We have two MD’s, lets call them Girish and Harsh. As it is a very small consultancy, we do not have proper policies in place and everything is worked out as is required.Now, me and my husband start planning to have a baby, so I asked my HR manager about the maternity benefit policy of the company. She informed me there is no such policy in the company as of now, as there had never been a case before. We have a women cell which is headed by Harsh’s and Girish’s wife, Anamika and Sunita. So my HR manager told me to discuss this in women cell meeting. At the next meeting, I raised this query, to which Anamika replied without any hesitation, that whatever the Government rules are regarding this matter, we will follow the same. It is 26 weeks of paid leaves and that shall be provided. I decided to have a word with our MD’s, but before I could, all girls, except Neha, were called for a meeting in MD’s office. They started the meeting by saying that it is regarding Neha. She had not been performing well in the past and due to her they lost their most prestigious client (who was responsible for around 40% of their revenue), as they have refused to give us any further work, owing to the mistakes and re-submissions Neha had done in the previous project. So they requested Neha to resign, but she refused to do so. So they wanted our opinion in this matter. I couldn’t believe what I was hearing. My first response was that it a company matter, why are we getting dragged into this. They said since she is pregnant, we wanted all women’s opinion. I told them they cannot terminate her during her pregnancy, it is illegal as per maternity policy of the government. Also, I told them they have to provide paid maternity leaves also. To this, Harsh replied the policy is for government organisations and doesn’t apply to us. I reminded him that his wife, Anamika had promised us the same benefits shall be provided, to which he replied, she doesn’t know the laws, we will be providing the leaves but we will not pay. I told them it was unfair on their part as now we cannot even switch company. My words were falling on deaf ears so I didn’t argue again. The meeting went on for around 20 minutes and it was finally agreed that Neha would just be given a written warning and left.3 days after, my husband decided to have a word alone with Girish regarding maternity benefits as I was taking a lot of stress for the same. Girish assured my husband that it was just that they didn’t want to provide any extra benefit to Neha, I would receive the benefit in some other way, like bonus or incentive. We didn’t believe their words, but as my husband was employed in the same company, I decided not to go for a legal action right now. I just remembered a quote in my mind, “No need for revenge. Just sit back and wait. Those who hurt you eventually screw up themselves and if you are lucky, God will let you watch.” So i kept my calm and resuemd my work.1 week forward, Harsh and Girish call me and my husband in their cabin. The conversation goes like this :Girish - We have enquired about the law a little and we think that it is payable. But still it is unclear, somewhere it is 3months paid and somewhere 6 months. Also, it is not clear whether full salary is payable or only basic.Harsh - We are still enquiring about it and if it is payable,we will pay. If it is not, we will not.Girish - No, there’s no question of not paying. I hope forever…if there are no significant improvements done, but it would be surely urged as advisable to soon create a new aircraft from scratch not based on such an old design..it is now a faulty design with the newer, big engines on this old design which needs inevitably a software tweak, the MCAS to using them anyhow.
