It is not illegal to have an auto-renewing contract in California as long as the proper disclosures are given. Per Professional Code Section 17600 et seq., any entity offering an “automatic renewal” must do the following:Present the terms clearly and conspicuously before the individual subscribes to the offer. The offer must be presented either in larger type than the surrounding text or in contrasting type, font, or color to the surrounding text of the same size, or set off from the surrounding text in a manner that clearly calls attention to the termsObtain affirmative consent to the automatic renewal offer terms prior to charging the consumer.Provide a record for the consumer that includes the terms and conditions of the offer, a description of the cancellation policy, specific information on how to cancel the offer. Cancellation must be through an easy-to-use mechanism, such as a toll-free number, email address, or a postal address if the consumer is directly billed. If the offer includes a free trial, that the consumer may cancel before the consumer pays for any goods or services.It’s worth noting that the statute has exceptions for:commercial agreements;regulated utilities including those companies regulated by the CA Department of Insurance, CA Bureau of Electronic and Appliance Repair, CPUC, FCC, and FERC;alarm companies; andbanks and credit unions.The question specifically asked about telecommunications companies which as noted above are exempted from this statute. Both the CPUC and the FCC have regulations in place which control the contract terms which may be offered by telecommunications companies but as far as I can tell there is no law or regulation on point that would prohibit an auto-renewing contract. However, even without a specific statute it could be argued that a consumer cell phone contract with an auto-renewing clause is so onerous that it is unconscionable (and can therefore be rescinded) , especially if the auto-renew terms were buried in the fine print.In the last couple of years the FCC has been mulling over possible additional rules concerning cell phone contracts, specially dealing with ETF fees. It should be a normal commercial agreement. Remember a written agreement should only be reflection of the terms that have been agreed to between the two parties i.e. you and the company.It should reflect on the time lines, the commercials, payment terms , the usage, support and maintenance, other duties and liabilities etc; basically all that you agreed to with the company.Apart from that , there will be certain other clauses like force majore , jurisdiction, dispute resolution etc.CA.
