We had a bunch of friends and family over and had just sat down for dinner when we heard a knock on the door. We weren’t expecting anyone else, so I had no idea who might be at the door. Imagine my surprise when I opened the door to find a Fedex driver with a thick envelope containing my signed (and completely unburnt) divorce papers. While defects in form may not be grounds for a court clerk to reject a paper, they are certainly grounds for a judge to refuse to sign a decree and thus can contribute to delays.It is also worth mentioning that divorce proceedings are only “fast,” even in places with no waiting period, when both parties agree on the relief sought and the respondent immediately comes in and files something agreeing with the relief sought. While it isn’t particularly difficult to get divorce by “default”, a divorce obtained that way will of necessity involve waiting some period of time that is provided by court rules relating to objections to pleadings. (Those delays would be a minimum of 40 days from date of service in Pennsylvania; conversely one divorce I had where both parties were keen on it and co-operated to sign all the required forms, I was able to file the divorce complaint, acceptance of service, affidavits, waivers, and praecipe all at once and I obtained the decree within a week.)You should be able to get a more precise answer by consulting a lawyer in Colorado and, assuming that one of you does not live in Colorado, a lawyer in the other place.
