PDF Editor FAQ
What are the copyright limits on reuse of another company's policies, terms of use and other customer facing legalese?
The following, slightly edited, is from a blog post I wrote almost four years ago (Can I Create my Standard-form Contract by Starting with Someone Else’s?) - concerns a printed contract rather than online terms, but applicable, nevertheless:AFLAC v. Assurant, et al. illustrates where the line between what is protected and what is not protected can be drawn. Here is a brief summary:AFLAC created, with substantial expenditure of personnel time, certain new insurance policies that, it felt, would provide a competitive advantage because of the narrative style used in the policies.Defendant insurance companies copied substantial portions of AFLAC’s policies for their own use.AFLAC sued, alleging copyright infringement. The Federal District Court found infringement of the non-boilerplate portions of the policies and enjoined the defendants from selling their infringing policies for the pendency of the suit. The moral: There is not likely to be a problem if you copy routine legal or business terms (lawyers do this routinely), but if you copy unique provisions that are important to another company’s business, you might find yourself on the short end of a copyright infringement lawsuit.
Why doesn't Aflac cover the time off you need after oral surgery?
I think we need to clarify a few things. Which Aflac policy are you talking about? The Aflac Dental policy is designed to help cover the cost of the actual dental care…. basically, the event. So, no. The dental policy will not cover time off of work. I don’t know of any dental insurance that will. The Aflac Short Term Disability policy is designed to help replace the pay you lost due to an injury, illness, or maternity. It requires a doctors order that you can not return to work after the care had been delivered. There are a few variables that will determine if/when your policy will pay out a benefit. Your agent that sold you the policy should have explained them at the time of application. If you have forgotten, reach out to them or to Aflac and they will help you.I hope that helped!
If you won the lottery, how would you deal with people and relatives after your fortune?
First of all, and I cannot stress this enough, accept the prize anonymously if your state allows you to do so. You'll be glad you did, because if word gets out you just won a kajillion dollar lottery, you'll get more phone calls and visits from more family members, old friends, and acquaintances than you ever realized you had.Second, consult with a lawyer and financial planner about what to do with all the money, before accepting the prize. Make sure all applicable taxes are paid before you do anything. Pay off all your debts in full before you do anything else. That means your house, car(s), and credit card(s) are fully paid with zero balance. And, any other installment items you are still paying on (I had to replace my home's air conditioner, for instance) and any personal loans you may owe friends or family members, if any.Next, start making some serious plans and identify what your goals are. Don't spend money like you have all the money in the world, because you don't. I am going to assume I just won hundreds of millions of dollars, by the way. Split up your funds into different accounts. Set up an investment portfolio. Set up one or more emergency funds that are strictly “hands off.” Set up trust funds and college funds for your kids. Set up one or more funds for charitable giving, and one or more funds for giving away. Set up a fund for your home improvement projects or purchasing and furnishing a new home, and then have funds for day-to-day and another for “fun money” (blowing on vacations or other lavish living). As for me, I would hire a reputable general contractor to completely redo my current residence, because my older son says he wants to stay here. I'm talking about stripping it down to the studs and starting over with high quality materials. Upgrade the plumbing, electrical, drainage, insulation, drywall, interior doors, everything. I want one of those two-story sheds in my backyard, wired and climate controlled, for all my tools, yard equipment, and stuff in the attic. I would consider switching to solar energy, and definitely want a whole house generator (since we live in a hurricane prone area, that's important). And, hire a good landscape architect to improve the frontyard, level the backyard, get rid of all the existing trees, and add a pool out back.My spouse likely will quit her job (I'm good with that, under the circumstances), but I likely would keep working until I could retire or I wanted to make my job fire me. I just don't know. My son, however, would have no access to any trust funds I set up for him unless he holds down a job or goes to school. I want him to live life and not spend the entirety of his adulthood on one long summer vacation.I definitely want to give some money away to do some good. St. Jude's Hospital, AFLAC Children's Cancer Center, and Shriner's Hospitals all are likely recipients, and I have thought of some kind of endowment for my college alma mater. BUT, I don't want my name on anything, and I will not give any money to any potential recipients unless they agree I will not lend my name OR face to any projects. Philosophically, I would feel better about any gifts if someone else's name was attached, like a war hero or someone who gave their life for the community.Beyond that, just have fun and enjoy life.
