What is the difference between copyright infringement and plagiarism?

US perspective:I blogged about this issue earlier this year (Plagiarism and Copyright Infringement). That post is reproduced below:This post compares plagiarism and copyright infringement. It is prompted by a Quora question that I answered several months ago. (See Have your ideas or works ever been plagiarized? What happened?)Plagiarism DefinedPlagiarism is the wrongful appropriate on another’s work and presenting it as one’s own. One typically thinks of plagiarism occurring in academia or journalism. However, as discussed below, it can occur in other professions, too.Copyright Infringement DefinedThe holder of the copyright in a work has certain exclusive rights with respect to that work. These include (as applicable) the rights to reproduce, distribute, publicly perform, publicly display, and make derivative works of the work. Copyright infringement is use of a work, without permission of the copyright holder, that infringes on one of those exclusive rights.Plagiarism and Copyright Infringement ComparedComparison of plagiarism and copyright infringement.Plagiarism focuses on misrepresenting the authorship or source of a work.Copyright infringement focuses on using someone else’s work without permission. They easily can come together. As a plagiarist prepares his work, he likely will copy and make derivative works of the original work or portions thereof. Because that is done without the copyright holder’s permission, it constitutes copyright infringement. My personal interest in – and victimization by – plagiarism dates back more than a decade. From 1995 to 2001, I wrote the Legal Tech column for the California Bar Journal. (My final column, A look back at six years of technology news, suggests how much simpler, and more limited, life was before ubiquitous high-speed Internet access, mobile devices and social media.)Plagiarism and Copyright Infringement in South AfricaAmazingly, one of my eagle-eye readers saw that De Rebus, a journal published monthly by the Law Society of South Africa, had published certain of my columns under the byline of a South Africa lawyer! Here is what the journal’s editor wrote in January 2001:Technology columns – an apologyDe Rebus has been advised by Dana H Shultz, an attorney of Oakland, California, specialising in technology licensing and related transactions, that two of the articles by Reinhardt Buys in the Practice Management column in the second half of last year contained substantial portions, verbatim, of articles written by Mr Shultz and published in the California Bar Journal, of which he is the legal technology columnist, other journals and on the Internet. The articles in question were ‘More money and happier clients – how technology can increase revenue and client satisfaction’ in 2000 (Oct) DR 39 and ‘Six technology mistakes every firm should avoid’ in 2000 (Nov) DR 32. Although the former contained a purported acknowledgment of Mr Shultz’s ‘assistance and guidance’, it appears that in neither case did Mr Buys seek Mr Shultz’s permission to use the latter’s published works as his own.In response Mr Buys has contributed the following note, under the heading ‘Setting the record straight’: ‘As readers may have realised, the information used to write this column comes from my personal experience, interviews with attorneys and information I get through newsletters, Internet chat-rooms and articles found on the Internet. Because of a terrible oversight on my side the article that appeared in De Rebus of November 2000 … was not attributed to Mr Dana Shultz whose material I also used for the article [in] October 2000 … My sincere apologies to Mr Shultz, De Rebus and our readers. I am truly embarrassed!’De Rebus also apologises to Mr Shultz for its unwitting part in the publication of this plagiarism – Editor.Interestingly, the lawyer had been on the editorial board of De Rebus. Once this plagiarism came to light, he no longer held that position.I do not know whether the foregoing will help you determine whether and when to bring suit.

What can people start doing now that will help them a lot in about five years?

1) Let me start on a morbid note.(I am sorry about this common truth. But I must say it). That your life at any moment may be extinguished - in a single breadth. This may happen in the next second, by a circumstance known to youand also due to factors beyond your control. You are just a speck of dust of humanity, within the unfathomable universe. Our existence as a flickering light, in the unpredictable wind of life, struggles so much, from being extinguished. If you want to be smart and to ensure an inner peace, which the world may not give you most times, you must continue to comprehend these things.Man is still engaged with all these unanswered curiosities.Till eternity, Man will continue to do this.So find your own path, without being injurious to others. Therefore, do your best to live as if tomorrow may not come. And if tomorrow comes, repeat the thoughts of the previous sentence. That is the vicious cycle of smart livingthat aught to guide your mortal soul and reality on this planet.I know and I have said it, but I struggle with it myself.2) That you can never know what the others think about you at anytime. This is irrespective of what the person professes about you. This does not exclude some friends, loved ones or even your spouse. These thoughts could be good. They could be bad. They could be perennial or fly for a fleeting moment.Circumstances determine. The same fellow may change his thoughts about you,in another situation or time period. You and I, are not different, either. Ok?But be good, because it is good.Though it takes much of a sacrifice. It is not easy to be good, I know.It is easy to destroy...don't you know?Your soul is the powerful beneficiary of the peaceful mind, ultimately. So infuse it with good thoughts about others. We may not in some cases. It is a struggle when we are wronged. And realize people change, as you would, depending circumstance and experience of life. But there is a constant character or personality which we all exhibit. This will still be there. And I remember this: don't rush to blab to an old friend you havenot seen in a few years or more.Recheck his person again. The world of hard knocks might have changed him, for good or bad. Some smart friends will subject you to that scrutiny too.We adults are complicated and our minds are very "deep".Bottomless pit.The person who really loves you, may not do much talking, but wishes you well in his mind.He doesn't just want the attention. Discover such persons. How?You will know. I can't tell you that.Nurture your instinct. Your Creator gave you that to use for many causes.3) That if you don't sow, you cannot reap.Heavens may nurture your seeds so well, for a bountiful harvest.Show gratitude. Others are smarter than you.Nature may kill your seeds, even before they sprout.Equally show gratitude. But ask why it happened.(After you have chosen to cry; who hasn't at least once? That act deals with anxiety and depression much better than personal abuse)The answer for your loss, could be your own fault. You may be lucky, a good friend could point them out for you.Why not, do objective introspection. The cause of your problems could also be external in nature.Whatever, find a solution.Start again from lessons garnered. But you must work smartly to reap the fruits of your labour..To a large extent, I believe in the:"cause and effect", as some progenitors of this dogma would tell you.But there is a place of unmerited favor and sheer luck.Nothing is absolute, as I believe many things are relative.Do not become a blind slave to man-made dogma. But work, which you must; but not in anticipation of luck and favor.Let those be unexpected icing.4) That not all things or experienced will reveal all truths. What we call the truth, as defined is subject to each person's circumstance;such as religion, location, norms and social mores.Of course, there are some universal truths.Look for them, for your peace of mind. The world is full of decoys, lies, deceits and of course some truths and facts. It is difficult to take time out to think, thoroughly. It is not a waste of time.(Don't use it as an excuse for procrastination, to get the work done.)Endeavor to look deeply, suppressing your usual pedestrian mode of rumination. You are most likely to discover some sacred truths. These ones, many in-the-know would not want to share with you.It shows you and I, are ignorant of many things, until those who know them, choose to reveal and prove them to us.If they so wish. Seek the truth yourself. You must, in that wise, seek continuous knowledge until you getthose sparks of inspiration, that would ignite in your being. That is your, "Aha" moment (did Oprah Winfrey coin that? :-) )5-1) That life and the world is about duality. It is about shades of experience. It is about the opposites and in-between.It is about building and it is also about destruction. These attributes are the fundamentals of our existence and our planet.Different situations, experiences and scenario fall under these attributes.A knife can peel the skin of a yam tuber - in the African context - before it is cooked.(You may substitute potato, if you wish. That's cool.)The same knife, may be used to inflict wounds on people. However the knife is neutral in its calling. But it can serve the purpose of duality andvarious shades of activities between the two extremes. The world will show you how much it is easier to destroy. It also shows how herculean, it is to build.Look around now. It is perceptible.A raffia thatched hut may take a day to be built.Whereas, sadly, a skyscraper built of solid concrete and steel,(with all sophisticated human creativity)could be brought down into smithereens in less than a day.It takes about 9 months before a human fetus becomes a bouncing baby. And the pains of birth.(Women tell us. I am not one. Salute to women.)But the same child - in the hands of a careless care-giver-may be lost within the twinkle of an eye.I can recall a painful extinction of a century old bank. This establishment disappeared due to one single error, committed by a single staff. Destruction in a day.In that vein, it is instructive to say that,to build your own good business or project ;systems, processes and many efforts must be deployed. But in the absence of having an eagle eye on all our efforts, things may go moribund or they die off.Likewise, to bring up a good child demands a lot of work.I know we have permissible societies in the world. But you must legally work around with love. And don't let that child call the police, provided you are doing good to show love. And for the lackadaisical parents,by their easy actions and inactions, they destroy this ignorant and naive kid. Therefore, what this portends for you and I, is that, nature forces us to sweat it out; if we desire to build up projects that will last.(It may not be everything).Same nature still plays pranks on uswhen the unwelcome challenge chooses to rear up its ugly head. But we must manage both extremes.5-2) That brings to mind that all humans are born as racists.Reason? We love our "self". A natural instinct. But you must develop yourself to overcome this irritation of the centuries.Granted, it will live with us.But do not let it restrict your overall appreciation of other peoples. The world has brought forth varieties to be enjoyed.Would you call that an error? How would it be, if this planet has been inhabited by one single race? One species of animals and plants? One formation of rock? One gender? (Even amoeba have duality)Plurality is it?If you allow yourself to be shackled by the continuous varied disdainof shades of pigmentation of the skin andthe anatomical features, you have just given your inner peace away.President Clinton was once quoted, to say that,if the skin of every race is cut, the color of the blood would still be red.I add my own.In the issue of duality and the opposite ends;the pigments embedded in each race, vary from one race to the other.Yet, I am waiting to see one human being, who created himself or herself!Even the albinos did not. Therefore, strive not to cheapen your soul over what you cannot create.See beyond the pedestrian things of life.Don't you know, you are a product of chance and freak of nature. We all are.And we were dropped in a particular place for a worthy purpose. So find your purpose in that place.I know you may have to negotiate with the adamant, to achieve your objectives.Avoid this mental irritation so that you can have your own peace within, wherever you find yourself in the journey of life. You are set free. But I warn, it will be tough before it gets easy.I am still struggling too because I am mortal.Love and respect to all who read...........................................................................................a) ......If you are an a struggling entrepreneur look up here and you maySignup for newsletters full of resourceshttp://muyiwaosifuye.comfor business and wellbeing of hardworking stressed entrepreneursb) Here is my book at Amazon using my pen name, Gary Rindson. We all do some type of marketing work as independent contractors for a range of businesses. We’ve each had our ups and downs. Yet, as I write this, things are going well for everyone.Connecting the dots, we realized that once we committed to specializing in a growing marketing platform, we had to actually start turning clients away. One of the fastest-growing segments is marketing automation, on platforms such as Ontraport and HubSpot. These platforms are experiencing explosive growth, and more are emerging all the time. Some other examples are Aweber, Convert Kit, and MailChimp.Taking a certification course to become a specialist can often land you in the $60 to $100 per hour range fast.See: Best Online Jobs for College Students#14) — SCOPINGQuick summary: Edit transcripts for court reportersAverage pay: $20 to $30 per hourThere’s a little-known work-from-home job that’s been around for 30+ years. Court reporters then hire scopists to edit their transcripts.Court reporters make money per page, not per hour. That’s why outsourcing the editing allows them to increase their earning potential.Similar to proofreading and bookkeeping, no certification is required, there are very minimal start-up costs, and the earning potential is high.If you’re interested, Linda Evenson — who has been a work-at-home scopist for 35-years — has a free course called Scoping: College Level-Income Without College-Level Costs.#15) — MEDICAL TRANSCRIPTIONQuick summary: Edit medical transcriptions for local healthcare providersAverage pay: $10 to $25 per hourThere are dozens of data entry jobs online. If so, you can make money online by flipping items for profit.Think of this side hustle as buying an asset and selling it for a higher price. Your inventory can be anything you find at a garage sale or on a clearance rack. The goal — and the key to making retail arbitrage work — is having an information advantage. This means understanding the market for what you’re buying better than the person who is selling that item.Remember, the concept of arbitrage is based on the principle that a particular good has a higher price in one place than it does in another. That might mean it sells for more in California than it does in New York. But it might also mean that it sells for more online than it does in a brick-and-mortar store. It’s actually something me and a friend have dabbled in (although without much success so far). The idea is to buy products directly from a manufacturer or wholesaler, then sell them online on Amazon. The most popular option is to use Amazon FBA, which handles all the warehousing and shipping (the “fulfillment”) for you. In fact, you can even have the manufacturer or distributorship the products directly to Amazon, so that you never have to physically touch the items. But you don’t have to limit your selling to Amazon. You can also use FBA to ship products you sell on eBay or your own website.
