PDF Editor FAQ

If I am arrested for a DUI or a DWI, when must the arresting officer read me my rights?

In most cases, never. There is a SCOTUS decision that addresses this directly: Berkemer v. McCarty 468 U.S. 420 (1984).Richard McCarty was seen driving a car, weaving across the road. He was stopped by Ohio State Highway Patrol Trooper C.J. Williams, who conducted a field sobriety test. McCarty failed the test, and agreed to take a breath test. At the county jail (Harold Berkemer was the sheriff of Franklin County, OH, and the keeper of that jail), McCarty’s breath test showed no alcohol consumed. Trooper Williams questioned McCarty further and learned that McCarty had smoked a considerable amount of marijuana just prior to driving. Williams used the information from this questioning to charge McCarty with DUI-Drugs.After McCarty was convicted, his attorney appealed on the basis that no Miranda warning was given to McCarty. Ultimately, the SCOTUS ruled that there was no need to give a Miranda warning during “routine roadside questioning” during a traffic stop, but that any questioning after the person has been placed under arrest is a custodial interrogation, and must be prefaced with a Miranda warning.Law enforcement officers seldom conduct any questioning after placing someone under arrest for DUI, beyond booking questions that are not covered by Miranda. Unless the officer does question you in a way that is likely to elicit incriminating information, you probably won’t ever be given a Miranda warning when being charged with DUI.

People accuse America of 'White Supremacism', but wouldn't a White Supremacist country expel, genocide, or otherwise remove the citizenship of non-whites? Also, wouldn't it censor or murder any 'traitor' who speaks up in their defense.

RE: “wouldn't a White Supremacist country expel, genocide, or otherwise remove the citizenship of non-whites? Also, wouldn't it censor or murder any 'traitor' who speaks up in their defense.”That is exactly what is going on in the United States of America, right now.Sometimes, it is overt. Where in New Jersey can I find a list of bank foreclosed properties coming up for auction?

Google “foreclosed properties, sheriff auction new jersey”.You will get around 1, 110,000 results. There are MANY banks and others willing to tell you what is available. Most, if not all, counties in the US have the sheriff’s office manage the auction of foreclosed and tax lien properties in the US.Most of the properties at sheriff sales are bought by the bank at the amount owed and then they are marketed by the bank. If the amount still owed on the property is very low, they might not bid.In Cumberland County, New Jersey you can go to the sheriff’s websiteCumberland County, New Jersey (NJ)http://www.co.cumberland.nj.us/sheriffsalesHere is the site for a list of foreclosure listings in New Jersey, Ohio, Pennsylvania and other counties: SoftCode Sales WebIn Cumberland county there was a sheriff sale 2/26/2019, the next is 3/12/2019.There are 249 search results as of 2/28/2019, one of the properties has been on this list since 8/8/2017 and it has been adjourned (moved the a future date) 12 times and will probably be adjourned on 3/12/2019.I believe this happens to many of the properties.I’ve been to several auctions in Ohio - Franklin County and Delaware county. In general, if you have time and you are willing to show up and make bids I would think you might get one or two ‘deals’ every year or so. If you are interested in a particular location then you could scan the sales until a property comes up and you might be able to get that property for a ‘market’ price.I was at one auction where a 1/4 acre section of property sold for over $200,000. It was between two buildings and each owner wanted the right of way that little driveway would give them to the back of their property.
