I have never believed in revenge. When someone has betrayed me; I take it in stride and I also take measures to insure that it will not happen to me again.A few years ago; my next door neighbor purchased a rototiller. He then proceeded to till up his front yard lawn which wasn’t in good shape any way. He set the tiller blades too deep and also tore up all of his irrigation.Being a landscape designer and owning a landscape firm right next door must have seemed like a God-send to him. He and his wife approached me and asked for help. Being a nice person; I worked with them and set a budget for the project. They then started changing things which required change orders. It wouldn’t have been a bad thing; but his youngest daughter was going to be married in forty five days. The wedding was suppose to be in the front yard.We fixed the irrigation and then laid sod. We also installed a flagstone patio on the west end of the driveway (change order). We also installed potted plants across the front of the house with irrigation (change order). Then the wife wanted Lemon Thyme planted between the flagstone pavers (change order). Then they decided that the backyard didn’t look good enough for the wedding (change order) and asked that we fix it up also. This was after he took his rototiller to it.After doing all of this work and then they had a beautiful yard. They didn’t have enough money to pay for the additional work that they requested. At least that was their story when presented with the final bill. After the wedding; the neighbors disappeared for a couple of weeks. I found out that they had gone to Hawaii for a vacation as they were so stressed over the wedding.When the company insisted that they complete paying for their landscaping; they spread the word among the friends the company had had in the community. They insisted that we were overcharging them and that the additional work was part of the original project.I basically told the other customers’ who asked what was going on; a short version of this was the original scope of work and these were the changes that they made after the fact. I also told these interested people that without their final payment; the neighbors wouldn’t have a warranty.I placed a lien on the property after waiting 90 days for payment. He even came over and asked if I could donate the materials and labor as a gift to them because of the wedding. Simple answer was NO.Since that time; the neighbors have tried to make nice. No, that doesn’t include paying their outstanding bill. It is to the point now that if he or she tries to be friendly, I know that they want a favor or free advice. The latest was that their irrigation timer, accidentally got broken. Could I please, please, please get them another one with my discount and they would pay me later. Simple answer NO.I feel that they betrayed me by telling people that I was trying to cheat them; when very clearly they had added additional work. The materials and the labor for the additional projects were paid for out of my pocket. I still have the lien on their home and they still haven’t paid their bill. I am cordial but I will not help with any landscape issues that they have.

I'm glad you guys asked me to answer this question.I don’t know about other firms but I can tell you my roles and responsibilities as a Senior Contracts Engineer in Hindustan Construction Company Ltd (India)There is so much to take care of..I’ll give you a gist.1. Execute proper contracts appreciation and ensure adherence to contractual conditions:We are normally provided with a hard copy of Contract Document which consists of thousands of pages.Whenever we need important clauses like variations/payments/advances etc, we can’t search the entire document. So, we prepare a Contracts Appreciation Document (we simply call it CAD).We enlist all the important clauses and streamline them in different schedules. I am not supposed to say anything more than that. This helps us in finding important clauses whenever required.2. Identify risks and develop risk mitigation plans:Detailed analysis of Risk is done at different levels of Project Cycle likea. Pre Qualification Stage,b. Tendering/Bidding Stage,c. Project Planning and Procurement Stage,d. Execution and Monitoring Stage,e. Project Closure and Claims stage.f. Project Operation and maintenance stage.etc.3. Develop and maintain client relationship:Even if you have a legitimate claim, client will not accept your claim. You can’t do anything without client’s support.So, we maintain good relationship with the Client.4. Ensure timely & accurate work measurement, billing, certification and collection:Need to keep a track on interim payment schedule. Check the deductions(Taxes, Interests on advance taken) and advances (Material advance, Mobilization Advance etc), Bank Guarantee expiry details etc.Escalation calculations for steel, cement, labor, fuel and other commodities. Principal and interest deductions in the RA Bills. I personally love this Math part of my job.5. Ensure identification, documentation and submission of claims & variations.This is the most interesting part. Refer all the related documents and IS codes to find a loophole in the contract document and claim extra time and cost.6. Ensure documentation and preparation for Dispute Review Boards & arbitration:Ok… Dispute!? Here we come :D7. Draft contractual letters to get them approved by Project Manager and send them to Client, Subcontractors, Government bodies etc.This is the most boring part. I had to sit for 3 weeks to draft a letter (14 pages) for Extension of Time. (Biggest career achievement so far- Awarded with 6 months project Extension based on a strong claim)8. Finalize sub contractor engagement:Creating subcontractor work orders, finalizing their rates and their scope of work etc and ensure validation of subcontractor bills as per contract conditions, including reconciliation of material/ quantities using SAP.9. Ensuring of various contemporious records are correctly maintained by various departments as required in terms of the contract provisions.10. Recording hindrances and rescheduling physical and financial milestones as per the delay analysis using MSP.etc.There are many other roles but we concentrate more on these.(We get to do planning, scheduling, micro-scheduling too). Economics whether positive or normative science: A positive science explains why and how of things and normative science explains the right or wrong of the things. Economics is both, it not only tells us why certain things happen, it also says whether it is right or wrong.
