What exactly are Indian courts (Native American)?

It is very, very complex. There are hundreds of tribes with courts and each is a little different.The general rule is that States have no jurisdiction over the activities of Indians and tribes in Indian country. Basically the principal is the land and jurisdiction was before the existence of the states or territories, in many cases. What they have is the land remaining after the ceded the rest by forced treaty or land given ins compensation of what they ceded. The tribal courts cover some laws and then the federal courts cover the rest. The land is held in trust for the tribes by the federal government so they have the responsibility of administering justice. The tribal lands are NOT state lands. But, it depends a great deal on what state and what reservation you are on. Just as is true in the rest of the US, most law and courts are is different from place to place. General Rules Criminal Jurisdiction in Indian CountryGenerally, tribal courts have civil jurisdiction over Indians and non-Indians who either reside or do business on federal Indian reservations. They also have criminal jurisdiction over violations of tribal laws committed by tribal members residing or doing business on the reservation. It depends a lot on who the victim and perpetrator are (tribal or not) and on what tribal land it happened. The latest numbers of enrolled triabl members who might be under a courts jurisdiction is they were living on the reservation is 12 years out of date. In 2005 the total number of enrolled members of the (then) 561 federally recognized tribes was shown to be less than half the Census number, or 1,978,099. There are now 567 tribes and the population has grown, probably above 2.1 million. Most, however, do not live on Indian lands and thus would only be effected by this when they visit. About 60–70% don’t live on reservation lands.Tribal courts are responsible for appointing guardians, determining competency, awarding child support from Individual Indian Money (IIM) accounts, determining paternity, sanctioning adoptions, marriages, and divorces, making presumptions of death, and adjudicating claims involving trust assets. There are approximately 225 tribes that contract or compact with the BIA to perform the Secretary’s adjudicatory function and 23 Courts of Indian Offenses (also known as CFR courts) which exercise federal authority. The Indian Tribal Justice Act of 1993 (P.L. 103-176, 107 Stat. 2005) supports tribal courts in becoming, along with federal and state courts, well-established dispensers of justice in Indian Country.There are Also CFR courts (Code of Federal Regulations).After the reservations in Oklahoma were opened by land runs to non-Indian homesteading, and federal Indian policy sought to weaken tribal governments and break up tribal land holdings, the courts over time lost their funding and consequently ceased to function. With the void in the enforcement of tribal law, the state began to assert its authority over the remaining tribal and allotted Indian lands even though no jurisdiction properly existed. In recent decades, the Indian tribes have regained the jurisdiction over these lands and have re-established tribal court systems.The State of Oklahoma once contended that tribal governments had no authority to operate their own justice systems, arguing that the Indian nations had no land remaining under their jurisdictions. Much confusion arose because many thought that tribes only asserted jurisdiction over “reservation” lands. Many people in Oklahoma incorrectly assumed that reservations were terminated at statehood. Recent court decisions have made it clear that tribes assert jurisdiction over all lands that are “Indian country”, including reservations, dependent Indian communities, and Indian allotments. These Indian country lands from the basis of tribal jurisdiction today. Since few Indian tribes had operating judicial systems in place in the late 1970's. When tribal jurisdiction was re-affirmed, the Court of Indian Offenses for the Anadarko Area Tribes now the Southern Plains Region Tribes was created. Courts of Indian Offenses are established throughout the U.S. under the Code of Federal Regulations (CFR), providing the commonly used name — the “CFR” Court”. Until such time as a particular Indian tribe establishes their own tribal court, the Court of Indian Offenses will act as a tribe’s judicial system. The only difference between CFR Courts and Tribal Courts is the form of laws they enforce.When the court was re-established in western Oklahoma in 1979, there were four CFR Courts covering eighteen Indian nations. A number of tribes have since established their own systems of justice. Accordingly, the CFR Courts for these tribes have been deactivated. In 1991, a separate CFR Court system was established for Eastern Oklahoma Region Tribes covering eastern Oklahoma, which is headquartered in Muskogee, Oklahoma.One big difference between Tribal courts and other types of state or local courts, is that, as in many places on other lands that are controlled or held in trust by the Federal government, some serious crimes are not dealt with by the local, tribal or state authorities but by the FBI and the Federal courts. This is analogous to what happens with crime is a Federal Park or BLM or Forest land, or on a military base. What crimes on Indian reservations are dealt with by the FBI.“The FBI is responsible for investigating the most serious crimes in Indian Country— such as murder, child sexual and physical abuse, violent assaults, drug trafficking, gaming violations, and public corruption matters. Nationwide, the FBI has investigative responsibilities for some 200 federally recognized Indian reservations. More than 100 agents in 19 of the Bureau’s 56 field offices work Indian Country matters full time.” Indian Country Crime There are 566 federally recognized American Indian Tribes in the United States, and the FBI has federal law enforcement responsibility on nearly 200 Indian reservations. This federal jurisdiction is shared concurrently with the Bureau of Indian Affairs, Office of Justice Services (BIA-OJS).Here is a map of the Indian Country Federal judicial districts. Indian Country in Judicial DistrictsHere is the General Crimes Act (18 USC 1152): This federal statue (enacted in 1817 and set forth below) provides that the federal courts have jurisdiction over interracial crimes committed in Indian country as set forth below:Except as otherwise expressly provided by law, the general laws of the United States as to the punishment of offenses committed in any place within the sole and exclusive jurisdiction of the United States, except in the District of Columbia, shall extend to the Indian Country.This section shall not extend to offenses committed by one Indian against the person or property of another Indian, nor to any Indian committing any offense in the Indian Country who has been punished by the local law of the tribe, or to any case where, by treaty stipulations, the exclusive jurisdiction over such offenses is or may be secured to the Indian tribes respectively.The Major Crimes Act : The Major Crimes Act (enacted following the U.S. Supreme Court’s 1883 Ex Parte Crow Dog decision) provides for federal criminal jurisdiction over seven major crimes when committed by Indians in Indian country. Over time, the original seven offenses have been increased to sixteen offenses currently. So, these crimes are usually prosecuted in Federal District courts.In 1953, Public law 280 was passed. It grants certain states criminal jurisdiction over American Indians on reservations and to allow civil litigation that had come under tribal or federal court jurisdiction to be handled by state courts. However, the law did not grant states regulatory power over tribes or lands held in trust by the United States; federally guaranteed tribal hunting, trapping, and fishing rights; basic tribal governmental functions such as enrollment and domestic relations; nor the power to impose state taxes. These states also may not regulate matters such as environmental control, land use, gambling, and licenses on federal Indian reservations.This changed things in Some states. The states required to assume civil and criminal jurisdiction over federal Indian lands were Alaska (except the Metlakatla Indian Community on the Annette Island Reserve, which maintains criminal jurisdiction), California, Minnesota (except the Red Lake Reservation), Nebraska, Oregon (except the Warm Springs Reservation), and Wisconsin. In addition, the federal government gave up all special criminal jurisdiction in these states over Indian offenders and victims. The states that elected to assume full or partial jurisdiction were Arizona (1967), Florida (1961), Idaho (1963, subject to tribal consent), Iowa (1967), Montana (1963), Nevada (1955), North Dakota (1963, subject to tribal consent), South Dakota (1957-1961), Utah (1971), and Washington (1957-1963).Subsequent acts of Congress, court decisions, and state actions to retrocede jurisdiction back to the Federal Government have muted some of the effects of the 1953 law, and strengthened the tribes’ jurisdiction over civil and criminal matters on their reservations.Here is a summary of who has what jurisdiction: 689. The Peacemaker has the courage and skills to provide the groundwork for the person or group to confront hóóchx̨o’/anáhóót’i’ and move toward mastering harmonious existence. Life value engagement with the peacemaker provides the sense of identity and pride from our cultural foundations. Hóóchx̨o’/anáhóót’i’ can block and overwhelm clanship, k’é, which is normally what binds human beings together in mutual respect. Through engagement, the Peacemaker educates, persuades, pleads and cajoles the individual or group toward a readiness to open up, listen, share, and make decisions as a single unit using k’é. When hóóchx̨o’/anáhóót’i’ is confronted, people may learn there is a choice to leave it. When harmony, hózh̨̨ó, is self-realized, sustaining it will have clarity and permanent hózh̨̨ó will be self-attainable, hózh̨ǫ́ójí k’ehgo nįná’íldee’ iłhááhodidzaa ná’oodzíí’.Through stories and teachings, the Peacemaker dispenses knowledge, naat'áánii, in order to guide the whole toward a cathartic understanding of hózh̨̨ó that opens the door to transformative healing. The flow of hózh̨̨ó is a movement inwards toward the core issue or underlying truth. Recognition of this truth and the ending of denial provide the opportunity for healing or mutual mending. Realization of the truth occurs when individual feelings are fundamentally satisfied. The resolution of damaged feelings is the core material of peacemaking sessions, hózh̨óji naat’aah. Why was the Avro Arrow project cancelled?

If you’re going to spend a bazillion bucks on a plane, it should really, you know, do stuff.Many answers highlight the fact that the Arrow was a very expensive aircraft with no role. Others go into the politics of the cancellation, which remain contentious. It was a contentious period in Canadian politics in general, and the wounds still rankle. In prepping this answer, I went online to look for a video of Stringband’s ironic “Dief Will Be the Chief Again,” and couldn’t find it, because the band is so embarrassed by its success that they prefer to suppress their performance than be associated with it.The politics probably explain the persistence of this question, although the average Quoran OP’s well known inability to find the Google search box (it’s at the top of the screen, FYI) is probably an even better explanation. In any case, here’s a slightly deeper dive.At the time the Arrow was conceived, people were thinking of combat aircraft in terms of the WWII paradigm of rapid turnover and ever-improving performance. And yet, at the same time, it was becoming ever more difficult to design and develop new generations of aircraft.The United Kingdom ended WWII with the Avro Lincoln, a minor development of the wartime Lancaster in frontline service. The Lancaster basically gave up day bombing in favour of night raids against Germany, but casualties were rising so rapidly that it was clear that the Lincoln was obsolescent. A new aircraft was needed, with a much higher ceiling and speed, even if only as a night bomber. Some thought was given to an incremental further improvement of the Lancaster lineage. Here is the final version of the Lancaster, the Avro Shackleton. Built as a maritime reconnaissance aircraft, it was not a complete success due to the extremely complex final generation piston engine that powered it.It seemed more reasonable to go back to the drawing board and design a jet-powered bomber that could carry an atom bomb. A preliminary specification, circulated to industry before the end of WWII, called for 500mph at 50,000ft, carrying a 10,000lb bomb (an atom bomb, in other words), with the range go blow up Commies. Whatever that range might be.The first production variant of the first of three “Vengeance bomber” models was delivered to the RAF in 1955, the same year that the Arrow proposal was finalised.The idea behind incremental technical progress is that if 500mph at 50,000ft is good enough in 1955, the next generation will be even better.Work therefore began on a next generation, Mach 3, supersonic bomber, the Avro 730. It was cancelled in 1957, so here’s a picture of the American B-58, instead.Still faster; still higher. Catching and shooting down a Russian bomber to this design concept that was penetrating North American airspace over the Arctic would require a blazingly fast plane with good range, which really only existed to get an air-to-air missile in the general vicinity of the target.Meanwhile, the USAF was running high altitude spy plane missions over the Soviet Union, because it’s always fun to provoke nuclear-armed powers. The Lockheed U-2 couldn’t go very fast, or carry an atom bomb, but it could make 70,000ft, so high that Russian radars had a hard time even spotting it, it was hoped, and their fighters couldn’t climb to intercept. Prompt Russian protests in 1956 demonstrated that their radars weren’t as bad as all that, and President Eisenhower reined the Air Force in, somewhat.Then, on 4 October 1957, the Russians launched a satellite into orbit on the bus of their ICBM, demonstrating that the long-anticipated day of the intercontinental ballistic missile was at hand. This, by itself, didn’t doom the Arrow. In the thinking of the day, the Arrow would have long since passed out of frontline service by the time the Russians had built up a strategic missile bombardment force. At the same time, the Russians developed their own U-2ski, the Yak 25, and intercepting it would be a much more plausible Arrow mission than stopping a force of atom bombers headed for Chicago (and Toronto and Montreal, I guess).Okay! But, meanwhile, the Russians and Americans continued to work on surface-to-air missiles, a much less Rube Goldbergish way of putting some explosives next to a plane. It now appeared that the next generation of bomber would not fly high and fast, but low and fast.At this point, it is probably a worthwhile digression to point out that peacetime military aviation development is often hard to disentangle from things that the airlines want. The development of the V-bombers coincided with that of the de Havilland Comet, the first generation high-altitude, high speed airliner.Which is great! But with the Comet in service, the next step up in terms of higher speeds at higher altitudes could be visualised dimly, way out at the end of a long and very expensive development path:The Concorde didn’t enter service until 1976, and its American rival never even made it out of the shop.Clearly, it was much more important for the airlines to focus on service delays caused by bad weather, in particularly at airports. Low-level flying in poor visibility required a whole set of technological solutions in terms of onboard sensors, navigation equipment, and some kind of artificial machine that did at least the maths part of thinking for the crew. Call it a “computer,” if you will.It’s an all electrical, automatic pilot! Wonders of the new age, etc., etc.So, leaving aside developments on the airliner front, we get the BAC TSR-2:(By Sisaphus - Flickr - Photo Sharing!, CC BY-SA 2.0 uk, File:TSR 2 (3rd prototype).jpg)Designed to fly low and fast under the radar to drop bombs on the Commies before they knew what hit them —because that’s not destabilisng at all!— the TSR-2 would also, of course, prove all those keen “autolanding” gizmos that would allow Heathrow to handle millions of flush American tourists every year, no matter how bad London fogs got. Final proposals for the TSR-2 design were received in January of 1958, by which time the V-bombers were at least practicing low-altitude penetrations, as well. Eventually, both they and the B-58 airframes would be used up in low altitude training missions, as their next-generation wing spars aged rapidly under the stresses.This was rather alarming to at least some Canadians. The British cancelled a slew of aircraft in 1957 on the assumption that doodling about at high altitudes and high speeds was just making yourself SAM bait. Arguably, this is when the Arrow should have been cancelled, as well, but politics got in the way. It was basically keeping the Canadian aviation industry alive by its lonesome. The St. Laurent government hadn’t been willing to give up the Toronto area going into a June 1957 election. They lost anyway, to a resurgent Progressive Conservative party, notwithstanding it being lead by a moonbats Prairie populist. The resulting minority government was a wee bit paralysed leading into a spring election the next year, in which the PCs won an overwhelming mandate, but proved to be just as paralysed by moonbattiness as by not having a majority in the House.Notwithstanding, the advantage of having a paranoiac at the helm is that no-one’s gonna like him when he goes, and you can load all the terrible decisions on his shoulder. The Americans were meanwhile offering Canada a share of its new integrated, computer-controlled, continental air defence system based on its brand-new BOMARC missile and SAGE computer system.The hardware side of BOMARC was . . . dubious. It was atomic-armed, and designed to stop enemy atomic attack with neutron poisoning, for which a technical solution was eventually found. People I’m tempted to call “hippies” were abstractly upset about atom bombs going off over pristine Canadian wilderness in self defence against atom bombs, and the Americans were all stinkie about how much control they would retain over American atom bombs on Canadian soil.Also, some lunatic decided to make the BOMARC a bit lighter by making it out of a radioactive(!!1!!) isotope. So that made for some fun electoral politics. But, you know, all’s fair in riling up the base (what could go wrong?) and carrying out random character assassinations.That being said, being in on SAGE was clearly a better deal in retrospect than nursing along a domestic aviation industry with massive subsidies. I’m not sure how clear that was at the time, and notice that I’m not saying that SAGE worked, but there you go.So here’s the Arrow, proceeding along, hoovering up money that the Army and Navy wanted, and headed for an uncertain future. Speaking of the future, if you count back, you will notice that 1958 was a midterm election year in the United States, and the future always looks . . . different in an election year. Because it was a long time ago, a Republican President, Dwight Eisenhower of blessed memory, could plausibly argue for not giving all the money to the Pentagon, and the Democrats could find an angle for accusing him of being a cheapskate who wanted to give all the money back to the rich people. (Well, that part never changes.) A charming young Democratic Senator from Massachusetts seized on this angle for his re-election campaign, and highlighted the alleged existence of a “missile gap.” Russia had more ICBMs than America, would have even more in the future, and things were lookin’ mighty bleak for capitalism, I tells ya.The Democrats proceeded to romp to major gains in the House and Senate in ‘58, bringing major civil rights legislation tangibly within reach. Well, that settles it! There’s a missile gap! Who cares about dumb old bombers, anyway? The future belongs toWell, okay, the future actually doesn’t belong to a hypersonic, ballistic-missile-launched extra-atmospheric space plane. (Sales pitch: “What if we fired a ballistic missile at Russia, and its payload was a reconnaissance plane that would fly over Russia at 100,000ft taking pictures of missile silos? C’mon! It’ll be fun!”)Point is, the conventional supersonic, high altitude bomber that the Arrow was designed to intercept was still not in service, and its future lifespan was being further squeezed by missile developments. It wasn’t dead—The North American XB-70 would struggle on through to a 1961 cancellation, but there were doubts that the Arrow could intercept the XB-70, anyway. The North was just too big, the B-70 too fast. BOMARC stations could be more numerous, populate more ridings, and be cheaper. In the meantime, with North American elections over and the new era of the “missile gap” upon us, it was time to euthanise a project that had lost its rationale, and which Canada could not afford.As industrial policy goes, this is both inescapable and unfortunate. Per Ardua ad Astra has a meaning. There’s a universe out there waiting for the human race, if we can keep on going faster and higher. In 1959, we assumed that we would. It’s now looking as though we won’t. Is that really because the technology is so hard? Could it be, rather, that the impetus of WWII was wearing off in 1959? We know, of course, that America took a further step, on the back of an almost WWII-level of public investment. We won’t know if we could have kept on climbing if the world had kept on like that.Just another reason to schedule WWIII, I guess. At least it’ll make teenage boys happy. . .
