She said she needed her husband’s approval before she signed a contract but he was still at work, so asked if I could come back later in the day when he would be home. I agreed and left.A couple hours later, I returned and found the husband home, at that point the wife and daughter were gone and he was alone. He agreed to the pest control contract and we quickly finished up the paperwork. After he handed it to me he looked straight in the eyes and said, “what are the chances of you and me running away together.”Let me give you a little background about me— I had been married for 5 months, I saved myself until I was married, I had never been abused or even close to it, and I basically lived a life up to that point of innocence and things like that only happened in the movies or the news. To say I was shocked would be an understatement.1% of me felt flattered, the other 19% felt sad for his wife, and the other 80%of me ached for his 3 year old daughter that has a dad who would ask a complete stranger such a question.I said something along the lines of, “that’s not happening.” And quickly made my way outta there!

As a lawyer or judge in court, was there ever a single testimony or piece of evidence that single-handedly swayed the jury from one side to the other?

Absolutely. Sometimes, the lawyers and judge in the courtroom are surprised about the specific issue or evidence which makes such an impact. I’ll give you three quick examples from personal injury cases where I’ve been involved in the trial.A Construction Site Accident Involving A Scissors Lift That Toppled. I represented a construction worker in Huntsville, Alabama. He was assigned to work in the ceiling of a project using an extended scissors lift. He was about 25 feet above a concrete slab. His work required him to move the lift while extended. Not a safe thing to do. However, that’s what management had the workers doing. My client’s lift toppled because an area of the concrete slab was uneven. We sued the general contractor for not maintaining a safe working environment. It was a tough case because Alabama is a contributory negligence state — if you are even 1% at fault you cannot win. Of course, the general contractor blamed my client after the accident for moving his lift while extended. And, the general contractor denied having any oversight or control of the actual slab area. What evidence did I have? After the accident, the general contractor purchased and hung red tape around the uneven area so other equipment operators could see and avoid it. Actions taken AFTER an accident are considered remedial measures. The evidence rules in most states do NOT allow you to introduce such evidence of later acts for the purpose of showing someone to be negligent back at the time of the accident. However, when the defendant denied having any control of the slab, it gave me a separate reason to get the small piece of tape admitted. That reason was to show the defendant did, in fact, control the area. I spoke with the jurors after the trial. The small piece of tape had a much larger impact than expected. We proceeded to have a long argument over the evidence and its admission during the trial, some of which played out in the jury’s presence. The defense lawyer’s arguments and demeanor led many jurors to believe the defendant was concealing several things. Most of them felt insulted by the defendant’s denials and felt that the defendant had lied. The end result in that case far, far exceeded the amount for which we would have settled or had even hoped at the beginnning of the trial. The defense lawyer’s protests over this little piece of red tape led jurors to a discussion of punitive damages that we never expected in the beginning.A Nursing Home Case Involving An Elderly Patient Attacked By Fire Ants. This case involved tremendous personal injury. From the beginning, we had a strong claim for substantial damages against the nursing home. The facility had allowed fire ants to attack an elderly patient in the bed. We also sued the pest control company that had treated the facility. At the beginning, we felt the case against the pest control company to be weaker. Why? While the pest control company did periodically treat/inspect the facility pursuant to a contract, the nursing home had an obligation to call them back if problems were observed. The nursing home had observed ants on multiple occasions but failed to call the pest control company at all. So, the pest control company could argue that they were unaware of the ant problems for months. Things changed during our investigation. We found a witness who had worked for the pest control company. Through that witness we were able to show that the pest control company was NOT using its pest control chemicals at facilities. Although the company was walking the facilities and acting like it was treating them, it was not. The invoices showed treatments and showed pesticides being applied. However, the witness was able to go deeper and show the pest control company’s actual receipts for purchasing chemicals. They were not purchasing appropriate amounts of chemicals to satisfy all their contracts.A Slip And Fall At A Big Box Retailer. Slip and fall cases in Alabama are very difficult to win at trial. To hold the business liable, you would need to show it actually created the hazard or that they hazard had existed for a long period of time putting them on notice. (That’s a much condensed and not complete legal statement just used here to illustrate the case.) We had a client who slipped and fell on a specific product in the entryway to a large retailer. Of course, the store denied that the substance had been present for any length of time. Fortunately for us (maybe a miracle for us), another customer walked up while our client was still laying on the ground after his fall. This customer had many years of experience working with the exact substance that caused the fall. He could identify the substance, tell us where it came from in the store, and tell by the discoloration that it had been present on the ground for a long period of time. This one witness really made the case. We were able to achieve an excellent verdict for our injured client. Of course, it did not help the store any when the witness also told the jury how the retailer’s employees refused to call an ambulance for our injured client.I could give many more stories. In many cases, a single piece of evidence or single witness really has an outsize impact. While it’s often a surprise to everyone as to what particular evidence/witness will sway events, this is a lesson to investigate cases fully. In many situations, the key evidence would never be discovered absent a full investigation.
