TATA NEXON FAN CATCH – TERMS & CONDITIONSTata Motors Ltd. (hereinafter referred to as "TML") has, decided to run a promotion known as Tata Nexon Fan Catch for cricket spectators who would be attending the Vivo IPL 2018 matches at different stadiums across India between 7th April 2018 & 27 thMay 2018. Under the promotion, the first person to make a clean one handed catch of a 'six' hit by either team at Vivo IPL 2018 (subject to the further criteria below) gets a chance to win Rs. 1 Lac per catch per match. One winner across the VIVO IPL 2018 season gets to win a Tata Nexon.The details of the promotion and its terms & conditions are explained hereunder:The Tata Nexon Fan Catch promotion will be governed by the following terms and conditions and all participants will have to abide by them. This promotion is an optional promotion conceptualized and organised by TML.. The promotion shall commence on 7thApril, 2018 and shall continue till the last VIVO IPL 2018 match on 27thMay 2018. TML has the right to withdraw or discontinue the promotion at any given point of time and for any reason.1. Eligibility:The promotion is only open to legal residents of India except Tamil Nadu & Pondicherry, Kolkata & Jaipur and each participant should be above eighteen (18) years of age as on 7th April 2018.Employees, agents or officers of Tata Motors Limited (TML) or of any entity involved in the development, production and implementation of the promotion including any advertising or promotion agency, parent company, service provider, subsidiary or affiliate of any such entity or any other entity directly associated with TML or any member of the immediate family of and/or person living in the same household as such persons, including but not limited to TML, are ineligible to take part in the promotion.2. Tata Nexon Fan Catch details:If and when a Player hits a 'six' during the live match into the stands and any fan takes a one handed catch – then subject to these Terms and Conditions, he/she is eligible to win Rs. 1 Lac from TML.If there are multiple one handed catches taken in the stands in a single match, the person who took the first compliant one handed catch of the match will win the Rs. 1 Lac award. There will only be one award of Rs.1 Lac per IPL match, assuming that the criteria in this paragraph 2 are satisfied..The catch has to be a clean one handed catch. A clean catch is one where the ball does not make contact with anything after leaving the bat until caught one handed by the participant after being struck out of the field of play. The catch cannot be taken on a rebound off someone else’s hand/ walls/ chairs/ railings etc or by diving. Either hand can be used to make the catch. The decision of TML with regard to any conflict or any other matter regarding the catch shall be final and binding on the participantsThe TATA Nexon Fan Catch is not eligible in the upper tiers of the stadium (wherever applicable). No person should enter the field of play in attempting to take any one handed catch.Any unruly behavior by participants in the stands in relation to the promotion (such as, by way of example, pushing and shoving of other spectators) will automatically disqualify the participant (s) involved.In verifying the winning catch, TML will review the coverage of the catch made on a TV camera. The one handed catch moment captured on a TV camera and showcased on the TV channel will be considered as the final and only proof that the catch has (or has not) been taken (as the case may be). Any alleged winning catch not captured on a camera and therefore not able to be reviewed by TML will be deemed a non – eligible catch. TML’s decision will be final.The prize will not be awarded unless or until verification of the winning catch is made by TML and TML is satisfied that the criteria for a winning catch and these terms and conditions have been met.The on ground sponsorship team of TML or its representatives will identify any winner and get his/her contact details. The details will include - Name, Mobile Number, Alternative Mobile Number, Email Address and Ticket no, Ticket Date & Venue. Irrespective of successful identification on ground, the winner will also need to log on to Price, Specifications, Features, Images, Variants, Colors and share the above details with us online after which the winner’s registration will be complete and he will be eligible to receive the Rs 1 lac. It is the winner’s responsibility to ensure that the correct contact details are provided to TML or its representatives. TML accepts no responsibility for any prize deposited into the wrong or incorrect bank account. TML reserves the right to conduct a security verification check at their absolute discretion. A winner may be required to sign a declaration confirming their eligibility to accept the prize.To win the season award– TML will upload videos of the individual winners of a match of the Tata Nexon Fan catch on their website. People may vote for the best fan catch and whoever gets the highest votes shall be declared the season winner.The season winner gets a Tata Nexon, petrol base variant. There will only be one possible season winner.The season winner must provide proof of age, address in the form of a Photo ID/ PAN Card/ Driving License/ Aadhar Card/ Birth Certificate / Voter ID copy and Address Proof to the Authorized TML/Dealer’s Representative when asked for to claim his/her the season award. TML team will get in touch with the winner for the delivery of prize.The IPL match conditions, duration, dates and venue may be subject to change from time to time. Any changes made to the schedule are outside of TML’s control. Participants will be solely responsible for ensuring that they keep up to date of all such changes. TML will not be liable to any person as a result of any such changes.3. The results of each Tata Nexon Fan Catch shall not be disputed in any manner whatsoever. By taking part in the promotion, participants fully and unconditionally agree to be bound by these rules and the decisions of TML, which will be final and binding in all matters relating to the promotion. Any person by virtue of his participation in the promotion, shall be deemed to have accepted the terms and http://conditions.By participation in the promotion each participant releases and discharges TML, The Board of Control for Cricket in India, each IPL team, each relevant State Association and in each case their respective representatives, affiliated companies and the respective parents, subsidiaries, affiliates, advertising and promotion agencies of each, and all their respective employees, officers, directors, representatives and agents from any liability or damage due in whole or in part to the award, acceptance, possession, use or misuse of any prize and/or gift or from availing this promotion. Each participant agrees that neither BCCI nor any IPL team nor State Association nor any of their respective officers, employees, shareholders or representatives accept any liability for any injury of any kind suffered by any participant or any other person in relation to the promotion.4. The decision of TML with regard to any conflict or any other matter regarding the promotion shall be final and binding on the participants. TML reserves the right to change, curtail or discontinue the promotion without any prior notice.5. Any gift/s as offered cannot be substituted, transferred or exchanged. The winner/s cannot claim cash in lieu of the car on offer for the season award.6. The winner of each prize of Rs 1 Lac and the winners of the car (in each case if any) will be required to bear all govt. taxes including gift tax which might be relevant on the Rs. One Lac amount given to a match winner or the Tata Nexon given to the season winner.The season winner will have to bear all registration, insurance and other costs of any kind related to the Tata Nexon. TML does not accept responsibility for any tax implications that may arise in relation to this promotion. The relevant winner(s) will have to bear all incidental costs, if any relating to this promotion.7. (a) TML Ltd may collect personal data about entrants in accordance with its privacy policy. By availing the offer, participants hereby permit TML to collect and use their personal information and to acknowledge that they have read and unconditionally accepted the privacy policy.(b) Participating in the promotion, constitutes participant’s permission for TML to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, including but not limited to promotion Entries submitted and/or any statements made by winners regarding the promotion or TML for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. If the winner rejects his/her gift or in the event of non-compliance with these rules and requirements, such gift will be forfeited and an alternate winner may be selected.9. TML reserves the right to change/curtail/discontinue/extend the promotion without notice and across all cities or any particular city, if required.10. The Tata Nexon variant given to the season winner cannot be changed or substituted with any other car. Decision of TML with regard to any conflict or any other matter regarding the offer shall be final and binding on the participants.11. Each participant warrants that they are of sound mind, of requisite legal age, have clearly understood the details of the promotion. Each participant further agrees that the promotion does not involve a matter of chance and or gambling and does not call for any entry fee being charged by TML from the participant. The participant agrees to all the aforesaid Terms and Conditions with their free will and there is no compulsion or coercion or undue influence exerted upon the participant to take part in the promotion or agree the terms and conditions as mentioned herein above.12. Indemnify- The participant agrees to indemnify, defend and hold harmless TML, its Directors, Officers, Employees, Agents, Affiliates and Suppliers from any liability, loss, claim and (including reasonable legal fees) directly or indirectly related to (i) the participant’s breach of this agreement, and (ii) the participant’s providing Contents/details to TML.13. Force Majeure- This promotion is subject to force majeure circumstances or any circumstances beyond the reasonable control of TML. TML will not be liable for any delay or adverse effect caused by the participant as a result of Force Majeure event.14. This agreement will be governed by and construed and interpreted in accordance with the laws of India. In case of any dispute only Mumbai Courts will only have exclusive Jurisdiction.
