PDF Editor FAQ
Does the tax withholding change after you get married?
Not unless you ask for a change by filing a new Form W-4 with your employer.
Is it legal for my employer to pay me in cash and still take out taxes and I HAVEN'T received or signed a w2 form?
First, you don’t sign a W-2 form. Neither does your employer. (The certification of truthful filing for W-2 forms is provided on Form W-3, which you’ll never see unless you’re an employer.) The form you are referring to is Form W-4, Employee's Withholding Certificate.Second, if you don’t submit Form W-4, your employer is still required by law to withhold taxes from your pay as if you had submitted a W-4 stating “single, no exemptions”. If you are fine with that, you can simply not submit a W-4. If you want to be withheld at a lower rate (single no exemptions is the highest possible withholding rate) then you must execute and convey a W-4 certification to your employer. This is true no matter how your employer pays you: even if they pay you in live chickens, they still have to withhold taxes from what they pay you. (Note also that the IRS does not ordinarily accept chickens as payment for taxes.)You cannot avoid payroll withholding by not submitting a W-4.
If you fill out a W-4 does that mean you are automatically a W-2 employee?
Completing Form W-4 at the request of an employer is a clear indication that that employer believes that the relationship between it and you is in the nature of an employer to an employee, and thus that the compensation you receive for for personal services is likely to be treated by the Internal Revenue Code as salary or wages and not as payments to an independent contractor. However, it is not the W-4 itself that makes you a “W-2 employee”. Rather, whether you are an employee or an independent contractor is determined by the totality of the circumstances of your relationship with your “employer”, according to a fairly complicated set of rules that are, in most situations, actually fairly straightforward to apply. For more information, see Independent Contractor Self Employed or Employee.
