In the county which I live in it means this. You are evaluated you are given certain tests. In Juvenile Court the parents are guilty no matter what. Its based on preponderance of evidence. In Criminal Court you are innocent until proven guilty. Juvenile Court is one lesser degree than Criminal Court. The courts think higher of a child molester than they do of a child in a sense. They say it's the best interest of the child. I say leave the children out of it. It means you will be given a battery of tests. You will never pass these tests. They will send you to counseling, or parent classes. If there were drugs or alcohol involved or even mention it to them you will be tested weekly for this and sent to alcohol or drugs classes. There is nothing you can do about this evaluation. Talk to your appointed attorney make him do his job. Don't be afraid to stand up in court and object yourself. The judge will always go with CPS recommendations. You have a right to appeal thru your lawyer, or even request a new one. Once something is said it's part of the record. This is the way the county makes there money paying for domestic violence, parenting classes, relapse prevention programs, etc., is sending you to these programs. You generally have to pay for them unless you are at poverty level. We all know that CPS is a corrupt organization. For every one thing you hear good about them there are 15 things bad. CPS are social workers they are not investigators nor the police. There titles are Behavioral Specialists. They are supposed to help people and families. They swear in the name of the child what they have written is true. When in fact they do not use spell check on there reports then look you in the eye and lie to your face. It doesn't take a smart person to throw a bunch of reports together and call it facts when they do not investigate one damn thing. There is no law that says police officers cannot investigate child abuse or child neglect cases. In my town if your report it to the local police the police call cps. Why because they pass the buck thats why. Why should they. They would need more manpower to do so. They are to busy running around and catching the bad guy. They are the ones that take you to the hospital, have the doctor give you a tranquilizer after giving you one for being combative with handcuffs on before putting you in their car.Then insist your blood be drawn. Then you confess you are on drugs. The police call cps. When you have been knocked out for 2 days cps says we are going to take your kids away from you. The police report says arrested without incident. So the officer leaves. But there is no law that says only contact cps. You can file a report with the Sherriff's Department or the District Attorneys office if you want to. But believe me when I say they will call in cps. Do they investigate? Well you just read the example I gave to you. What does it take to staple police reports together and call it investigating. Why do they look you in the eye and lie to you? Why do they not tell or send the notification to relatives in the 5 th decree of kinship.? So relatives know that a child may be put up for adoption. Social workers are supposed to be passionate people and help you get your child back not tell you" don' t talk me like that I have the authority for you to never see your children again " when you did not understand the process in the first place . It definitely is not ok to tell a child that you are going to use a knife to make his mouth bigger. This 3 year old child could have mouth problems like sores, dental cavities, or perhaps he cannot swallow. He may not like the food he is eating. His food could be spicy or not spicy enough. There are so many reasons he could be eating slowly. But you can be sure he is being more than verbally abused by the conversation at his dinner table.My advise to you is this as you stated you are a part of this family now is to talk to this boys mother. Tell her you are concerned about his eating habits but you are more concerned about him being yelled at by his family members. Tell her he needs to be looked at by a family doctor. Tell her there may or may not be anything wrong with him but it is affecting you the way they talk to him and threatening to take a knife and to cut on him. Tell her you do not believe this to be a joke this is something very serious.Yes you do have the right to say something. After bringing it to the attention of this three year olds parents if nothing is done to correct the situation then I suggest you take it directly to the police. This is called child abuse. You could be saving this childs life. You said you grew up by being beaten . By taking it to the police they will do the investigation not CPS. If CPS gets involved its a one sided investigation . Look it like a traffic stop . Do not open your mouth, no your rights, do not answer one question, do not let them in without a warrant. CPS does not now the laws. CPS title is social worker or behavior specialists . Is it right to have a title of social worker and lie to you or anyone else. So it is always better to report child abuse to someone who hows how to investigate. You save the parents agony and grief. Once CPS is involved they will be with you for a very very long time. You are guilty you have to prove your innocence and worth to social workers.
