Can I study Law in the UK and Practice it in USA?

Every state has it’s own requirements for the practice of law and you’ll want to check to see the requirements for the states you want to practice in. For example, most states require a JD or higher (LLB from England does not generally qualify) from an accredited program and passage of bar exam. The last time I looked at the Calif requirements, they did not require the degree from an accredited program, and as I recall there were people who were trying to pass the bar there without the same formal education that the rest of the country would get. A nice idea that “anyone” could practice law, but their exam was harder and had more details… in fact it was a 3 day bar exam with the third day being a test case where they gave you file information and you had to organize the file, write memos, etc… I assume that if you went to England for law school and tried to get a license in a state that did not require a degree from an accredited university, then it’s POSSIBLE that you might be able to become a lawyer there, but passing the bar without the required education would be a problem.Another issue… I took the Maryland bar after practicing for 20 years in other states. The reason is that Maryland did a very sensible thing, they required that new lawyers in their jurisdiction learn their rules of court. Things like what are the specific requirements of procedure for filing a case, for serving a subpoena… things that would be different there from other states. It was not an easy exam, but if you had practiced for years and had a chance to look at the Maryland rules along with a class in what is different in Maryland from everything else, as well as the chance to put little flags on your rule book (which is allowed in the test… don’t think that makes the test easier, it makes it harder, the intent is to make sure you know what you’re doing when you file a case and answer it, etc., etc)…EVEN if you get an education in the U.S., some schools are known as “national” schools, where you get an overview of the laws of various states and might have an easier time understanding the differences between them, and LOCAL schools where you’ll get a specific understanding of that state’s laws … you’ll have a harder time transferring that knowledge to other states, but you’ll be better prepared to saddle up & dive into it when you do get to practice in that state. Details like how big your typeface needs to be for pleadings, what your margins need to be, how many days you have to file a response… they’ll be taught in a state school where the only thing you get about those details in a more national school is the fact that each state will have it’s own requirements about that and you need to look them up and where you can find them. I went to a national school and am biased towards that, but I saw some people who went to local schools in each state where I practiced, who were very competent to manage the details of a law practice in their own state.But knowing this, I have to wonder if the knowledge learned in a LLB from England would transfer as easily. Even if you could get the opportunity to take the bar exam, how much harder would it be to pass such an exam without having the American traditions of law taught to you on top of the English traditions? For example, I understand the English traditions may be very different, with one person preparing the case file and a totally different person assigned to argue it in court. The rules of argument will be different as well the fact that compliance with our constitution and all it’s amendments as well as the statutes of our various jurisdictions, must be complied with in every case. COULD one learn enough of the requirements of our constitution to pass the bar and practice law in the U.S. without going to a U.S. school? Of course… but it would not be so easy.In a U.S. law school, you’ll start by examining cases such as Marbry V Madison … I doubt the british law schools care a bit about ancient legal rulings about our own constitutions’ distribution of power and exercise of power between the various parts of our government (and through our changes of government after our electoral process). You’ll learn about Miranda v. Arizona in a criminal law class, and about whether someone who shoots a gun in Ohio, in the direction over the Ohio river, and kills a person in Kentucky, without ever setting foot in Kentucky… WHICH state is allowed to prosecute that murder? And doesn’t it cause a crisis if the state where the victim lives has the death penalty and the state where the murderer lives does not, and the victim’s family is demanding the death penalty but the defedant wants to say he ever set foot there so that the death penalty can’t possibly be imposed? You’ll discuss what is the difference between procedural and substantive jurisdiction, between search and seizure versus right against self incrimination… I don’t know that Britain has these distinctions. I’m sure their laws are very detailed as well, but likely in a different direction since a lot of thier law is based upon an old “common law” tradition and not nearly as much by constitution and statute. We learn about common law here because where constitution and statute do not address an issue, we fall back on principles of common law to make the decision on how to handle it, but…Am I giving enough detail so you understand that basically every detail of what you’ll learn in the U.S., which will be helpful in passing the bar exam here, will probably not be available to you in Britain?Which does not mean that over time, if you practice for years in Britain, that you might not be able to get some permission or opportunity to practice here in the states. If you were working for an international company, licensed in one of the nations where they have a presence, and advising clients on matters of those international laws, then it’s highly likely that you’d get authorization to conduct that type of practice here… but would they let you defend some guy in a DUI in the local traffic court? Probably not… your knowledge of how to file a motion to suppress properly for failure to follow u.s. constitutional rules would not allow you to practice competently in that area of law. You’d need more than just a waiver to be permitted to give limited international law advice, if you intended to open up a general practcie of law here.THe idea of going to another country to get a degree is really tempting… it’s an exciting opportunity to travel at the same time as getting an education, but if your ultimate goal is a career in law in the U.S., I highly recommend spending your $$ and efforts on a law degree from an accredited U.S. law school, getting a license to practice here, and saving some part of the wonderful salary that comes with such a degree and license, to travel as you will… Let us know what you decide!
