When I was a social worker and working with at-risk high school students, one of my duties was to attend truancy court. Students who missed too many school days would have to face a justice of the peace, and would have to make restitution for missing too many school days.One thing I quickly learned was that so many of these kids’ truancy issues stemmed from their parents. In general, working with at-risk kids, one discovers that sometimes when you think the kid is bad enough, you meet their parent(s)—and then you realize that the kid is actually a lot more together, considering the circumstances.One day, there’s a lady who is in front of the judge, and she is making excuse after excuse. Car broke down. Kids overslept. She had to work the night shift and overslept. Couldn’t get a sitter. Bus driver came too early. Bus driver didn’t show. Literally, it’s just one excuse after another. It’s not that one didn’t believe her—it’s just that every thing that was brought before her, she had a quick answer to it—and it was never her fault.So the judge, she’s annoyed by this, and she says, okay, fine, and offers her a deal. She writes up the paperwork and the judge says that they need to go into the back room and discuss another matter.“Oh, can you mail me that paperwork? I can’t sign it right now, and I don’t want to meet with you, ’cause don’t t want you to get near me, I’ve got the Swine Flu.”Face.Palm.Not just me, but the court officer, the judge, and the bailiff.I laugh, but I feel sorry for her kids.EDIT: You want some face-palm material? What happens if a non-custodial parent habitually brings a son back days late from a visitation, resulting in unexcused absences from school (kindergarten)? Am I responsible for the truancy? The school district/truancy officer can't offer any advice.

Obviously, the first step is to speak to the parent. Explain the problem. Show the unexcused absences.If the parent refuses to stop and this is a common problem, the solution is to go to a lawyer and/or handle the matter on your own through court. If there is not a specific custody order that the person is disobeying, one may need to be put in place through court. If there is an order, then the person disobeying it may be held in contempt, or at least ordered to obey the order. Then, if they refuse to change, the judge may hold them in contempt.So, my answer is, if the other parent will not listen, get thee to a lawyer. If you cannot afford one, see if legal aid will help you. If that is not an option, I suggest you look in your county to see if there is paperwork that will help you handle the matter through the court system.I do not know who will be responsible for the unexcused absences, if it gets to the point where the authorities get involved. I would hope that you can show the other parent is at fault, and so the other parent would be responsible.But in the end, it doesn’t matter who is responsible. The child needs to be in school and the issue needs to be resolved for the child’s well being.

Also, any visitation or custody rights the parent had as the result of court dispute will be jeopardized. It remains unclear if the children could be removed solely for the lack of education, without other circumstances, but it seems likely in a case of prolonged refusal to educate.It is highly recommend that parents complete the appropriate paperwork for the legal education option they have selected before the start of each school year.
