Indian importers are not permitted to import goods against advance payment in cash from any country in the world except Nepal or Bhutan. There is a Foreign Exchange Management Act in place in India. Payments for imported goods is made through Letters of Credit issued by the importers bank in India to the exporters bank in China. The Chinese exporter has to provide proof of shipment on board a ship or aircraft. Once the goods are shipped and s Bill of Lading or Airway Bill is issued, the Chinese exporters ownership rights of the cargo ceases and the carrier becomes the custodians for the cargo. Once the carriers dues are paid before the ship arrives at the designated Indian port, the carrier delivers the goods to the importers who take posession after paying duties and ancillary charges at the port. The exporter submits the one original set of the Bills of Lading to his bank in China who confirms receiving this to the importers bank in India. On receiving this, the importers bank transfers the cost of the goods to the exporters bank in China in foreign exchange. The equivalent amount of this foreign exchange is debited to the Indian importer's account in Rupees from the importers deposit account with this bank. This is a fail safe method of international trade transactions the world over, and has been practised for over 200 years. Since India has a FEMA, it is a criminal offence for Indian importers to pay for inports in foreign exchange by any other manner. There is no exchange control restrictions between India and Nepal and Bhutan. Therefote it is not illegal to import goods from Nepal and Bhutan by direct payment. If a babk credit isn't established by the Indian inporter, the Nepalese or Bhutanese supplier may insist on 100% advance payment. The supplier may defalcate the money and not supply the goods. There's not much the importer can do about it, if he is foolish enough to trade in this manner. Most honest traders conduct even domestic suppliers through bank letters of credit. People with unaccounted money cannot ooen bank credit lines without being detected.This question relates to a problem that may arise for a criminally dishonest Indian importer, importing goods from China and paying for these by illegal foreign exchange transaction through illicit financial channels. The problem speculated on is in effect that of an Indian criminal being deprived by a Chinese criminal. There cannot be any legal or diplomatic solution to this. This is irrespective of the political relations between India and China at the time.
