What is Form 4868?

To Ariel Black,As someone who had to file Form 4868 last week, I may be uniquely qualified to answer this question. My CPA says I am getting a refund, so I will not owe any penalty or interest.Form 4868 is the U.S. Internal Revenue Service (IRS) form for filing an extension on your individual tax return (Form 1040) so you can file your real tax form later (by October 15) once you collect all the paperwork and details. You will still owe any taxes due plus interest, but by filing Form 4868, you at least avoid a penalty. If you are due a refund, there is no penalty if you file a late tax return. However, if you wait more than three years to file your taxes, you cannot claim your refund.Because today (April 18, 2018) is the last day to file your 2017 taxes, you can file a Form 4868 (Application for Automatic Extension of Time To File U.S. Individual Income Tax Return) by midnight today and you will avoid any penalty. You can pay the taxes later, but you will only owe interest. The full form is here: https://www.irs.gov/pub/irs-pdf/f4868.pdfA view of the part you send in is below. It can be filed electronically or by mail, and must be postmarked by midnight tonight.Image courtesy of WonderShare(dot)comNOTE: April 15 is the usual official deadline for filing taxes, but several things conspired to move the date to April 18 for this year only:The official April 15 deadline fell on a weekend, which means the taxes would have been due the next business day (Monday, April 16).However, April 16 is Emancipation Day, a holiday observed in Washington, D.C., so the IRS moved this year’s deadline an extra day and allowed taxpayers to wait until Tuesday, April 17, to file this year.HOWEVER, in the early hours of Tuesday, a computer glitch paralyzed part (or all) of the IRS filing system, so the IRS moved the deadline yet another day to midnight tonight (Wednesday, April 18).Happy filing, kids!—Sarah M. 4/18/2018ORIGINAL QUESTION: What is Form 4868?

What should a new immigrant (H1B employee) know before filing taxes in the US?

The first thing that a new immigrant should do is read IRS Publication 519 (2012), U.S. Tax Guide for Aliens. That publication contains almost everything that you need to know about filing taxes when you are not a US citizen.I also strongly suggest that you talk with a tax advisor who is experienced in filing returns for non-US citizens. US tax law is generally complex and an experienced advisor can steer you through the complexities and advise you based on your specific personal situation in a way that I can't do over the Internet. The main reason that you would file for an extension of time to file your return is if you wanted to claim dual status for 2012, you don't yet qualify to do so, and you expect to qualify to do so sometime after April 15. You could qualify for dual status in 2012 if you were present in the US on your H1B visa for at least 31 consecutive days in 2012 and for at 75% of the days between the first day of the 31-day period and the last day of 2012 - but you will not qualify for dual status for 2012 if you did not meet the substantial presence test in 2012 until you meet the substantial presence test for 2013. If you won't meet the test for 2013 until after April 15, you can file for an extension by April 15 using IRS Form 4868, http://www.irs.gov/pub/irs-pdf/f4868.pdf, and you should pay the amount of tax that you would owe if you filed as a nonresident for all of 2012 when you file that form. Again, though, I suggest you work this through with a tax advisor before you make a decision to determine what status is best.

Can I still mail my tax return after April 15th?

Yes, but you should send in Form 4868 by April 15 to let the IRS know you’re still thinking about them. It’s just about the smallest form the IRS has: a two-by-eight scrap of paper with your name and address, and a guess of how much you might owe.And you can file it online, at irs.gov.One thing that the other answers fail to stress: Filing 4868 does not give you more time to pay if you owe additional tax. You still must pay any amount due by April 15. However, it will eliminate the failure-to-file penalty (which is huge) and if you are pretty close in your payment to the actual amount owed, it will eliminate late-payment penalties. You will still owe interest on any underpayment. When filing Form 4868 online, you are given the option to direct-debit any tax payment too. After filing form 4868, you will have until October to file a proper tax return.
