Thanks for the A2A.The contentious National Medical Commission Bill, 2017 is the brainchild of two Expert Committee’s led by Prof. Ranjit Roy Chaudhury(2015) and Dr. Arvind Panghariya(2016).The suggestions of both these committees was to structurally reconfigure the functions of MCI(Medical Council of India) and improve and upgrade the standards of medical education in the country.Based on the recommendations of these committees, the current Bill proposes to replace MCI with NMC(National Medical Commission). The reason being, MCI has been mired in controversy since 2010 when its President was accused of corruption and bribery charges while granting permits to medical colleges.However irrespective of the noble intentions of the law makers, this Bill has become major bone of contention between the Government and the Medical Fraternity on the following points:Composition and Powers of National Medical CommissionThe newly proposed body will have its members appointed and nominated by the Government while the MCI had members elected from the medical fraternity.This is seen as a loss of autonomy and freedom by the MCI especially given the huge amount of power allotted to the NMC which include:Framing policies for regulating medical institutions and medical professionals,Assessing the requirements of healthcare related human resources and infrastructure,Ensuring compliance by the State Medical Councils of the regulations made under the Bill,Framing guidelines for determination of fees for up to 40% of the seats in the private medical institutions and deemed universities.The IMA contends that this Bill, “will "cripple" the functioning of medical professionals by making them completely answerable to the bureaucracy and non-medical administrators.[1] ” Dr K K Aggarwal, the former president of IMA, said:"It (the bill) takes away the voting right of every doctor in India to elect their medical council. Abolishing a democratic institution and replacing it with a body in which a majority is nominated by the government, is certainly a retrograde step.”But the Government claims the new body will have experts from related fields, which will put Indian standard of education at par with global standards.National Licentiate ExaminationThe Bill states that after completion of MBBS the students will have to appear for an exit test to get the license in order to practice medicine.This is seen as an unnecessary, insensitive burden against the plight of doctors and medical students who have already been through a rigorous academic year[2]Concessions to Private Medical CollegesThe draft bill, in its current form, allows private medical colleges to charge at will, nullifying whatever solace the NEET brought.Bridge Courses for AYUSH PractitionersAnother issue which sparked the protest against this Bill was Section 49 which allowed AYUSH (Ayurveda, Yoga and Naturopathy, Unani, Siddha and Homoeopathy) practitioners to take up a bridge course, post which they can prescribe modern medicine.According to WHO, a healthy doctor patient ratio is 1:1000. In India, this ratio is 1:1,674[3] . So, Government’s intention behind introducing this bridge course was to fill up the demand supply imbalance in Indian health care system.However, Indian Medical Association was concerned that this will promote quackery and have grave medico legal consequences. They proposed that instead of this bridge course, government should give incentives to the already qualified healthcare providers to work in semi-urban and rural areas. Others were of the opinion that we can take inspiration from China’s barefoot doctors[4] to bring paramedics to remote rural areas.What has the Government Done So Far?On 28th March, 2018, the cabinet led by Prime Minister Modi, approved the following amendments to the draft NMC Bill[5] :The final MBBS Exam to be held as a common exam across the country and would serve as an exit test. It would also serve as the screening test for doctors with foreign medical qualifications in order to practise in India.The 6 months bride course for AYUSH practitioners has been left to the choice of State Governments. If they can come up with viable alternatives to address medical manpower shortage in rural areas, they need not implement the bridge course. However, so far some states have already implemented it.Imprisonment of 1 year and fine upto Rs. 5 lakhs has been provisioned to address the problem of quackery.The representation of doctors in the NMC has been increased upto 21 members out of 25. Number of nominees from states and UTs in the NMC has been increased from 3 to 6.The maximum limit of 40% seats — for which fee would be regulated in private medical institutions and deemed universities — has been increased to 50%.Monetary penalty on a medical college non-compliant has been replaced with provision that provides other penalty options.However, the Bill still did not meet the complete expectations of medical fraternity which felt that the issue of bridge course has simply been pushed under the rug.Mid Level PractitionersFinally in another round of amendments on May 5th 2018, the Government introduced a new provision which proposes to create a new cadre of mid level medical practitioners will get limited licence to practise specified medicines in primary and preventive healthcare settings and in other settings under the supervision of a medical doctor[6] .So far under the Indian laws, only MCI-licensed and registered medical doctors can practise medicine and prescribe them.The Bill also provides for a separate register to list such mid-level medical practitioners with limited drug prescription rights. So,when the Course is same,the Reputation of the College Plays a Key Role.The students of AIIMS are known as AIIMSonians.Best No. Of Cadavers Per BatchCadavers are an Important part of studying Gross Anatomy,thus plays a major role in forming a Good Base in MBBS.AIIMS Bhopal provide 8 Cadavers per Batch for Dissection and 2–3 Extra Cadavers for Surface Marking. i.e 12–13 Students will get One Cadaver.At AIIMS Bhopal Students are allowed to dissect Cadavers ,which will help gain more experience. It is much better than studying from predissected Cadavers.There are No post MBBS Service Bonds.Due to Intelligent Peers and Seniors we end up learning atleast a Step further than we might in a Normal Government Medical College.Histology Labs provide one Microscope for Two Students.Hematology Labs also provide one Apparatus for Two Students(Lab Partners).There are Integrated Classes for First month after Joining. Later on we were shown Clinical Cases such as Varicose Vein(Around November).Seminars are Conducted from 1st semester onwards.First Seminar was done on 9th Nov 2019. The procedure to start a new medical college is prescribed in which is as under for the minimun standerd requirement for 50 / 100/ 150 / 200/ 250/ admissions with a Hospital four years befoe.For a very good 200 bed hospital the cost would be over 500 crore.ELIGIBILITY CRITERIAThe following organisations shall be eligible to apply in Form-1 for permission to set up a medical college, namely :-A State Government/Union territory;A University;An autonomous body promoted by Central and State Government by or under a Statute for the purpose of medical education;A society registered under the Societies Registration Act, 1860 (21 of 1860) or corresponding Acts in States; orA public religious or charitable trust registered under the Trust Act, 1882 (2 of 1882) or the WAKFS Act, 1954 (29 of 1954).2. QUALIFYING CRITERIAThe eligible persons shall qualify to apply for permission to establish a medical college if the following conditions are fulfilled :-1. that medical education is one of the objectives of the applicant in casethe applicant is an autonomous body, registered society or charitable trust.2. that a suitable single plot of land measuring not less than 25 acres isowned and possessed by the person or is possessed by the applicant byway of 99 years lease for the construction of the college.3. that Essentiality Certificate in Form 2 regarding No objection of theState Government/Union Territory Administration for the establishment ofthe proposed medical college at the proposed site and availability ofadequate clinical material as per the council regulations, have beenobtained by the person from the concerned State Government/ UnionTerritory Administration.4. that Consent of affiliation in Form-3 for the proposed medical collegehas been obtained by the applicant from a University.5. that the person owns and manages a hospital of not less than 300 bedswith necessary infrastructural facilities capable of being developed into ateaching institution in the campus of the proposed medical college.6. that the person has not admitted students to the proposed medicalcollege.7. That the person provides two performance bank guarantees from aScheduled Commercial Bank valid for a period of five years, in favour ofthe Medical Council of India, New Delhi, one for a sum of rupees onehundred lakhs (for 50 admissions), rupees one hundred and fifty lakhs (for100 admissions) and rupees two hundred lakhs (for 150 annualadmissions) for the establishment of the medical college and itsinfrastructural facilities and the second bank guarantee for a sum of rupees350 lakhs (for 400 beds), rupees 550 lakhs (for 500 beds) and rupees 750lakhs (for 750 beds) respectively for the establishment of the teachinghospital and its infrastructural facilities :Provided that the above conditions shall not apply to the persons who areState Governments/Union Territories if they give an undertaking to provide funds in their plan budget regularly till the requisite facilities arefully provided as per the time bound programme.8. Opening of a medical college in hired or rented building shall not bepermitted. The Medical college shall be set up only on the plot of landearmarked for that purpose as indicated.3. FORM AND PROCEDURESubject to the fulfillment of the above eligibility and qualifying criteria, the application to establishment of medical college in Form-1 shall be submitted by the person in the following parts, namely: -Part - IPart-I of the application shall contain the following particulars about the person, namely: -1.Status of the applicant in terms of the eligibility criteria;2.Basic infrastructural facilities, managerial and financial capabilities of theapplicant (Balance Sheets for the last three years in case the person is not a StateGovernment or a Union Territory).3.Necessary certificates/documents as prescribed in qualifying criteria underparagraph 2.Part – II1. Name and address of the medical college;2. Market survey and environmental analysis (a) state medical education policy,(b) needs and availability of trained medical manpower, (c) gap analysis and howthe gap will be reduced, (d) Catchment area in terms of the patients for theproposed medical college, (e) No. of hospitals/Primary Health Centres/PrivateClinics available in the Catchment area (f) How will the existing medical facilitiesget augmented by the establishment of proposed medical college.3. Site characteristics and availability of external linkages – (a) topography, (b)plot size, (c) permissible floor space index (d) ground coverage (e) buildingheight (f) road access (g) availability of public transport (h) electric supply (i)water supply (j) sewage connection and (k) communication facilities.4.Educational programme – (a) proposed annual intake of students (b) admissioncriteria (c) method of admission (d) reservation/preferential allocation of seats (e)department wise and year wise curriculum of studies.5. Functional programme – (a) department wise and service wise functionalrequirements, and (b) area distribution and room wise seating capability.6. Equipment programme – Room wise list of (a) medical (b) scientific, (c) alliedequipments, complete with year schedule of quantities and specifications;7. Manpower programme: - Department wise and year wise requirements of (a)teaching staff (full time), (b) technical staff, (c) administrative staff, (d) ancillarystaff (e) salary structure, (f) recruitment procedure and (g) recruitment calendar.8. Building programme – building-wise built up area of (a) the medical college,(b) faculty and staff housing, (c) staff and students hostels, (d) administrativeoffice, (e) library, (f) auditorium, (g) animal house, (h) mortuary , (i) cultural andrecreational Centre and (j) sports complex.9. Planning and lay out – (a) master plan of the medical college complex, (b)layout plans sections, and (c) elevations and floor-wise area calculations of themedical college and ancillary buildings.10. Phasing and scheduling - Month-wise schedule of activities indicating (a)commencement and completion of building design, (b) local body approvals (c)civil construction, (d) provision of engineering services and equipment, (e)recruitment of staff and (f) phasing of commissioning.11. Project cost: - (a) capital cost of land, (b) buildings, (c) plant and machinery,(d) medical scientific and allied equipment, (e) furniture and fixtures and (f)preliminary and pre-operative expenses.12. Means of financing the project:- (a) contribution of the applicant (b) grants (c)donations, (d) equity, (e) term loans, and (f) other sources, if any.13. Revenue assumptions : (a) fee structure and (b) estimated annual revenuefrom various sources;14. Expenditure assumptions : (a) Operating expenses and (b) Depreciation;15. Operative results : (a) income statement (b) cash flow statement, and (c)projected balance sheets.Note: For columns 4 to 8 , a comparative statement showing the relevant Medical Council of India norms vis-à-vis infrastructure/faculty available and/or proposed to be made available shall be annexed.Part – III1. Name and address of the existing hospital2. Details of the existing hospital including : (a) bed strength, (b) bed distributionand whether the norm of five in patients per students would be fulfilled, (c) built-up area, (d) clinical and para-clinical disciplines, (e) out patients departments andout patients department attendance department wise, (f) architectural and lay-outplans, (g) list of medical/allied equipments, (h) capacity and configuration ofengineering services, (i) hospital services, administrative services and (j) otherancillary and support services (k) category-wise staff strength.UPGRADATION AND EXPANSION PROGRAMME:3. Details about the additional land for expansion of the existing hospital : (a) landparticulars, (b) distance from the proposed medical college, (c) plot size, (d)authorized land usage, (e) geography, (f) soil conditions, (g) road access, (h)availability of public transport, (I) electric supply, (j) water supply, (k) sewageconnection and (l) communication facilities.4.Upgraded medical programme : Year wise details of the additional clinical andpara-clinical disciplines envisaged under the expansion scheme.5. Upgraded functional programme : (a) specialty-wise and service-wisefunctional requirements, (b) area distribution and, (c) specialty wise beddistribution;6. Building Expansion programme : Year wise additional built-up area to beprovided for (a) the hospital, (b) staff housing, (c) staff, student hostels and (d)other ancillary buildings;7. Planning and layout : Upgraded master plan of the hospital complex along with(a) layout plan (b) sections, (c) elevations, (d) floor wise area calculations of thehospital and (e) ancillary buildings;8. Details about upgradation or addition in the capacity and configuration ofengineering services and hospital services;9. Equipment programme : Upgraded room wise list of (a) medical and alliedequipment, (b) schedule of quantities and (c) specifications;10. Upgraded manpower programme : category wise distribution of (a) medicalstaff, (b) para-medical staff and (c) other staff ;11. Phasing and scheduling of the expansion of scheme: Month-wise schedule ofactivities indicating (a) commencement and completion of building design, (b)local body approvals, (c) civil construction, (d) provision of engineering andhospital services, (e) provision of medical and allied equipment and (f)recruitment of staff;12. Project cost of the expansion scheme : Cost of additional (a) land, (b)buildings, (c) medical and allied equipments, (d) furniture and fixture and (e)preliminary and pre-operative expenses;13. Means of financing the project: (a) contribution of the applicant, (b) grants, (c)donations, (d) equity, (e) terms loans and (f) other-sources, ( if any);14. Revenue assumptions : Income from various (a) procedures and services, (b)upgraded service loads and (c) other sources;15. Expenditure assumptions : (a) operating expenses, (b) financial expenses and(c) depreciation;16. Operating results : (a) income statements, (b) cash flow statements and (c)balance sheets.4. APPLICATION FEE:The application shall be submitted by registered post only to the Secretary (Health), Ministry of Health and Family Welfare, Government. of India, Nirman Bhavan, New Delhi – 110 011 along with a non-refundable application fee of Rs. 3.5 lakhs in the form of demand draft/pay order in favour of ‘Medical Council of India’ payable at New Delhi. The Fee is for registration, technical scrutiny, contingent expenditure and for five inspections. Beyond five inspections, the normal inspection fee prescribed by the Council will apply. The Schedule for receipt of application for establishment of new medical colleges and processing of the applications by the Central Government is given in the Schedule annexed with these regulations.5. REGISTRATION: -Applications referred by the Ministry of Health & Family Welfare to the Council will be registered in the Council for evaluation and recommendations. Registration of the application will only signify the acceptance of the application for evaluation. Incomplete applications will not be registered and will be returned to the Ministry of Health & Family Welfare along with enclosures and processing fee stating the deficiencies in such applications. The Council shall register such incomplete applications, if so directed by the Central Government for evaluation but shall submit only a factual report in respect of them and shall not make any recommendations.6. EVALUATION BY MEDICAL COUNCIL OF INDIA: -The Council will evaluate the application in the first instance in terms of the desirability and prima facie feasibility of setting up the medical college at the proposed location. Therefore, it shall assess the capability of the applicant to provide the necessary sources and infrastructure for the scheme.
