For seventeen months and eight days I worked as a junior associate for a lawyer who probably was bipolar, but didn’t know it.He was a brilliant man who did some things exceptionally well. His manner of cross-examining witnesses was among the best I’ve ever seen. But with staff, he was often very abusive. Didn’t matter who it was. He could be absolutely horrible. So, a tenant was suing a landlord because a light fixture became detached from the ceiling and fell on her head. We were counsel for the landlord’s insurer. He lined up an electrician to swear an affidavit saying that the light fixture was properly installed and the landlord could not have know it would fall.Well, an electrician can’t give that evidence. He can give opinion evidence about wiring and current - electrical things. Construction and the suitability of the casing, fixtures, things like that, are outside of his range of expertise.That’s just one of several examples from that one file, and of a dozen or so more from my time there. I don’t know if it was always a test - I was supposed to stand up to him and say, “We need an engineer not an electrician” or “We passed on an obviously forged cheque from the client, we have to withdraw” or “Our Court of Appeal has explicitly rejected your argument several times”. If it was a test, I failed. You couldn’t tell him anything, so I stopped trying.He could also be very kind. At one point I was hospitalized, I think with a kidney issue. He came to visit while I was there. He brought me a six pack of Dr. Pepper, and it was cold when he gave it to me. I might be underselling that, but it was very thoughtful.The final straw was over nothing. The insurance company’s client was a house owner whose tenant set up a marijuana grow op, and got raided by the RCMP. Among other things, the police found that the tenant had cut a hole in the wall to set up a hydro bypass (ie steal electricity before it got to the meter).Now, that damage to the wall was not covered, because the owner’s policy had an exclusion for “farming operations”. But the insurance company wanted to know if another exclusion applied: vandalism by a tenant. So… they cut a hole in the wall to steal electricity. Is that “vandalism”?Peter considered himself to be an expert on the meaning of “vandalism”, because in the entire history of British Columbia, there had been exactly one case about the meaning of “vandalism” in an insurance policy, and Peter was the successful counsel. (I think the other party never showed up for the appeal. I might be wrong on that.)So, I was tasked with writing an opinion on whether or not this - the hole in the wall - was vandalism. It was abundantly clear what opinion I was supposed to reach. After reviewing basically all existing case law (maybe ten cases from Canada, the U.S., and the U.K.) I said that the law was on our side. However, I said that I thought that we could not comfortably rely on these cases. Our situation was different - we were dealing with damage that was deliberate and purposeful, not reckless or wanton. For that reason (and a few others) I felt this was not vandalism.He was absolutely livid, and savage in his reaction.
