PDF Editor FAQ

Has Bruce Banner ever received legal punishment for his behavior as the Hulk?

Bruce Banner is a particularly interesting character from a legal perspective as he suffers from temporary insanity that he can make efforts to prevent by controlling his anger. So could he be held responsible for any crimes he performed as The Hulk?In The Incredible Hulk #279, the Avengers and the United States military finally give Marvel's longest-suffering hero the respect he deserves. Following a presidential pardon for all the destruction he's caused over the years, the Hulk is honored in Manhattan with a parade, the key to New York City, an inter-dimensional welcoming committee (seriously, the ceremony stretches from the Big Apple to Atlantis to Asgard), and a giant statue celebrating his accomplishments. The fascinating challenges involved in evaluating Banner’s guilt for actions he took while he was overtaken by The Hulk. It’s worth noting that while different writers have given Bruce Banner differing levels of control over his Hulk state, this article will only be discussing The Hulk that has a similar relationship of Mr. Hyde to Dr. Jekyll -a character that is totally uncontrolled by his creator’s mind.Obviously, Bruce Banner could plead insanity as he is not in control of his actions when The Hulk takes over his body. With the exception of when he has control. A lawyer can only prove an insanity defense by showing his client has a mental disease or defect that prevented him or her from distinguishing right from wrong and knowing or understanding the nature or quality of his or her illegal actions. Having an entirely different entity live inside you and take control of your body would certainly count as a mental defect and since Banner is unaware of The Hulk’s actions during his rage phase, that would certainly qualify him for the knowledge aspect of the insanity defense.Typically, attorneys are reluctant to use the insanity defense because even if it is successful, their client will still be sentenced to treatment at a mental health hospital. Because the treatment phase lasts until doctors believe the patient is actually cured, studies have often showed that those who use the insanity defense spend more time institutionalized than they would have if they were sent to prison. In the case of The Hulk vs. Bruce Banner though, this becomes incredibly more complex because punishing an innocent party in the process of punishing a guilty one falls under cruel and unusual punishment.

Without using Venezuela as an example, what is so bad about socialism?

Want to know the God’s honest truth worst thing about socialism?People don’t know what it means. Note I didn’t say “Conservatives,” I said people. That means people on both sides. There is an entire group of people on the left-hand side of the aisle who think they advocate for socialism because they’ve been repeatedly told that the things they advocate for are socialist. Then, of course on the right-hand side of the slide, you can’t go half an hour watching or listening to a conservative pundit without hearing the complaints about the spread of socialism. The vast majority of what people on both sides of the conversation are arguing about is in fact capitalist. What is socialism? It’s an economic system where the means of production and distribution are owned and controlled by the community as a whole. Until you are talking about nationalizing industry and abolishing the free market, you are squinting at things that seem a little “socialisty” and ignoring who actually produces and distributes.Easy enough to understand. A few things that get in the way of actual conversation about solutions to problems we look at as a nation are when people look at something, and when they squint they can see something “Socialisty” and pretend that means the whole system is going to end with the same results as the worst examples of the most corrupt “socialist” economies in existence. Like Venezuela. On the other side, you have a whole subsection of people advocating for well-regulated markets, government solutions to economic problems like the wealth gap, and affordable health care, who have been screamed at so often by the other side about socialism that they think what they want is socialist. It doesn’t help when a guy like Bernie Sanders who hasn’t proposed a single actual socialist program in recent memory calls himself a “Democratic Socialist.” Then again, Bernie isn’t a Democrat until it comes time to run for President, so his goal isn’t to be helpful to Democrats. The most common example of this problem is the problem of health care and the opinion divide over single-payer health care. It’s by far the best example of this point.Right now, in this country, health care is provided by, in other words, produced and distributed by doctors, hospitals, pharmacists, drug companies, etc. In other words, private industry, the free market. Capitalist. The most common solution advocates for universal health care advance is a single-payer solution, in other words, “Medicare for All.”If that passed, and everyone was covered by Medicare, not just people 65 and up, who would be producing and distributing health care?Doctors, hospitals, pharmacists, drug companies, etc. In other words, private industry, the free market. Capitalist. What changes is the profit motive of the middle man. The organization paying the bills no longer has a profit motive. Now when you squint, You can say, well, socialism also means “regulated by” society as a whole, so that really is sort of socialisty. That’s true. Medicare for all gives the government an enormous amount of power to regulate the market. But there is a huge difference between that and the nationalization of industry as a whole which is what you have in Venezuela, a problem compounded by the dictatorial control of the government by an unscrupulous, corrupt, terrible human being, and it’s important not to overlook how much Maduro’s incompetence contributes to the problem. The problem isn’t just Maduro though, you can’t simplify it to that level. When people look at the nationalization of industry as a solution to out of control unscrupulous corporations, they tend to overlook the fact that by nationalizing industry, you’re in effect making one giant unscrupulous corporation that regulates itself. That problem is compounded when you end up with a CEO like Maduro. And that’s the problem real socialist states have historically run into.So on one side you have people advocating for something that would ensure universal health coverage, and cut the average American’s health care expenditures in half even if they’re paying the full amount it would take to make it deficit-neutral in taxes, thinking that’s socialist, and so saying “we want socialism. “ On the other side you have people who fear the cost and the regulatory oversight of the market, pointing to areas where the idea compares to socialism and leaping 20 logical steps to the most corrupt actually socialist economy on the planet.Do you see? The problem isn’t saying “Venezuela is socialist, and it sucks.” That’s a simple sentence containing 2 statements of fact. The problem is saying “We can’t let the government do anything, because Venezuela is socialist and it sucks.” If that were true, we would be Venezuela already, because we already have Medicare, we already have publicly provided services paid for by taxes like schools, roads, security, fire departments, sanitation, mail delivery, etc, etc, etc, and have since the beginning. As Harry Truman said in 1952:[Republican Senator Robert] Taft explained that the great issue in this campaign is “creeping socialism.” Now that is the patented trademark of the special interest lobbies. Socialism is a scare word they have hurled at every advance the people have made in the last 20 years.Socialism is what they called public power.Socialism is what they called social security.Socialism is what they called farm price supports.Socialism is what they called bank deposit insurance.Socialism is what they called the growth of free and independent labor organizations.Socialism is their name for almost anything that helps all the people. When the Republican candidate inscribes the slogan “Down With Socialism” on the banner of his “great crusade,” that is really not what he means at all. What he really means is, “Down with Progress — down with Franklin Roosevelt’s New Deal,” and “down with Harry Truman’s Fair Deal.” That is what he means.Sound familiar? The “creeping socialism” scare tactic has been used and used and used and yet, for some reason, we have all those things Truman was talking about and somehow we’re still not Venezuela nearly a century after the New Deal was proposed?Maybe it’s time to look at things individually based on their merits? The truth is it’s time to stop calling a glass of water “The Pacific” and claiming you’ll drown in it without a life vest.

Do you think Donald Trump is unbeatable in 2020?

Yes, he's been unbearable for some time and doesn't look as if he's likely to change… oh, I'm sorry. You meant "unbeatable". With a T.It's certainly not inconceivable that he might pull off a similar trick again, if the Republicans just decided to hold their noses and follow that malodorous banner. But in the long term it's looking more and more likely that something will pull him down. It might be Mueller. It might be lawyers. It might be discoveries of illegal behaviour in office and running for office. Possibly even more likely than any of these is his own mental and physical health. His behaviour has shown a clear disregard for the Constitution and the people of his nation. Despite making all sorts of promises he's failed in most of them. He had shown either an inability or lack of interest in selecting "the best people," and his ability to form sentences without a script, let alone follow a train of thought, seems to have fallen catastrophically in the last couple of decades (older videotapes show that he did start out with that ability, which is why I'm wondering if he's suffering from an organic brain disorder or perhaps just the strain of taking up a new and very challenging job at over 70).When Trump uses the words "Believe me!" I start to worry. When he came up with what was essentially a forged doctor's note I wondered what he was hiding, but it really looks as though the wheels are coming off at the moment, and the whole disastrous enterprise will plunge into ruin.
