A few things to note:Cipollone’s letter asserting the illegitimacy of the inquiry does not mean that it’s actually illegitimate. He’s doing that on order from the President, but no court in the land would ever overturn the Congressional prerogative to maintain oversight over the Executive Branch. It’s written into the Constitution, for goodness sakes. They absolutely can (and indeed, in instances of clear Presidential misconduct, must) investigate and decide if action needs to be taken.The President ordering that the White House not co-operate with Congress could be construed as a Federal crime. It’s Obstruction of Justice, in addition to Contempt of Congress: if the Legislative Branch orders a formal investigation and initiates impeachment hearings, the President does not have the authority to prevent anyone participating in them, and encouraging them to do so is illegal. Only a claim of Executive Privilege can prevent testimony, and that’s not going to stand up to scrutiny.Bear in mind: anyone refusing to co-operate with Congress (particularly if they’re in receipt of a subpoena) would be committing a felony themselves. Trump might be immune to prosecution, but nobody else working in his administration shares that protection.Esper and other members of the current administration don’t have a choice but to co-operate with Congress, ultimately: failing to do so would be a criminal offense. Although they can challenge a subpoena in court, that’s really their only option.
