By this time, we’d made a significant amount of improvements to the home: the kitchen was completely gutted and redone with granite countertops and premium cabinetry, a wall was removed to enlarge the kitchen, bathrooms were 100% remodeled, etc. Looking at comps in the area, the home we’d bought for $150k could easily sell for $270k.So, I really didn’t think anything of it when the first bank we went to for refinancing told me they’d be sending out an appraiser. I paid the initial fee and scheduled for a time when the appraiser would come by and waited patiently…for somebody who never arrived.Days later, I receive an email that my appraisal documents are ready, which I curiously opened…to find that my house had been appraised at $160k. It took me seconds to see what the problem was; the appraisal was based entirely on the idea that my home was still the original 1050 sq ft home, it specifically identified it as such. The appraisal was a drive-by; he just pulled up in front of my house, didn’t notice the significant alterations to the home, inside and out, and left.That’s just great.Of course, it really thrilled me to see that I was also expected to pay for this appraisal, even if I didn’t go with this financing.The call to this bank was rather enjoyable…I did get a full refund on my initiation fee and the appraisal.

I did not see this but rather heard it from my brother who was the expert witness who was the one being cross examined. My brother was tasked with appraising the structural damage that had been done to a series of homes by blasting at the neighboring mining operation. Now appraisers will typically focus on square footage in a house, the number of rooms and the overall condition of the house during their appraisals and then compare that to similar houses in the area to estimate a home’s environment. Typically though, an appraiser couldn't care less about the color of the drapes or wallpaper as these items rarely factor into the overall value of the home. Consequently, after my brother had testified on how the damage had reduced the value in one of the homes, the opposing lawyer under cross-examination started asking my brother all sorts of questions about the colors of the drapes and wallpaper in the various rooms in the house. Since this information was not in his notes, my brother truthfully answered that, because this information was not a factor in his analysis, he did not remember. After about 5 - 10 minutes of this the jury was obviously bored and their attention was wandering. And then the lawyer made his mistake. After my brother once again stated that he did not remember the color, the lawyer responded with “Well, Mr. Pritchett, it looks like you do not remember very much about that house”? At that point my brother responded with “You are right, I don’t remember much about the color of the drapes and wallpaper in that house. But, the one thing that really sticks in my mind is the presence of the jacks in the basement holding the ceiling up.” Needless to say that woke the jury up and the lawyer was never able to recover from the gaffe. Also, needless to say, the home owners won their claim for damages.
