It really depends. There is no one size fits all to this. I was once involved in a case which involved a bill of lading between two commercial parties. The terms were in fine print on the back of the invoice. The judge asked for the terms to be typed out in normal sized font and double spaced. They came to 23 pages in that form. Nobody suggested that either of the commercial parties should not be bound by them.Conversely, there are all sorts of clauses which may not be upheld if they are buried in the fine print. Laws vary from country to country, but in the UK this is policed primarily by the Unfair Contract Terms Act and the Unfair Terms in Consumer Contracts Regulations.
