The I-140 has nothing to do with the EAD. The I-140 is important as it enables your spouse to extend H-1B status for three year periods continuously, and thereby your H-4 status as well.If your spouse is in H-1B status, and your H-4 is valid, you can apply for an EAD based on your H-4. Just be aware that the EAD and H-4 are entirely dependent upon your spouse’s H-1B validity.Also, if your spouse has an approved I-140, you should consider filing form I-485, Application to Adjust Status along with forms I-131, Application for Travel Document and I-765, Application for Employment Authorization, as doing so would eliminate your need to be dependent upon the H for employment authorization. Once you have filed I-485, you will be able to extend your travel document and EAD continuously until you receive your green card. I have my I-140 approved. Can I switch from employer at this stage? Does the new employer have to file a new H1B or can they apply for an extension based on my approved I-140?

I am planning to apply for a Green Card through marriage. I am thinking to submit I-130, I-485 and I-765. Will I get separate receipt numbers for all? Do I need to pay for all 3 applications?

It is currently free for an I-485 applicant to file I-765 to apply for an EAD and/or file I-131 to apply for Advance Parole. This is true no matter if you file I-765 and/or I-131 together with the I-485, or file them later with the I-485 receipt. You may file these forms together. If you choose not to file Form I-765 and/or Form I-131 with your Form I-485, then you must submit a copy of your I-797C, Notice of Action, receipt as evidence that you filed a Form I-485.So if you file I-130, I-485, I-765, and I-131, you just have to pay the $535 fee for I-130 and the $1225 fee for I-485, and you will get 4 separate receipt numbers.
