Ok. So you wanna live the American dream.First, the way.Since you are not working, you will need to find an employer in U.S. who can sponsor your H1-B visa. The timeline for applying for H1B visa is first week of April for every year. If everything goes well, you could get your visa approved by September with Visa for 3 years. Go to U.S. And at the end of 3 years, file for 2 years extension. When 1 year is left, file for green card with your employer. If all goes well, you will get your greencard. Btw, you can apply for green card from the day you land in US but that depends on the employer. Note: Earlier, the law was that if you have applied for green card and your application is in process, your H1B gets extended indefinately until the result of your GC application is received. However, the recent H1B law changes state that if you haven’t got a green card before your current visa expires, you need to leave the country.After completing 10 years legally, file for citizenship and you are done.Now for reality check:You won't find an H1B sponsor who will bear the cost of your visa. Law prohibits employers from asking for money for vis but realistically, there is always a backdoor way for companies to get money. If you complain to USCIS (US immigration), no surity you will get any positive result.Even if you decide to give money voluntarily since you are eager to go to US, H1B is a lottery system which picks applicants randomly. So if you dont get picked, try next year. You will be reimbursed back the money if your employer is good but chances of that are remote.If you get selected in the lottery, there could still be hurdles like insufficient documentation or additional documentation required. Once that happens, it could take years for the query to get resolved. So tht will block your money for eternity.If you are lucky and you do get the visa, the US is lately not keen on hiring H1B people due to Trump's agenda of America first. There is also an invisible racist wave against immigrants by Americans that has taken rise lately.Even if you get a job, chances are less of that being for 3 years.If you service 3 years, extension cases lately have been delayed like crazy and you cannot be in US IF YOU HAVE NOT RECEIVED YOUR EXTENSION BEFORE CURRENT VISA EXPIRES.In a nutshell, dont leave India. There are many other social factors as well like Indians themselves not helping Indians, etc.India is in a good shape and you have ample opportunities here. Money isn't everything and those in US are just showing you the good side which is like tip of the iceberg of bad side.P.S. If your H1B application is picked in the lotteryYou can work under the Cap-Gap extension until September 30th. After that you have 60 days grace period to leave the country during which you are not suppose to work. You can come back after the H1B Approval.If your H1B application havent picked in the lottery and your attorney gets the return packet.Be prepare to leave. Immigration team of your company will let you know your last date. I wouldn’t overstay and jeopardize my entire chances of not setting my foot in America again.
