Can GoI refuse to implement the Supreme Court's decision for paramilitary forces for granting NFFU/NFSG on the request of IPS who fought a case against CAPFs?

Unlikely in current scenario where the Govt of India had to back down in an end to end prolonged legal battle between the haves and have-nots. Organised Group A Services are getting organised far more powerfully on the sheer strength of numbers. Even though the IAS and IPS are the controlling and dominant cadre, the Govt of India is not very happy with the situation especially due to its hatred for corrupt delay-tactics red-tapism of the IAS and corrupt political-criminal nexus of the IPS.NFFU has been accepted for CAPFs by the Govt of India despite the opposition of the IAS and IPS. In fact Govt of India now favours Organised Group A services including CAPF cadre coming into Central Govt senior positions from Joint Secretary level onwards in order to end the monopoly of the IAS and IPS. The recently concluded experimental Lateral Entry Scheme is a step in the same direction. Govt of India now wants experts in the decision making than generalists of the Civil Services.Even the Armed Forces are facing the same resistance from the IAS Bureaucrats in the MoD as the CAPFs faced in MHA. Hopefully, the Supreme Court will grant it to them too. It is rumoured that just to stop the Armed Forces from getting their due the IAS/IPS lobby may force the Govt to junk the concept of NFFU itself. But it is neither justified nor feasible now that the Court rulings have treated it as discriminatory practice in violation of Article 14 of the Constitution of India. If NFFU is junked now the IAS/IPS would have to be disbanded to ensure equality of employment. No service can claim to be above others similarly placed and employed. The parachuting of IAS/IPS into Top Govt positions is already being questioned and changed by the Political dispensation itself. Here are the recent report to buttress the argument.Strong and Clear Court Judgements. “The apex court had in February upheld a Delhi High Court verdict on the subject and agreed that all the CAPFs be recognised as "organised services", saying it will remove stagnation, ensuring the promotion and other service-related benefits to officers in the same post. In its February order, the SC had held that Group A officers of the CAPFs should be given all benefits, including NFFU from 2006 in terms of the 6th Pay Commission. The top court, during this hearing, had upheld the Delhi HC's two verdicts by which it had granted "organised service" status to these forces and also to the officers of the Railway Protection Force (RPF). The Delhi High Court had on March 15 subsequently asked the Centre to file a compliance affidavit on the subject after a retired and a serving officer of these forces filed a contempt petition before it, saying the government has not complied with its directions.” [1]Political Assurance to CAPFs. “More than a month after the Union Cabinet approved better pay benefits to Central Armed Police Forces (CAPF), the process has been mired in alleged ‘foul play’ by Indian Police Service (IPS) officers. The meetings with Madhav and Birla came in the backdrop of several letters that were written to Home Minister Amit Shah by some CAPF officers. The letters alleged that IPS officers were deliberately thwarting release of the Non-Functional Financial Upgradation (NFFU) grant to CAPFs despite a Supreme Court ruling in February ordering the same. According to several retired and serving CAPF officers who ThePrint spoke to, Madhav is principally in agreement with them and has assured that he will talk to Shah after 15 August.”[2]Grant of Group A Status to CAPFs. “The central government Wednesday accorded the Organised Group A Service status to senior officers of the Central Armed Police Forces (CAPFs) that will ensure better service benefits for them, ending years of legal battle.”[3]Grant of NFFU to CAPFs. “The cabinet also approved extension of benefit of Non-Functional Financial Upgradation (NFFU) and Non-Functional Selection Grade (NFSG). It will benefit about 11,000 serving officers and a few thousand more who have retired since 2006 from the five primary CAPFs or paramilitary forces -- Central Reserve Police Force, Border Security Force, Central Industrial Security Force, Indo-Tibetan Border Police and Sashastra Seema Bal.”[4]Modi Backs the Decision. “The Union cabinet meeting that cleared the proposal of the Ministry of Home Affairs (MHA) was chaired by Prime Minister Narendra Modi, it said.”[5]Lateral Entry Scheme. “Out of over 6,000 private sector specialists, who had applied for 10 posts of joint secretary in central government departments, only 89 have been short-listed, officials said Monday. Opening the doors of the bureaucracy for private sector professionals, the government had on June 10 invited applications for 10 Joint Secretary-level posts through lateral entry as opposed to the UPSC examinations.”[6] [7]Induction of Non IAS Joint Secretaries. “The government on Monday appointed 33 new joint secretaries in the Centre out of which only seven are from the Indian Administrative Service (IAS) and four from the Indian Revenue Service (IRS). Living up to its promise, the government has brought officers from other services like the Indian Railway Service of Mechanical Engineers, Indian Post and Telecommunication, Accounts and Finance Service and Indian Defence Accounts Service.”[8]Demand of Armed Force for NFFU resited by MoD. “Ministry of Defence (MoD's) stand that Non Functional Upgrade (NFU) should not be extended to the military because officers have palatial houses has sparked rage among serving officials as well as veterans. Government's opposition for denying NFU is that armed forces have several facilities and privileges that other services don't get, including certain special allowances. "The government is also of the view that armed forces have a different functional structure that will break down if NFU is granted," said an official privy to the details.”[9]Armed Forces Activist for NFFU Threatened.Armed Forces in Supreme Court over NFFU.Latest Update. The Armed Forces case is listed to be heard on 19 Oct 2019. Govt Of India seeks and granted four weeks time to serve notices to some listed petitioners (doing that for last one year already). Let’s see 19 Nov 2019 now.Footnotes[1] Govt grants NFFU, special selection grade to CAPF officers, ends years of litigation[2] Armed police force allege foul play by IPS[3] Govt grants NFFU, special selection grade to CAPF officers, ends years of litigation[4] Govt grants NFFU, special selection grade to CAPF officers, ends years of litigation[5] Govt grants NFFU, special selection grade to CAPF officers, ends years of litigation[6] Only 89 of Over 6000 Candidates Short-Listed For Lateral Entry into Civil Services[7] Government appoints nine professionals for joint secretary posts in ministries[8] 33 joint secretaries appointed by Union govt, only 7 from IAS[9] Serving officials rage over Defence ministry's stand on Non Functional Upgrade
