? How does the Supreme Court involve itself in a bail petition while gladly ignoring matters of national importance? Does it mean influential people or matters related to influential people will be heard first in the Supreme Court? Does this mean having political connections with the ruling party will help you jump the queue?We know this has been happening for a long time. Just that nobody has ever dared to challenge the status quo.Conclusion:Kamra has done us a huge favour by sacrificing himself to expose the culture of political influence and misplaced priorities at the Supreme Court. Prashant Bhushan has been held guilty of contempt by the Supreme Court. What are your reactions on this issue?

Contempt of court should be only for two reasons. One, if the judgement of some court is not implemented within time limit and the petitioner approaches the court with contempt of court petition (provided the opposite party has not appealed in a higher court or to a larger bench). The second reason may be if somebody obstructs judicial proceedings or tries to influence the judgement. Contempt of court should never be for personal reasons.I have gone through both the tweets of Shri Prashant Bhushan and I do not see anything objectionable which amounts to contempt of court. Shri Bhushan has pointed out that CJI was riding a motorcycle without a helmet and a mask. He was enjoying the time while needy petitioners were not being heard as the court was closed due to corona epidemic. SC in its hearing, in the instant contempt of court case, has said that urgent petitions were being heard through video conferencing and hence allegations and tone of Mr Bhushan amounted to contempt of court. But the argument of Mr Bhusan that CJI is not SC seems to be quite convincing.I think that those who are very cautious about their respect or disrespect are actually hollow from within. Those who are really strong from inside invite healthy criticism. After 1991 i.e. after the era of judicial activism courts are sometimes behaving irrationally as if only judges are the repository of wisdom and respect and others are second class citizens. The President of India is the repository of legislative, executive and judicial powers. Ministers and judges are called Hon’bles but we call the President of India as His Excellency. One can criticize even the His Excellency but not the judges! If somebody has said something which has lowered anybody’s prestige or honour then the person, be it ordinary citizen or judge or minister, should approach an appropriate court with a defamation suit. Suo motto taking cognizance and contempt of court, in such cases, actually threatens rule of law or equality before law and also obstructs freedom of speech guaranted by the constitution as a fundamental right. It, in fact, lowers the dignity of Hon’ble Courts. Respect is commanded. It is never coerced..

Two days back, CJI Dipak Misra ordered a special investigation team (SIT) to reopen 1984 Sikh riots cases and investigate 186 cases related to it.1984 anti-Sikh riots: Supreme Court orders new SIT to probe afresh 186 cases which were closed2. Last month, CJI Dipak Misra slammed Kapil Sibal when he asked to postpone the judgement of Ram Janmbhumi case after July 2019. You know how Congress was left red faced and distanced itself from Kapil Sibal.Chief Justice's Sharp Reprimand For Kapil Sibal, Others For Conduct in Court3. Remember Yakub Memon case, his mercy petition advocated by Prashant Bhushan and others in the midnight was rejected by Dipak Misra. Misra even got death threats from terrorists for this.SC judge Dipak Misra who rejected Yakub’s plea gets threat letter, security beefed up4. Shekhar Gupta, senior journalist known for his fake coup story against Indian Army under then Army Chief V.K. Singh was seen standing behind the 4 judges during press conference as if he is organizing it.5. D. Raja senior member of CPI and Member of Rajya Sabha, met Justice Chelameshwar, one of the dissenting judges. What's this Parliamentarian doing in sitting judge's house?My Analysis:Though the fight among judges for administrative issues like 'master of roster' and ‘first among equals’ may be genuine. But instead of venting out their dissatifaction in press conference, they should have met the President who is supposed to protect & defend our Constitution.This will cause unprecedented damage to the sacred and widely accepted image of Supreme Court. For Example- Every future SC decisions may be questioned on the basis of who was the Judge.Currently 25 Judges are there in SC including CJI. So its necessary to understand opinion of rest 20 judges about current conflict.Recently, India scored big win in diplomatic front when Justice Bhandari got re-elected as a judge of International Court of Justice against a UK nominee. This internal judicial conflicts will send negative message about our judiciary in the international community.Opposition and left liberal eco system got golden opportunity to start campaign of “Democracy threatened under Modi rule.” Thus the issue will be fully politicized which will impact the independence & effectiveness of SC.It sets wrong precedence. This may prompt HC judges to come out in open against Chief Justice of respective High Courts for their dissatifaction.Lets hope everything will be all right in Supreme Court.This was my perspective.
