You and the other person involved are true employees. You or the other person are not temporary employees through a third party or contract employees.Should my understanding of the situation given in the above paragraph is true and correct, if the “accident” did occur in the course and scope of employment, both you and the other party are agents of your employer and be treated that way. You and the other employee should qualify for indemnity under your employer’s General Liability Policy.It is possible that the Worker’s Compensation Carrier is not the same insurance company as the General Liability Carrier. You may have received notice from the Worker’s Compensation Carrier because an unexperienced claim handler hit the subrogation button.
