This prevents the participant from claiming authorship, copyright or credit for their spontaneous verbal contributions to the “script”.Image and likeness. This refers to the talent’s physical appearance. This include use of the talent’s image and likeness in the primary work, as well as in promotional materials.Performance. This refers to the talent’s manner of interpreting the role portrayed in the production. It may also cover musical performances or choreography, and indirectly (to the casual, nonprofessional participant) classifies the primary work (the movie) as a fictional representation rather than journalistic, documentary or factual interview. A work of fiction has greater latitude that permits editing and guiding the talent’s performance to suit the artistic interests of the producer, rather than the factual representation in a non-fiction work.Incidental and non-performance. The crowd and video release language allows the producers to use non-specific, incidental recordings where the talent appears or is heard outside of what the participant might argue is the “boundary” of the performance for they released their rights.The video release is a reaffirmation that the participant will be captured on recorded media, just in case they later claim not to understand the form of the primary work. The materials release covers all ancillary aspects of what is recorded that the participant might assert under copyright: photographs and artworks within their home and property or on their person; written works within same; music or sounds within same; and so forth. The crowd release allows the recording of open and public areas without requiring prior written consent from people who cross or enter the area recorded.Cohen’s documents aren’t this simple, but for illustrative purposes…Most releases contain the following provisions:An authorization to record the participant and to use the recording and other material about the participant in one or more productions and related advertising and promotion, in all media, in perpetuity.A statement of the compensation to be paid to the participant (or that no compensation will paid).A provision that the producer owns the recordings in which the participant appears and any contributions to the production made by the participant.A release of claims in favor of the producer.A choice of law and venue provision for the producer's preferred jurisdiction.Some appearance releases go considerably further, such as by authorizing the producer to make re-creations (dramatic sequences) portraying the participant, fictionalize events involving the participant, or use the material authorized under the release in books and even scripted feature films. If a re-creation, fictionalization or similar production technique, or a book or other derivative, is actually contemplated, provisions like these are appropriate.But while a producer might think to include such provisions "just in case," they are objectionable to many participants and could stand in the way of a release being signed.
