PDF Editor FAQ

Is a car bill of sale required on all states?

Yes. A bill of sale is a legal record of an ownership transfer, and it is required by all states as documentation of a vehicle transaction (private party or otherwise) unless the vehicle is being given as a gift, in which case a "gift letter" is required. However, what isn't commonly understood is that a bill of sale can be very informal - something as simple as a hand written letter can suffice (just be sure to write in blue or black ink). Here's what you need to include:Legal name of buyer(s) and seller(s)Full description of the vehicle (year, make, model, mileage, and color)Purchase price, value of trade-in (if applicable), etc.A statement like "Under penalty of perjury, the parties warrant..." OR a notary's seal (check with your state's DMV)The signatures of both the buyer(s) and seller(s)Most states have a sample bill of sale you can print out and/or copy online (see one for Colorado here: http://www.larimer.org/motorv/billofsale.pdf), so a quick search on Google should give you a free template to work from.NOTE: If you're considering a private party sale or purchase, you might talk to your local auto dealer about a "pass thru" transaction. For a fee, your local dealer will process your purchase for you, which helps to ensure that your title paperwork is up-to-snuff, that you're not doing business with a criminal (i.e. inadvertently buying stolen property), and that whatever payment you receive is valid, as the dealership has experience with detecting fake payment instruments. For a couple hundred bucks, you can save yourself a lot of hassle...and you might even be able to get the other party to pay the dealer's transaction fee as part of the purchase.Additionally, if you can do a pass-thru at the dealership you're going to buy your next car from, you can save a lot of money on sales tax too.

I’m selling my vehicle and getting a deposit, then the new buyer will pay me the rest in 3 weeks do I need a bill of sale?

Yes, you need a bill of sale. State the terms and odometer reading on the BOS.Below the signature, write down the date and amount you received and initial it. Do this on your copy and the buyer's copy. Life happens, so build that into your BOS. “Any money collected prior to the total amount is a non-refundable deposit. The vehicle must be paid in full by 11:59 PM on [put down 4 weeks instead of 3 to allow life to happen.] After that time the total amount collected to that point is considered a deposit in order to remove the car from the market. If you happen to sell the car immediately after that, you need to return any money that is not lost on the second sale. If you sold it to Party 1 for $5000 and they paid $2000 down, and give you $1500 next week and do not pay the rest within 30 days, you can list it for sale again. If Party 2 buys it for $4500, you are entitled to keep $500, but you need to return the rest. On the other hand, if Party 2 pays $6000, you need to return all of the money. On my BOS's I put a clause that states that I am no longer insuring that vehicle and will notify the DMV of this by close of business the next business day. I also remove my plates. In some states you can return the plate for a prorated refund on the taxes. I also ask the buyer to please let me know when they get it registered. If you provide the title at the time of sale, put a statement for the buyer to acknowledge receiving the title.Of course, in capital letters state, “THIS IS AN AS IS, WHERE IS SALE. There are no warranties expressed or implied. This document represents all the terms of this sale. Any modifications must be initialed by both parties.”Some states require a notary witness the signature on the BOS, title, or both. Make sure before you write anything on the title.I have a Word document template for a BOS. I am not sure if I can upload it or a PDF on Quora.
