An A2A. “Overworked,” a defense raised in accompanying answers, is statutorily excluded as a reason for the failure or the inability of a public agency to make timely disclosure of public records as required by California law. So while it might be true that agencies like the LAPD are overworked and understaffed, the LAPD can and should be invited to follow the advice it so often gives others: They can tell it to a judge.Through its email acknowledging receipt, the LAPD has met its burden to respond to your public records request within 10 business days - even if the response was non-responsive. This is not the same as the time within which the records must be disclosed to the requester. That’s set by Gov.t Code, § 6253, subd. (b) which states “…each state or local agency, upon a request for a copy of records that reasonably describes an identifiable record or records, shall make the records promptly available.”Any person may file a civil action for injunctive or declaratory relief, or writ of mandate, to enforce their right to inspect or receive a copy of any public record or class of public records under the act. Failure to make records promptly available is a cause of action covered by the act. The burden of defending its failure to comply would fall on the already “overworked” LAPD. The act also provides an immediate appeal to a higher court for those denied timely disclosure of public records. The LAPD doesn’t get to appeal.Approach the LAPD. Reserve your right to pursue relief through the courts (let them know you know you can sue), but offer the department assistance in making the legally required disclosure. You can do this by narrowing the scope of your request or through some other form of accommodation. If this doesn’t work, and the LAPD continues to remain unresponsive, exercise your right under the act to bring a civil action against the department.The LAPD technically isn’t breaking the law. It’s in violation of an act of the Legislature and the California Constitution. But you have rights. And a law that favors you over the police. Use both.
