Any solution proposal will necessarily be complex in an attempt to address all of these issues. This answer is long and detailed because it is a serious attempt to offer a serious compromise solution. Read it accordingly>>At a New Hampshire Town Hall some time ago, Hillary Clinton said that gun confiscation is something “worth looking at.” Discussing the firearms confiscation program in Australia, Clinton admitted she would consider implementing such a system in America. This was almost certainly political hype and spin and it was soon forgotten….that is, until the next mass shooting occurred and then such statements begin to pop up again. It is, however, very unlikely that any politician will ever seriously press for gun confiscation or even mild gun management reforms.There are more than 300 million registered guns in the US, not counting the illegal ones which might easily top several million. Despite the political rhetoric and the fear mongers that predict mass confiscation, I am sure Clinton knows full well, as do all the politicians, that such action is virtually impossible in America. To think otherwise is simply a product of right wing paranoia and exaggerated talk-show hype.Any discussion of gun control is difficult because it is so emotionally charged and because there is so much distrust on both sides of the issue. If you cannot trust what is being said, then you cannot negotiate any kind of solution. In such a complex problem, we should not hope for simple solutions and yet each side of the issue want assurances that their issues will be addressed and everyone wants a simple, easy answer.To understand both the complexity of the issue and the needed solution, we have to understand that there are actually four sides to this issue. The (1) gun owners, (2) the anti-gun side, (3) the local and national government and (4) the manufacturers and retail merchants. Each has a stake in this game and each has their own separate and different objectives.I would like to suggest a way to achieve the primary objectives of all sides of this issue without most of the usual problems. So that I won't lose a lot of readers before I can finish, let me say that my proposal includes a guarantee that gun owners will not have their guns confiscated at any time in the future. I advocate that this be written into law.Please read all of this and then decide if there can be any other viable solution that would do better.This approach would provide these features:Reduce the time and effort of the gun buyer at the time of purchaseProvide gun buyers with “gun insurance” against lost or stolen weaponsImprove and speed the identification of buyers of guns and ammo by law enforcementTrack sales by gun serial number, buyer’s name, location, etc.Provides positive (legal) identification of law abiding citizens as well as known felonsAllow trend/pattern recognition of multiple buys across state boundariesAllows real-time identification and control of sales to known felonsRaise millions of dollars in new tax revenueThe core of this idea is to impose a variable federal tax on guns and ammo while also offering a discount card to avoid that tax. Here is how it would work:Impose a mandated information federal form that must be filled out for every purchase of any gun, ammo or reloading supplies (bullets, brass, and gunpowder). It would also apply to clips, scopes, suppressors and other selected equipment. This form would require a thumbprint in addition to the usual record of the serial number of the weapon. This form should be sufficiently comprehensive to be able to conduct a comprehensive background check; i.e. significantly longer than the Q&A form now used. The new form must be an original (not a copy) for each and every purchase. The intent is to treat every purchase as if the buyer has never before purchased a firearm, ammo or related equipment.Impose a mandated federal tax on every purchase of any gun, ammo or reloading supplies (bullets, brass, gunpowder). This tax should be sufficiently high enough to reduce sales and motivate people to seek ways to avoid the tax. This tax should be progressive in that it increases rapidly as the quantity of guns or ammo increases during any one purchase or within specified short periods of time. Ammo and gunpowder would be limited in quantity to a fixed number of rounds per day that can be purchased (20 rounds for rifles, 50 rounds for pistols, 100 rounds for rimfire .22’s) and no more than one weapon per month.Offer gun purchasers the option to apply for an ID and Discount card (call it the “IDD” card) that would allow the purchaser to avoid the federal purchase tax and remove the limitation on the quantity of guns and ammo that can be purchased. In order to obtain this discount card, the gun purchaser must fill out an information sheet and obtain a certified positive background check, sign a statement that they have received and read a pamphlet on federal and state gun laws, submit a thumb print and have a picture taken and pay a fee of about $25. All of this would only need to be done once and would be valid for life.Ideally, the IDD card application would require thumbprints read by an electronic reader and have the card applicant’s picture taken by a web camera. The gun sales merchant would file a weekly electronic report which would include sales receipt data, card scans, thumb print and camera images and document scans or database transfers of the hard copy forms for those purchasers that do not have an IDD card. The monthly reports for discount card purchases could be almost entirely automated and would be encrypted and sent over the Internet to a central database.The gun purchaser can also pay a nominal added one-time fee ($5) per gun to add a gun insurance policy to his IDD card. This would insure that if his gun is ever stolen or lost and recovered or turned in to any law enforcement agency, anywhere, that they will return his gun to him, at no additional cost (other than collect postage). This would make use of the record of the serial number of the weapon taken at the time of the sale. Additional insurance could be offered by commercial insurance companies to cover stolen or lost weapons that are NOT recovered.During the first year of use, the gun owner would swipe the IDD card through a reader to reduce the federal gun tax by 50%. At the end of the first year, the entire federal gun tax would be eliminated. If the gun owner is ever convicted of any felony or any minor offense involving a gun, his card is cancelled and he will have to reapply for a new one. At each purchase of guns or ammo, the card is used and a thumb print scan is made to verify the card belongs to the purchaser.From the gun owner’s perspective:In practice, the delay and effort of filling out the form, the cost of the federal tax and the limitations on bulk purchases will motivate responsible and law abiding citizens to obtain the discount card and insurance. An added benefit would be that holders of the discount card would be allowed to make purchases at gun shows but those without the card would have to transact the purchase and take possession of the weapon at the store at some date after the gun show. Sales between private parties could also use the IDD card by having the seller take down the buyer’s IDD card number and then entering the transaction at an online federal website.Although this will be seen as a “gun registration” effort, it can be marketed as offering significant benefits to law abiding gun owners while not limiting the purchase of guns or ammo (with the card). To further reduce the objections, the card application could include a legally binding guarantee that it will never be used to confiscate the guns that are registered using the card. The implication is that without the card’s guarantee, guns might someday be subject to confiscation.Once the card is issued, the gun owner is offered the chance to extend the lost/recovery insurance and the guarantee to not confiscate to all previously purchased guns. Each gun would cost just $5 to register and insure, however, for each previously purchased gun brought in to an FFL merchant and added to the card, the owner would receive an additional 5% discount for all future purchases during that first year of card use. Adding 10 guns to the card would completely eliminate the 50% gun tax during that first year.To make use of the gun insurance, the owner must notify the IDD system (using the nearest FFL merchant’s system or an online website accessible by the public) of the lost or stolen weapon. When/if the weapon is found and turned in to any law enforcement agency and it has been previously reported as lost or stolen, it will be returned to the owner. If it has not been reported lost or stolen by the owner or the gun is not registered with the IDD card, then the gun might not be returned and might be destroyed. Special arrangements could be established between FFL merchants and law enforcement for the safe and legal transfer of the firearms to the owner.At the time of purchase, for an IDD card holder, he would scan his card and press his thumb print in a reader and then would be exempt from the federal tax. No other action would be required at the time of purchase by the buyer or seller. The same actions would apply to transactions made at gun shows. A purchase at a gun show would have to return to the merchant’s store at some later date and repeat the above actions in the store. This delay would apply even if the merchant has all the needed forms and scanning equipment at the gun show.From the gun retailer and merchant’s perspective:The sales delays and the need to scan hard copy forms and the loss of sales due to the increased cost from the gun and ammo tax will motivate merchants to advocate buyers to get the card. Providing the merchants with the scanning, computer and thumb print devices and equipment or a subsidy to buy it will reduce the objections to implementing the necessary infrastructure. Returning a portion of the collected taxes back to the merchant in the form of a quarterly or annual subsidy might also offset some of the sales loss and added labor.If the gun retailers are convinced that the guarantee not to confiscate is valid and is legally binding then it will remove a significant objection to the use of the card and forms. However, the threat of confiscation is one of the marketing ploys used by the gun retailers to boost sales. Turning that against them in promoting the card might be effective and may even reduce overall sales and the frequency of people accumulating large arsenals.From the Anti-Gun LobbyThe positive identification and background check performed when the IDD card is initially issued will significantly improve (reduce) the sale of guns to the criminal element and to past offenders. It will also speed the capture of criminals that use guns and the trace of guns to their source. The required review of gun laws and the collection of taxes that can be used to pay for gun safety programs and will improve the overall awareness and education of the general public about gun ownership and safety.Promotion of the IDD CardOne of the most critical aspects of this idea is the guarantee not to confiscate card carrying gun owner’s guns. It is generally understood that such confiscation would be very impractical, if not, impossible, for the 300 million guns in current private ownership. Short of a Draconian state of martial law and the inevitable armed resistance to such confiscation, it would be useless to attempt it. With that in mind, a declaration by the government that the federal government would never confiscate privately held firearms is not really giving up any degree of power or control. This guarantee, of course, does not apply to felons or anyone that commits any kind of crime with a gun, including misdemeanors, hunting violations, etc.An extreme implementation of the use of the IDD card might be considered as an option - which is that if someone has a gun that is not registered in any federal database and/or not on his IDD card, then that gun might be subject to “retention” by law enforcement until such time as the owner does register it. This might apply to hunters that have been charged with a hunting violation or to anyone involved in any kind of legal altercation with law enforcement in which a firearm is involved or found on the premise or in the vehicle. This would have to be marketed as a “detention” or “temporary retaining” until it is being registered. The registration process would involve a background check to confirm that the owner should be allowed to retain the firearm.To make this IDD card work, the gun owners have to believe it is not a prelude to confiscation – to that end, I propose that the Congress pass a federal law forbidding any federal agency from ever confiscating firearms from any law abiding citizen that has not been charged with a felony or a gun related misdemeanor. Loss or refusal to issue an IDD card might also apply to certain kinds of mental disorders, people on a terrorist watch list, new immigrants, people on visa’s, illegal aliens, etc.Wording can be carefully chosen so that it implies that this is true only of those that hold the IDD card and only for the guns listed on the IDD card account for each owner. Given that the NRA will very likely support any law that guarantees that guns will never be confiscated, there will be no problem getting Congress to pass it.Note that this does not change or alter any state law that wishes to impose stricter requirements but it should apply to all sales, including foreign sales and imported guns and to homemade guns and other weapons.Polls show that even among a significant portion of NRA members, there is no objection to background checks and compliance with FFL requirements. Additional marketing perspectives might include: (1) Similar “pre-registration security” cards are used for bypassing airport security; (2) the tax collected could be used to fund gun safety and education including subsidies given to the NRA to fund youth gun safety and training (3) card based discounts are in common use in grocery stores and gas stations: (4) The guarantee not to confiscate is a critical and valuable feature and will deflate a lot of objections if it is properly expressed.Implementation:The extended hard copy or online/computer-based form could be implemented almost immediately – replacing the existing Q&A form that most people regard as being useless. Having the owner’s thumb print and image encoded and encrypted onto the IDD card itself, allows for positive verification without the need for network access to a central database, however, like typical credit card transactions, it would be necessary to validate that the IDD card is active or has not been cancelled.This system will require the establishment of a new screening database that mimics the way credit cards are used. The infrastructure to make use of thumb print readers, webcam images, form scanners and weekly/monthly reports could be offset by using some of the money from the tax and fees to subsidize the gun merchant for the purchase of the equipment needed.One of the quickest and easiest ways to distribute the needed infrastructure is to prepare and sell an all-in-one laptop computer that includes all the needed software preloaded in ROM, a built-in thumb print reader, a card scanner, a web camera, a wifi and modem connection and a separate but compatible and connected (by USB) document scanner. Such equipment is already available from several commercial sources and would cost under $750 for the total hardware/software package. Having a central system server that would allow FFL holders to download and keep current the needed software would assure that every merchant is using the same software and reporting requirements. Use of 128 bit encryption, a tunneling VPN and a plug-in USB security dongle would assure that the system cannot be hacked.Using this laptop would also facilitate the gun seller to maintain compliance with the sales limitations for non-IDD card purchasers. The thumbprint and pop-up photo image could be used to scan for previous sales and dates to see if the buyer is qualified to buy. A black list of unauthorized buyers could also be distributed to keep known felons from buying.Initially, the hard copy form could be filled out and then scanned. Later, the hard copy form and the IDD card application could be fully automated on the laptop. The laptop could be used for future purchases for scanning the IDD card and taking the thumbprint.Using a combination of overlapping security techniques would assure the system cannot be hacked, even if a merchant’s laptop were stolen. The merchant will be given a USB dongle that plugs into the laptop and contains a security ID and scrambling algorithm that the laptop must have in order to communicate with the central registry. The merchant also must sign in using a password and user ID. Finally, the system will identify the phone number, system IP address and computer’s MAC code of the merchant’s location and system to validate connection to the central system. If a different computer is used, if the computer is moved to another location or if there is a duplicate system access detected, that merchant’s system is locked out until the problem can be resolved. Any data of local sales kept on the laptop is heavily encrypted and all other data resides on the central server database, also encrypted. Use of an encrypted virtual private network (VPN) on the internet assures that the data cannot be intercepted enroute to/from the server. Similar high security systems are used by banks and some government agencies and can be easily implemented at nominal cost.BenefitsThe database created by this system would include gun serial numbers, buyers, locations, and sellers in a searchable database for use by law enforcement. This would facilitate tracing firearms as well as returning stolen firearms. Running trend analysis and pattern recognition algorithms on this “big data” database can trace potential buildups of arsenals, routes and frequency of stolen gun traffic and other useful information across all geographic boundaries. By adding ammo, gunpowder and reloading equipment to the IDD card purchase, arsenal buildups, purchase and resale trends and other conclusions and extrapolations of the big data analysis would be possible on regional and national scales.The use of photos and thumb prints would provide positive tracking of actual buyers and would reduce the straw buyers by being able to track buys across geographically dispersed sales locations.In a manner similar to checking for a valid credit card, the scanned IDD card and scanned thumbprint and matching pop-up photo are confirmed to be correct at each and every purchase. If the card does not match the thumbprint or photo then there is no sale.If the card and print and photo match, and the card is from a local or in-state resident, then it is cross checked against an internally stored blacklist of known felons. This internal (within the store’s IDD laptop) database would be smaller than a national listing and would contain only the local, regional or in-state felons.If the card and print match, and the card is NOT from a local or in-state buyer then the thumb print is matched to a much larger online database in a national registry. This might take a few minutes but it would be done only to out-of-state buyers - where that is legal.Obviously, any of the parameters, prices and details of this can be modified but I believe this is a very reasonable and practical step in the right direction. It has the advantage that it is not a cosmetic or knee-jerk response to mass shootings while not being an extreme, unreasonable or unworkable response. It offers the gun owners the option to not participate but it offers financial and convenience incentives to willingly volunteer.
