When talking about ‘modern’ or ethical law, keep things in perspective.I remember an interaction between James VI & I of Scotland and England (r. 1567–1625)—and his English Lord Chief Justice. Faced with a land dispute, the king judged it according to Scottish law and what seemed to him just, fair, and reasonable. His justice overturned his ruling and corrected him:“God has endowed His Majesty with excellent science, and great endowments of nature; but His Majesty was not learned in the laws of his realm of England, and causes which concern the life, or inheritance, or goods, or fortunes of his subjects are not to be decided by natural reason but by the artificial reason and judgement of the law, which law is an act which requires long study and experience before that a man can attain the recognizance of it.” [1]Now, King James was a man I wouldn’t spit on if he was on fire, but I sympathize.Most people, in the 17th century or the 21st, just instinctively assume the law in their own country, as written (or practiced) is if not perfect, fairly reasonable. In reality, the law (esp. modern law) is an artificial construct that would never be made in its present form by any reasonable man “with heavenly compassion in his heart.”Similarly, most people would be surprised at just how different the laws of otherwise “modern” countries are on things that seem routine. Truth be told, the things you legally can do in (say) Greece, Germany, and the US, and the kinds of coercion exercised against you if you do other things, are radically different.Most well-off, “upper middle class” people don’t actually wager their happiness on whether their country’s prison system is inherently fairer or less violent than, say, receiving twenty lashes for theft: they just plan on never encountering the law, and separating themselves as a class from the “criminal element.”I recall something written by a Greek novelist in the 19th century, written at a time when the Greek countryside was transitioning from the Ottoman shari’a system run by provincial qadis or judges, themselves members of the community, to the leviathan of French law. The words are put in the mouth of a lawyer writing to the inhabitants of a village which is seeing its property rights trodden over by the local landlord—the lawyer is, we are led to understand, just squeezing the villagers for money, since the case is stalled for political reasons. Paraphrasing:“These are no longer the days when the qadi, sitting with hookah in hand, would resolve a dozen cases that landed on his lap every day. Now there are lawyers, whose tongues wag back and forth, back and forth, spilling saliva for their client’s interest. And not all that they set down is good, but once written it cannot be unwritten.” [2]Off the top of my head, I recall a recent incident during the COVID pandemic, where (here in Greece) there is a 300 € fine for leaving the house without a permit, and 150 € for not wearing a mask. Together, these exceed what a large part of the population living hand-to-mouth makes as a salary or (esp. for the elderly) a pension.Now, I live in a “well-to-do” neighbourhood: I’ve never once seen a policeman out checking permits or masks, and many people go without one. But I have it on good authority that in working class and “ethnic” (viz. gypsy) areas—which tend to have harsher curfews—the police is out in force. Family members who are darker skinned tell me that it’s fairly obvious what attracts their attention.The story I heard by word of mouth is that an old man—a yerontio, oldling, as we say in Greek—had gone to get his pension, but did not conform to ordinances. A policeman spotted him, and proceeded to take away the entire pension for the fine. The old guy was begging him not to leave him penniless, but dura lex, sed lexI take this as an example of something that wouldn’t have happened under Ottoman law. The idea that the state has the legal right to take the livelihood from the weakest members of society is a Western concept. The old Turkish “social contract” did not guarantee property rights the way Western law does, which is why it was routinely attacked in 19th century British Whig discourse as a case study in “oriental despotism.” Common law in the UK gradually formed around the property rights of the landlords, the magnates of industry, and in time the “legal person” of the company (now the main factor): the main concern with the lower classes was to prevent theft, not guarantee “social harmony” and moral education as shari’a did.The contrary to this line of development is that the Ottoman state did not prey on the poor to “rob them in their poverty.” If you were in the lower rungs of social strata, the state did not think you had something to take, and saw you as deserving of unconditional charity (provided the ubiquitous waqf, or Islamic public property, which received successive endowments by several dynasties over the 10th to 19th centuries). The game of state appropriation of resources and “illegal” fines (shari’a technically forbids all non-canonical taxes, but they were levied regardless) was played between the government and the top “1%.”I recall the following piece by a critically minded Briton:We stayed a day in (Russian) Tiflis and saw poor people for the first time since we left Europe. By poor I do not mean Dervishes, or beggars, or cripples, or blind, for in Turkey there are many of these, but they are not poor. They have but to ask for bread, and a Zaptieh, a Pasha, a Shaykh, an Imam, a street boy, a merchant, a soldier, a robber, a peasant, or a baker will give it to them without comment; for in Turkey, unless there is an absolute famine, no one need starve.But in Tiflis we saw the poor of Europe—the poor who live in foul, narrow alleys, the poor who stare with gaunt grey faces of hopeless misery, the poor who work for a miserable wage, the poor who build railways and manufacture ‘civilization.’ Tiflis has some fine modern buildings; Tiflis has a picture-gallery; Tiflis has a museum; and Tiflis has slums, wretchedness, and want in its back streets. [3]Most people who talk about shari’a in the West think of instances of violent coercion by Islamicate states, not next to instances of coercion by Western states, but against their own idea of peaceful, enfranchised, “civilized” life.They don’t realize this is not the “face” shown by the West to Islamic societies:Almost 100 girls in the Central African Republic have said they were sexually abused by international peacekeepers, with three claiming they were tied up and forced to have sex with a dog by a French military commander in 2014.A spokesperson said three girls reported that they and a fourth victim, who has since died of an unknown illness, were tied up and undressed at a military camp by a commander from the French “Sangaris” force. (Operation Sangaris, 2013–16) They said they were then forced to have sex with a dog before being given 5,000 Central African Francs (£6) each. One of the victims said she was called “the Sangaris’ dog” by people in the community after the attack.It is far from the only report of abuse in CAR, (“new cases, which involved at least five children, come on top of more than 20 allegations of sexual abuse and exploitation by UN peacekeepers…”)[4] where peacekeepers have been accused of raping girls as young as 12. A report leaked last year included claims that French troops forced refugee children fleeing violence to perform sex acts for food. I am reminded of how the mastermind behind the more famous My Lai gang-rapes & massacre in Vietnam (504 dead, including “182 women—17 of them pregnant—and 173 children, including 56 infants”[7]), only served three and a half years in “house arrest” for what he did.[8]People who plaster the French flag on their faces for “Je Suis Charlie” don’t tend to think the symbol also stands for the engorged organs of French officers sliding into the “African Venus.” On the other hand, they associate the sword on the Saudi flag with every chauvinism perpetrated by Sunnite Arabs the world over, even terrorist organisations formally opposed to the Saudi state.Don’t get me wrong, I don’t think shari’a is, in itself, anything brilliant; like any system of law, it is an “artificial reason” essentially foreign to the true ethical instinct. I don’t think it can be just. But the halo of cultural prototypes that informs the letter of the shari’a shows why people suffering the predations of Western militaries or local paramilitaries turn to it.Off the top of my head, when Sultan Sanjar entered Khorasan, he announced he would not molest the locals; the first man in his army who was reported looting was hanged on the spot, and no other incidents ensued. When Akbar found that a Brahmin had been systematically raping his own daughter, he proceeded to have the man castrated and fed his own genitals (he reportedly “ate them with appetite”, hoping he would be released); he was subsequently executed and his daughter released. &c, &c; the classic idea of justice in the Perso-Islamic tradition is the big bully keeping the many little bullies in line; to use the old Greek verse referring to the redoubtable Turkish ruler Ali Pasha, the king in fear of whom “the owl and the nightingale played together.”This is appealing to many people. To say that it is not “modern” is beside the point; if I were to list the vast number of civil injustices and military brutalities that are both legal and modern, but aren’t mentioned because the people doing the mass-movement criticism don’t feel competent to criticize them, I’d still be typing tomorrow.If you’re looking for “modernity, ethics, philosophy”—perhaps glossing modernity as civility—don’t look to the law. The great states of the early to mid-20th century were very modern—perhaps more modern than those of our own day—but they were emphatically not better. State coercion—which is what the law is—is the sign of social collapse in all its forms. Whether it is a failed state in a state of generalised predation by armed groups, needing to rely on state force to keep the peace, or the “momentary” collapse of criminality in the West, against which state coercion is (neither rationally nor justly) applied, the use of the law is a sign that things have already gone bad.If police officers shot protesters in the gates of the US capitol on behalf of American democracy, it did not make those bullets a fitting end to the lives taken (nor would it make those lives inherently more deserving to be taken than any number of other, more vicious or harmful lives that are legally and modernly running out there in the world). If greater numbers of people threw themselves against the arms of the state out of fanaticism or desperation, and were all legally killed, the amount of “legal” (and legitimate) violence would not at some point restore the equilibrium of a civil, ethical society: it would just shatter it, entirely within the confines of the law. The same holds true for “common criminals.”Civil, ethical, philosophical societies don’t exist because they have a better law; they are simply societies in which coercion is less needed, in which the average person has his own continuity of life less often interrupted by it. That says nothing of the law itself, which organizes itself by that “artificial reason” quite divorced from the constitutive values of society. When (say) the civil rights movement brought one of the most radical improvements to date in the ethics and civility of the modern world in the 60s and 70s, it did not bring a corresponding revolution in the legal framework of society (as, say, the French or Soviet revolutions pretended to in their own days). Its legal consequences were afterthoughts to its ethical content, just as the forces that opposed it were also fundamentally (un-)ethical, not rational. And (despite their attempts to “wash themselves” in the waters of civil rights), the state and coercive apparatus of the US and the former colonial empires did not become inherently a better “law” (din, lex, dharma, or what-have-you) because of the change.People looking at the world for change—and more than just Islam is in need of a lesson in civics, ethics, and philosophy—from the point of “reform”, always implied to be imposed from above, miss the point.
