This is Kirk Bloodsworth.This is also Kirk Bloodsworth, 34 years ago.In 1984, he was arrested for the violent rape and murder of 9-year-old Dawn Hamilton in Rosedale, Maryland, a town in Southeast Baltimore County. As it was stated in the Court of Appeals,On July 25, 1984, police discovered the partially nude body of nine year old Dawn Hamilton in a wooded area near Golden Ring Mall in eastern Baltimore County. The victim was found lying on her stomach with an eight inch stick protruding from her vagina. Near the victim's head was found a large piece of concrete with a possible blood stain. The victim's skull was "fractured" and "depressed" and her scalp had "two tears" with a "very rough edge". The victim's neck had a "patterned abrasion". The opinion of the medical examiner, Dr. Dennis Smyth was that the death was a homicide and "was a result of blunt trauma to the head and strangulation."[1]Understandably, the public was outraged. They demanded to know who killed the innocent child and they wanted that criminal to be put to death (which I, if in their position, would agree with).Kirk was brought to court on charges of sexual assault, rape and first degree pre-meditated murder, facing death by Maryland’s gas chamber. The jury found him guilty of all charges and he was sentenced to death.He spent his few months on death row in the oldest prison in the western hemisphere, the Maryland Penitentiary. The prison was corrupt and riddled with violence.[2] Kirk spent a few months there; and then, days before the judge was to sign the papers warranting his death, an appeal was accepted.So, once more, Kirk walked into the courtroom, and once more, was found guilty. This time however, the Judge sentenced him to “only” two consecutive life sentences. He was still to die in prison.But as you might have already guessed…He was innocent.The person who actually did it was in a cell one floor beneath his for a different crime.Now, I read the book[3]; it went over every detail of the trial. And really? He shouldn’t have been found guilty in the first place. All of the evidence presented by the prosecution was circumstantial evidence, not direct evidence. In a perfect world, he would have been found innocent. But he wasn’t. Why? The state acted as the prosecution. And do you want to know what the state did?They violated the Brady v. Maryland Supreme Court case.They apparently couldn’t find any bodily fluids on the clothes even though there actually was.They withheld exculpatory evidence.Good Lord, the judge even kept a DNA sample in a paper bag in his office.So the state, in breaking laws and being about as transparent as a brick, was able to sentence an innocent and honorably discharged former Marine to death.So, what has this been leading up to?The State needs to be held accountable.Often we do well at holding our governments accountable. But too often, we don’t. No one on the prosecution was punished for their lack of due process, for their illegal actions. That can not be accepted. We, the people, whether you live in the US, UK, Japan, wherever, need to hold our government accountable for their crimes. They shouldn’t be some invincible group of people that can do things such as what happened in that case.This man lost one of the most valuable times of his life largely in part to government corruption and failure. That is, in my opinion, a tragedy.EDIT:In case anyone is wondering how he got out, it’s worth pointing out he was the first death row inmate exonerated by DNA evidence. Every day he would wake up, go to the library, and pore over books on law and forensics. He would then write a daily letter to people who were either nationally famous, locally known and everyone in between. When he discovered the DNA process, after spending thousands of dollars (his family were fishermen, they didn’t have much money), they found a small bit of semen on Dawn Hamilton’s panties and tested it (those were the panties that were kept in the Judge’s chambers… in a paper bag…). He was then pardoned by the Governor of MD in ‘93.It wasn’t until, I believe, 2003 that the state looked into who actually did it. They arrested Kimberly Shay Ruffner for the crime and he pleaded guilty. Until Ruffner pleaded guilty, a lot of people were doubters. In his rural coastal town in Southern Maryland they didn’t know what DNA was except it was some fancy science shit. A lot of them doubted the credibility of the test and he had trouble finding work. As far as I’m aware, the only doubters nowadays would be the uninformed ones or conspiracy theorist.But yes, it is tragic that such a thing happened.
