Sorry to give you the bad news: it won't.The movement is flawed in both its objectives and the path to achieve it.[1] A flawed conceptAnna Hazare and his team has reduced the fight against corruption to a single project - the Lokpal (ombudsman) Bill.a. Let's look at some of the specifics of the Jan Lokpal Bill (surprisingly, the latest version is missing from the public domain - if you find one, please paste the link in the comments) There have been many versions floating around and I'm still not sure if the version I have is the latest one.i. It aims to create a parallel bureaucracy to control the existing bloated system. It's said that India's progress has been blocked by the North Block and the South Block. Adding another layer would not yield a better system, but a more complicated one.ii. Anna seeks to bring CBI's anti corruption wing under the Lokpal. With the transfers and postings of top CBI officials (the IPS cadre) still under strong political control, it's difficult to fathom how anti corruption investigations would improve.Proof: The Supreme Court had once given a CBI director near absolute freedom (almost unheard of in independent India) in investigating a corruption case. Still the case got completely butchered.Even if the anti corruption wing of the CBI started functioning independently, without clear support from ED, IT and other departments, it will be difficult to build a strong anti corruption case.iii. Seeks to bring the judiciary and PMO under lokpal's purview. Dangerous and not going to happen.iv. Opens a pandora's box through filing frivolous complaints. Will be a nightmare as a risk averse bureaucracy will completely stop taking any decisions. Recall that at the time of the Commonwealth Games, many departments simply stopped functioning as they knew any work they do would be seen as an attempt to make money. The officials also knew that a corruption inquiry is in the air and it made no sense to work on something that damages their ACR. It's for precisely this reason that our anti corruption laws take a strong view of such complaints.v. Blanket approval for phone tapping. Government proposed approval from the Home Secretary, but Anna's team says "this will compromise investigations."Some ideas are beyond comprehension.Take one - The Lokpal's appointment committee should include a judge in the Supreme Court ... in fact, the juniormost judge. Anna's team has put forth the logic that as your tenure increases, your chances of being corrupt are higher; showing a lack of understanding of the appointment process of Supreme Court judges.b. Instead, they could have chosen an issue where there's a broad consensus on the path forward.I'll give just one short example - take the case of police reforms. Reforming India's policing system and making it independent from political influence is necessary in curtailing both abuse of power and corruption.The Supreme Court has been pushing in the right direction.In 1979, the National Police Commission (NPC) was set up to report on policing and give recommendations. It produced dozens of recommendations and a Model Police Act. However, none of the major recommendations were adopted.After nearly 15 years, two former police officers filed a Public Interest Litigation (PIL) in the Supreme Court for directions to implement the Police Commission recommendations. (see Prakash Singh and others vs Union of India and others)In 2006, after a decade long struggle, the Court delivered its verdict. It ordered the states and union territories to comply with binding directives that would kick start reform. The Court required immediate implementation of its orders either through executive orders or new police legislation. It set up a monitoring committee and asked states to file periodic status reports.In late 2010, it took serious note of the lack of compliance and issued notices to the errant states. Recall that it took him over 2 decades before he gave the rallying call for Quit India movement.Anna, on the other hand, decided that blackmailing India's parliament was the best way forward in getting a dubious law passed. His approach has been extra constitutional in a representative democracy and reeks of handing power to a rowdy mob.Tomorrow if Anna decides that all Indians should wear dhoti, would you still support it? Or if there's a movement to get honor killing legalized?Recall the Gurjar agitation of 2008 when Rajasthan was brought to a halt on the issue of reservations. If Anna can bring the Parliament to its knees, the gujjars have every right to do so. After all, over three dozen died for the reservation cause and which, in their opinion is perhaps more important than the Lokpal Bill.[3] Anna's biggest sponsorSome may disagree, but there was an inherent conflict of interest when IAC started taking donations. The biggest donor (~30% of total collections) was Jindal Aluminium. It is run by the Jindal family, which has close ties with the Congress. In fact, Naveen Jindal is a Congress MP from Kurukshetra.[4] Mass appealWith its volunteer force and an ability to pull crowds, support from the right wing and especially the RSS was a key reason behind the movement's success in Delhi.However, as Anna and team distanced themselves from the right wing and without a disciplined cadre backing them, Mumbai was a flop show. Raja, a powerful minister from a strong regional ally. Since the Prevention of Corruption Act, 1988 mandates that "No court shall take cognizance of an offence .... alleged to have been committed by a public servant, except with the previous sanction ... of the authority competent to remove him from his office." [Ch IV, Cl 19], Swamy had to approach the Prime Minister for sanction to remove Raja. However, his complaints fell on deaf ears.With no response from the Prime Minister to his incessant requests, Swamy moved the Delhi High Court for a direction to the Prime Minister. However, his petition was dismissed. Undeterred, Swamy then moved the Supreme Court and his petition became part of the long litigation that was now building up against Raja.On January 31, 2012 after a period of over two years of heated arguments, the Supreme Court of India delivered a historic judgement, quashing the 2G licenses. They noted -"Before concluding, we consider it imperative to observe that but for the vigilance of some enlightened citizens who held important constitutional and other positions and discharged their duties in larger public interest and Non Governmental Organisations who have been constantly fighting for clean governance and accountability of the constitutional institutions, unsuspecting citizens and the Nation would never have known how the scarce natural resource has been grabbed by those who enjoy money power and who have been able to manipulate the system." [Pg 91, SC judgement]Moreover, the Supreme Court ruled that it is the constitutional right of a citizen to move to prosecute any public servant. And effectively has directed that the authority from whom prosecution permission is sought, has to take a decision within three months. And if, within four months, no decision is taken, the permission shall be deemed to be granted...Narashima Rao, one of modern India's architects, made an interesting speech in 1995. The change has to come from withinJP was instrumental in translating raw anger into votes through the Janta Party. On the other hand, the Anna movement has been working on "sab neta chor hain" (all politicians are thieves) concept and instead of working with the opposition, they have tried to bypass the entire parliamentary system.To bring effective change, Anna and his team needs to channel their energies through the electoral system. A small urban middle class lighting candles at India Gate cannot force the government to take action that fundamentally alters the system.They should instead learn from a man working tirelessly right across the border. Imran Khan has caught the popular imagination in Pakistan and has terrified both PML and PPP. Come next election, and there's a high chance that his party will form the government.C. FocusThey need to have a clear vision and deep analysis when they propose a fundamental change to a system. Piecemeal work and speeches make for interesting soundbites but cannot bring real change.Ramnath Goenka and Arun Shourie were able to bring down AR Antulay's government through a targeted crusade that relied on a huge fact base.Sadly, this movement is high on style, but lacks substance.
