The general requirements a Lender must meet for SBA to guaranty 7(a) loans are described, in part, in the SBA Form 750, Guaranty Agreement. The Authorization provides specific requirements for each 7(a) loan. Lenders are expected to close 7(a) loans in the same manner in which they close non-SBA loans. Lenders are responsible for knowing how to properly close loans, secure collateral, obtain and perfect the required lien positions, and meet other authorization requirements.SBA relies on representations in the loan application and supporting documents in issuing the Authorization. The SBA guaranty is contingent upon the Lender:Complying with the SBA Loan Guaranty Agreement, SBA Form 750 (SBA Form 750B for short-term loans) and any other required supplemental guaranty agreements between Lender and SBA;Paying the guaranty fee in a timely manner;Complying with current regulations and SOPs;Having no evidence of unremedied adverse change that would prevent disbursement;Satisfying all the conditions of the Authorization; andMaking timely disbursement.Three of the most common deficiencies leading SBA to recommend a cancellation, denial or repair of its guaranty (at the time the lender requests that SBA honor its guaranty) happen at loan closing:Unauthorized, improper, uncontrolled, or undocumented disbursement of loan proceeds.Failure to obtain or adequately document a required equity injection.Failure to obtain required collateral or properly perfect lien position.Closing also is the last time the Lender has an opportunity to discover eligibility and credit problems before the Lender disburses the loan.

I also find many differences between the two cases, most importantly:Kosovo become world problem, while Crimea avoided Ukrainian civil war. Even now Albanians prevent hundreds of thousands of Serbian refuges to come back to their homes, or even visit the graves of their family members in Kosovo. In Crimea even Ukrainians have more reasons to complain about how Ukraine treats them, then how Russia threats them.Kosovo become mafia state, while Crimea become part of civilized society. When Albanian from Kosovo get seriously sick, he or she has to move to central Serbia and get Serbian health insurance in order to get free medical assistance, social security is on much higher level in Crimea than in independent Ukraine.How successful state Kosovo is, is best illustrated by hundreds of thousands Albanians from Kosovo who applied for asylum in EU after Kosovo declaring it’s independence.Russians lived in Crimea legally, they were no illegal immigrants unlike Albanians in Kosovo.Ukrainians in Crimea never made big demonstrations against Crimea joining Russia, or showed in any way that they do not like new status. The only ethnic group, showing displeasure with Russian rule are Tatars, who were no more happy with Ukrainian rule.Kosovo independence is not welcomed by any other ethic group but by Albanians.Albanians live in other parts of Serbia, without discrimination. In parts where they present significant percent of population, they have education in Albanian.Russians in rest of Ukraine, or even Ukrainians who prefer to Russian, are constantly attacked by Ukrainian ultra-nationalists. There is no more education in Russian.No one was killed in Crimea, because of his/her nationality, or political opinion. In Kosovo members of so called Kosovo Liberation Army (short KLA,which was on list of terrorist organisations even in US until 1 998) killed thousands of people just for being Serbs, Montenegrin, Gypsy, or Gorani, and thousands of Albanians for disobeying KLA and supporting legal Serbian police in fighting terrorists.But the question asks about similarities, so here they are:US guarantied by the treaties sovereignty of both Serbia and Ukraine. (Google for Budapest Memorandum on Security Assurances and Kumanovo Agreement.)Both had significant majority of population who wanted separation from current country, and joining other county. Yes I know, Kosovo have not joined Albania, at least not yet.Both separated from vary unstable countries, who were not capable to provide normal lives to local population.

There have been some media reports that India and China have agreed to a road map to disengage in Ladakh. The first point of disengagement would be the Pangong Tso lake area. The final decision is yet to be taken.As per this understanding, there would be three phases of disengagement in the Pangong Tso lake area (in one week) -1) On the first day, armored vehicles (including tanks) would be moved back to a significant distance from their frontline deployment.2) On the northern bank of the Pangong Tso lake, both sides would withdraw one-third of their troops for three days. India will come back to Dhan Singh Thapa post situated between Finger 2 and Finger 3. China will go back to Srijap (someone says it Finger 6 and someone says it Finger 8). The land between Dhan Singh Thapa post and Srijap post would become no man's land & no Army would patrol this area.3) Both Armies will withdraw from the peaks & posts on the southern bank of Pangong Tso lake. We must remember that this was the place where India had occupied many peaks on the night of August 29th and 30th which caught the Chinese off guard.The main focus would be the verification process of Chinese withdrawal. In Galwan Chinese refused to go back after agreeing to go back and this resulted in the bloody clash. There is a saying that the moment you trust China you will lose half of the game.My concerns for such agreement areas -Chinese philosophy has been to use talks & agreements to buy time. Even if they go back they will come back next year or so. India must ensure that the Indian Army should not be caught by surprise next time. India should also use this time to strengthen its defenses. What is the guaranty that China will not come back next time?Why India is dealing sector by sector with China. India has the upper hand on the southern bank of the Pangong Tso lake but the Indian position is weaker in Depsang plains for many decades. Indian offensive action on Southern Bank of Pangong Tso lake under the full Chinese view was one of the boldest decisions. Now India will have to give up those peaks and peaks in front of Finger 4 without gaining much in Depsang. Next time, the Chinese would be more alert & may not allow India to capture those peaks again. And now China has started to build an alternative road in that area which will be out of sight of India.China has the advantage of terrain in Ladakh and if both armors withdraw to equidistance then China will be able to bring their tanks much quickly to the front line than India.Even Chinese Media has confirmed this - (but we must not read much into they statement that India will withdraw first)Indian Army is a very tough Army and more than enough for China. But we must not lose the advantage in diplomacy that our Army gave to us - Santosh Babu & his Bihar Regiment during the Galwan clash and daring climb on several peaks on the Southern bank of the Pangong Tso lake.
